HomeMy WebLinkAbout2022-025-3738_-_Release_of_Restrictive_Covenant_to_facilitate_the_Bridge_Point_Commerce_Center_WEST_RESOLUTION NO. 2022-025-3738 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF MIAMI GARDENS, FLORIDA, RELEASING THE DECLARATION OF RESTRICTIONS FOR PROPERTY LOCATED AT 21301 NW 47TH AVENUE, MIAMI GARDENS, FLORIDA, TO FACILITATE THE DEVELOPMENT OF BRIDGE POINT COMMERCE CENTER WEST; AUTHORIZING THE CITY MANAGER TO EXECUTE A RELEASE FOR THIS PURPOSE; PROVIDING FOR THE ADOPTION OF REPRESENTATIONS; PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, in July of 1990, Miami-Dade County entered into a Declaration of Restrictions (Declaration) with the Town of Surfside and Riviera Realty Investments, Inc., for land located at 21301 NW 47th Avenue, Miami Gardens, Florida, where the proposed use was for a commerce park, and WHEREAS, the property is now owned by MG Westside, LLC, (Owner) and Owner proposes to construct a commerce park located immediately to the west of Bridge Point EAST, and WHEREAS, the proposed Bridge Point WEST development will serve as a Phase II to Bridge Point EAST and is expected to house several national tenants upon completion, and WHEREAS, the recorded Declaration and development restrictions contained therein must be released and of no further force or effect to facilitate the development of Phase II, and WHEREAS, the proposed commerce park will still be required to be developed in a manner that addresses landscape, fire safety, solid waste management, stormwater drainage, vehicular access and circulation, and utilities such as water and sewer, WHEREAS, the Department of Environmental Resources Management (DERM) will review the site for any environmental remediation or monitoring that is necessary as a result of it being a former landfill, and WHEREAS, City Staff recommends the City Council release the Declaration of Restrictions for property located at 21301 NW 47th Avenue, Miami Gardens, Florida, to facilitate the development of Bridge Point Commerce Center WEST, NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF MIAMI GARDENS, FLORIDA AS FOLLOWS: DocuSign Envelope ID: F4BD1957-47F0-416A-8342-0852BAAFE339 Page 2 of 2 Resolution No. 2022-025-3738 Section 1: ADOPTION OF REPRESENTATIONS: The foregoing Whereas paragraphs are hereby ratified and confirmed as being true, and the same are hereby made a specific part of this Resolution. Section 2: AUTHORIZATION: The City Council of the City of Miami Gardens hereby release the Declaration of Restrictions for property located at 21301 NW 47th Avenue, Miami Gardens, Florida, to facilitate the development of Bridge Point Commerce Center WEST and authorizes the City Manager to execute a release for this purpose. Section 3: EFFECTIVE DATE: This Resolution shall take effect immediately upon its final passage.
