A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
MIAMI GARDENS, FLORIDA, APPROVING A WAIVER OF PLAT
FOR 'LUIS MORENO AND RINA MARIBEL MORENO' FOR THE
PROPERTY LOCATED AT 15915 NW 40TH COURT, MIAMI
GARDENS, FLORIDA 33054, ATTACHED HERETO AS EXHIBIT
"A"; PROVIDING FOR THE ADOPTION OF
REPRESENTATIONS; PROVIDING FOR AN EFFECTIVE DATE.
WHEREAS, the applicant, Luis Moreno, wishes to subdivide an oversized single
family lot into a double lot, and
WHEREAS, the lot is located at 15915 NW 40th Court with a Folio Number of 34-
2117-004-1492, and
WHEREAS, the lot is approximately 16,800 square feet in size and is proposed to
be subdivided into two (2) single family lots of 8,400 square feet each, and
WHEREAS, this is in keeping with the general lot size of existing single family
homes in the area and meets or exceeds the 7,500 square feet minimum for single family
lots as outlined in Section 34-342: Table for Development Standards of the City's Code
of Ordinances, and
WHEREAS, Article VII - Plats, Subdivisions, Excavations, Address Assignment of
the City of Miami Gardens Land Development Regulations (LDRs) requires Waiver of
Plat approval be granted by the City prior to recordation by Miami-Dade County, and
WHEREAS, the 'Luis Moreno and Rina Maribel Moreno' waiver of plat as shown
in Exhibit “A” has been reviewed by Planning and Zoning staff and by the City Surveyor,
and has been determined to be in compliance with the City’s LDRs and with Section
177.081(1) – Platting Dedication and Approval of Florida Statues as shown in Exhibit “B”,
and
WHEREAS, upon approval by the City Council the waiver of plat will then be
reviewed and approved by the Miami-Dade County Plat Committee and subsequently
recorded in the Official Records of Miami-Dade County, and
WHEREAS, Planning and Zoning staff recommends the City Council approve the
request for a waiver of plat submitted by 'Luis Moreno and Rina Maribel Moreno' for the
lot located at 15915 NW 40th Court with a Folio Number of 34-2117-004-1492,
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF MIAMI GARDENS, FLORIDA AS FOLLOWS:

Section 1: ADOPTION OF REPRESENTATIONS: The foregoing Whereas
paragraphs are hereby ratified and confirmed as being true, and the same are hereby
made a specific part of this Resolution.
Section 2: AUTHORIZATION: The City Council of the City of Miami Gardens
hereby approves a waiver of plat for 'Luis Moreno and Rina Maribel Moreno’ for the
property located at 15915 NW 40th Court, Miami Gardens, Florida 33054.
Section 3: EFFECTIVE DATE: This Resolution shall take effect immediately upon
its final passage.

GARDENS AT ITS SPECIAL MEETING HELD ON NOVEMBER 10, 2021.
