A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
MIAMI GARDENS, FLORIDA, APPROVING A WAIVER OF PLAT
FOR M&R PROPERTIES AND INVESTMENTS, INC. FOR THE
PROPERTY LOCATED AT 15649 NW 38TH CT, MIAMI
GARDENS, FLORIDA 33054, ATTACHED HERETO AS EXHIBIT
"A"; PROVIDING FOR THE ADOPTION OF
REPRESENTATIONS; PROVIDING FOR AN EFFECTIVE DATE.
WHEREAS, applicant M&R Properties and Investments Inc., has submitted a
request for a waiver of plat for approximately a half-acre of residential property located at
15649 NW 38th Court, consisting of Folio No. 34-2117-004-3140, see attached hereto as
Exhibit “B”, and
WHEREAS, Article VII - Plats, Subdivisions, Excavations, Address Assignment of
the City of Miami Gardens Land Development Regulations (LDRs) requires a City Council
Resolution in order to approve a waiver of plat, and
WHEREAS, the request for a waiver of plat submitted by M&R Properties and
Investments Inc. has been reviewed by the Planning and Zoning staff and the City
Surveyor and has been determined to be in compliance with the City’s LDRs and Fla.
Stat. § 177.081(1), see attached hereto as Exhibit “B”, and
WHEREAS, upon approval by the City Council, the waiver of plat will be reviewed
and approved by the Miami-Dade County Plat Committee and subsequently recorded in
the Official Records of Miami-Dade County, and
WHEREAS, Planning and Zoning staff recommends the City Council approve the
request for a waiver of plat submitted by M&R Properties and Investments Inc. for
approximately a half-acre of residential property located at 15649 NW 38th Court,
consisting of Folio No. 34-2117-004-3140.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF MIAMI GARDENS, FLORIDA AS FOLLOWS:
Section 1: ADOPTION OF REPRESENTATIONS: The foregoing “WHEREAS”
paragraphs are hereby ratified and confirmed as being true, and the same are hereby
made a specific part of this Resolution.
Section 2: APPROVAL: The City Council approves the request for a waiver of plat
submitted by M&R Properties and Investments Inc. for approximately a half-acre of
residential property located at 15649 NW 38th Court, consisting of Folio No. 34-2117-
004-3140.

Section 3: EFFECTIVE DATE: This Resolution shall take effect immediately upon
its final passage.
