CALL TO ORDER/ROLL CALL The City Council for the City of Miami Gardens, Florida, met in special session, Nov 10 2021, beginning at 07:00 PM, in the Council Chambers, 18605 NW 27th Avenue, Miami Gardens, Florida. The following members of the City Council were present: Mayor Rodney Harris, Councilwoman Katrina Wilson, Councilman Robert Stephens, and Councilwoman Linda Julien. Also in attendance were: City Manager Cameron Benson, City Attorney Sonja Dickens, and City Clerk Mario Bataille. 2. INVOCATION Councilman Stephens delivered the Invocation. 3. PLEDGE OF ALLEGIANCE 4. ORDER OF BUSINESS Item 7.3.2 will be the first Quasi-Judicial Item heard this evening. Councilwoman Wilson pulled Item 6.1 from the Consent Agenda. A motion made by Councilwoman Julien, seconded by Mayor Harris, to approve the Agenda as amended passed and carried by a unanimous voice vote. 5. PUBLIC COMMENTS Theophins Williams, 1391 NW 95th Street, Miami, FL appeared before the Council and spoke in opposition of the City's Red Light Camera Program. Andre Brown 3440 NW 213th Street, Miami Gardens, FL appeared before the City Council and shared concerns regarding unsafe and hostile work environment within the Public Works Department. 6. CONSENT AGENDA: 6.1. A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF MIAMI GARDENS, FLORIDA, APPROVING A WAIVER OF PLAT FOR 'LUIS MORENO AND RINA MARIBEL MORENO' FOR THE PROPERTY LOCATED AT 15915 NW 40TH COURT, MIAMI GARDENS, FLORIDA 33054, ATTACHED HERETO AS EXHIBIT "A"; PROVIDING FOR THE ADOPTION OF REPRESENTATIONS; PROVIDING FOR AN EFFECTIVE DATE. Answering a question posed by Councilwoman Wilson, Deputy City Manager Craig Clay indicated by approving this item the property will become two taxable properties. A motion offered by Councilman Stephens, seconded by Councilwoman Julien, to approve the Resolution passed and carried by a 4 to 0 roll call vote of the City Council. 6.2. A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF MIAMI GARDENS, FLORIDA, APPROVING THE 'MIAMI GARDENS S.P.' FINAL PLAT FOR THE PROPERTY GENERALLY LOCATED AT 4500 NW 183RD STREET, MIAMI GARDENS, FLORIDA 33055, ATTACHED HERETO AS EXHIBIT "A"; PROVIDING FOR THE ADOPTION OF REPRESENTATIONS; PROVIDING FOR AN EFFECTIVE DATE. A motion offered by Councilman Stephens, seconded by Mayor Harris, to approve the Consent Agenda passed and carried by a 4 to 0 roll call vote of the City Council. 7. QUASI-JUDICIAL ZONING HEARINGS/JENNINGS DISCLOSURE: Planning and Zoning Director Nakeischea Smith read into the record the rules for this evening Quasi-Judicial Hearings. 7.1 ORDINANCES ON FOR FIRST READING/PUBLIC HEARING(S): 7.1.1. AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF MIAMI GARDENS, FLORIDA, APPROVING THE APPLICATION SUBMITTED BY ARTURO GRIEGO ON BEHALF OF MOUNT HOPE CHURCH, FOR THE REZONING OF PROPERTY LOCATED AT 15525-15555 NW 22ND AVENUE IN MIAMI GARDENS, FLORIDA 33054, MORE PARTICULARLY DESCRIBED IN EXHIBIT “A” ATTACHED HERETO, FROM NEIGHBORHOOD COMMERCIAL (“NC”) TO R-15 MULTIPLE FAMILY DWELLING RESIDENTIAL (“R-15”); PROVIDING FOR ADOPTION OF REPRESENTATIONS; REPEALING ALL ORDINANCES IN CONFLICT; PROVIDING A SEVERABILITY CLAUSE; PROVIDING FOR INCLUSION IN CODE; PROVIDING AN EFFECTIVE DATE. City Clerk Bataille administered the oath of truthfulness. Direct Smith presented the Item and answered questions posed by the City Council. She indicated staff recommends approval of the Item. A motion was made by Councilwoman Julien, seconded by Councilman Stephens, to approve the Resolution. Arturo Griego, Architect for the Project, provided an overview on the planned development project and the purpose of the application which is their plan to build two story townhouse. The owner of the property appeared before the City Council indicated this would be rental properties. Answering a question posed by Councilwoman Julien, Director Smith indicated and explained the five criterias the applicant has met in the Zoning Review and Analysis. Answering a questions posed by Councilwoman Wilson, Mr. Griego indicated the estimated average rent for the property will be between $2000 - $2400 with an square footage of 1350. They are expected to build 41 townhome units with two parking spaces per townhome. After further discussion on the Item, Mayor Harris recommended the Item be deferred to allow there to be a community meeting between the residents and the applicant. Councilman Stephens indicated he will coordinate the Community Meeting. A motion offered by Mayor Harris, seconded by Councilman Stephens, to defer the Item to the January 12, 2022 at 7:00 PM passed and carried by a 4 to 0 roll call vote of the City Council. Mayor Harris opened the floor for public comment. There being no public comment, Mayor Harris closed the floor. Deputy City Manager Clay briefed the Council on the Item and recommended approval on second reading. 7.3 RESOLUTION(S)/PUBLIC HEARING(S) 7.3.1. A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF MIAMI GARDENS, FLORIDA, APPROVING THE WAIVER OF MINIMUM REQUIREMENTS FOR RECREATION/PLAY AREAS FROM 42,000 SQUARE FEET TO 1,634 SQUARE FEET FOR THAT CERTAIN PROPERTY LOCATED AT 18441 NW 2ND AVENUE, MIAMI GARDENS, FLORIDA, MORE PARTICULARLY DESCRIBED IN EXHIBIT “A” ATTACHED HERETO, AS SET FORTH IN SECTION 34-288 OF THE CITY OF MIAMI GARDENS CODE OF ORDINANCES; PROVIDING FOR THE ADOPTION OF REPRESENTATIONS; PROVIDING FOR AN EFFECTIVE DATE. City Clerk Bataille administered the oath of truthfulness to all interested parties. Mayor Harris opened the floor for public comment. There being no public comment, Mayor Harris closed the floor. A motion was made by Councilman Stephens, seconded by Mayor Harris, to approve the item. Director Smith presented the item and answered questions posed by the City Council. Ms. Smith indicated staff is recommending approval of the application. Mark Grafton, representing the applicant, provided an overview of the application and was joined by Johnny Gaspard answering questions posed by the City Council concerning the schools capacity, organization, operation, and recreation area. Councilwoman Wilson shared concerns with the limited recreational area this waiver would provide. Answering a question posed by Councilman Stephens, David Coviello (representative for the applicant) confirmed the school did receive approval of a building permit to construct the school but has not received a certificate of use. Approval of this item would afford the school to obtain the certificate of use. Answering a question posed by Councilman Stephens, confirmed the applicant received a building permit but not issued a certificate of use to operate. The permitting process is separate and apart from the certificate of use. Answering a question posed by Councilwoman Julien, Deputy City Manager Clay confirmed the school did not receive a business tax receipt or a certificate of use. Mr. Coviello indicated if they are unable to receive approval they would have to shut down the school. Deputy City Manager Clay suggest possibly including a declaration of restriction as it pertains to busing the students to the local park for recreational activity. Attorney Dickens recommended the City Council defer the item in order to bring the item on the condition of declaration of restriction covenant. A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF MIAMI GARDENS, FLORIDA, APPROVING THE VARIANCE APPLICATION SUBMITTED BY KEITH MOORE ON BEHALF OF BREAD OF LIFE CHURCH LOCATED AT 16305 NW 48TH AVENUE, MIAMI GARDENS, FL 33014, MORE PARTICULARLY DESCRIBED ON EXHIBIT "A" ATTACHED HERETO, WAIVING THE MINIMUM FLOOR AREA REQUIREMENT SET FORTH IN THE CODE FOR PLACES OF ASSEMBLY FROM 15,000 SQ FT TO 10,170 SQ FT; PROVIDING FOR THE ADOPTION OF REPRESENTATIONS; PROVIDING FOR AN EFFECTIVE DATE. City Clerk Bataille administered the oath of truthfulness on the item. Director Smith presented the Item and answered questions posed by the City Council. Additionally she stated staff recommends approval of the application. Mayor Harris opened the floor for public comment. There being no comment, Mayor Harris closed the floor. A motion was made by Councilman Stephens, seconded by Councilwoman Julien, to approve the Resolution. Answering a question posed by Councilwoman Julien, Pastor Keith Moore indicated the Church has been at that location for the last four years and leasing the facility. After further discussion on the item, Mayor Harris called the question. 8. REPORTS OF CITY MANAGER/CITY ATTORNEY/CITY CLERK (3 MINUTES EACH) Deputy City Manager Craig Clay announced the City was awarded the Project of the Year Award by the American Public Works Association for the Hard Rock Pedestrian Bridget and Tunnel Project. In addition, Public Works Director Tom Ruiz was awarded the Lifetime Achievement Award for his dedication and outstanding services in the profession. Deputy City Manager Craig Clay announced the City was awarded the 1st Place Eagle Award by the Association of Builders and Contractors for the Senior Center Project. 9. Councilman Stephens continued to announce his upcoming Turkey Drive. Councilwoman Julien announced the upcoming 10th Annual Science Fair and Award Ceremony. Councilwoman Wilson reported on her last Meet Me Monday Meeting. Mayor Harris reported on his trip to Tallahassee where he met with State Representative and Senators. In addition Mayor Harris briefed the Council on the approval of the City annexation project by the County's advisory committee and is in its final stage of approval. Mayor Harris announced the City upcoming Veteran's Day Event. 10.
