HomeMy WebLinkAbout2021-150-3704_-_Bread_of_Life_Variance_-_Adopted.docxRESOLUTION NO. 2021-150-3704 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF MIAMI GARDENS, FLORIDA, APPROVING THE VARIANCE APPLICATION SUBMITTED BY KEITH MOORE ON BEHALF OF BREAD OF LIFE CHURCH LOCATED AT 16305 NW 48TH AVENUE, MIAMI GARDENS, FL 33014, MORE PARTICULARLY DESCRIBED ON EXHIBIT "A" ATTACHED HERETO, WAIVING THE MINIMUM FLOOR AREA REQUIREMENT SET FORTH IN THE CODE FOR PLACES OF ASSEMBLY FROM 15,000 SQ FT TO 10,170 SQ FT; PROVIDING FOR THE ADOPTION OF REPRESENTATIONS; PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, Applicant, is Keith Moore on behalf of Bread of Life Church located at 16305 NW 48th Avenue, Miami Gardens, FL 33014, more particularly described in Exhibit “A” attached hereto, and WHEREAS, the subject site is zoned I-2, Heavy Industrial with a “Commerce” designation in the City of Miami Comprehensive Development Master Plan (CDMP), and WHEREAS, Bread of Life Church has operated at the facility since 2017, however the applicant never obtained a Zoning Certificate of Use (CU) which is a requirement to be properly licensed in the City if Miami Gardens and issued a Business Tax Receipt (BTR), and WHEREAS, in order to become compliant, the Church must meet the minimum standards required for Places of Assembly set forth in the Code of Ordinances, and WHEREAS, pursuant to Section 34-288 (33) Use Permitted With Extra Requirements of the City of Miami Gardens Land Development Regulations, Places of Assembly must meet certain minimum standards including a minimum gross floor area of 15,000 square feet as set forth in Section 34-288 (33)(c), and WHEREAS, the Applicant requests a non-use variance to allow a reduction of the 15,000 square feet minimum allowable floor area requirement to permit a minimum allowable floor area of 10,170 square feet, and WHEREAS, the City’s Planning and Zoning staff has reviewed the application and a staff report is attached hereto as Exhibit “B”, and WHEREAS, staff recommends the City Council approve the application for a non- use variance to allow a reduction of the 15,000 square feet minimum allowable floor area requirement to permit a minimum allowable floor area of 10,170 square feet, and NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF MIAMI GARDENS, FLORIDA AS FOLLOWS: DocuSign Envelope ID: 26B747CC-E35A-4298-B22A-203FAA1887FD Page 2 of 2 Resolution No. 2021-150-3704 Section 1: ADOPTION OF REPRESENTATIONS: The foregoing Whereas paragraphs are hereby ratified and confirmed as being true, and the same are hereby made a specific part of this Resolution. Section 2: AUTHORIZATION: The City Council of the City of Miami Gardens hereby approves the application for a non-use variance to allow a reduction of the 15,000 square feet minimum allowable floor area requirement to permit a minimum allowable floor area of 10,170 square feet. Section 3: EFFECTIVE DATE: This Resolution shall take effect immediately upon its final passage.
