A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
MIAMI GARDENS,FLORIDA, AUTHORIZING THE CITY
MANAGER AND CITY CLERK TO EXECUTE AND ATTEST
RESPECTIVELY,THAT CERTAIN AGREEMENT WITH THE
HAIMOV GROUP, LLC, PERMITTING THE DISBURSEMENT OF
ESCROW FUNDS IN THE AMOUNTS OF ONE HUNDRED AND
FIFTY THOUSAND DOLLARS ($150,000) TO THE CITY AND
FIVE TODOLLARS ($500,000)HUNDRED THOUSAND
AMERICAN KING SERVICES, INC., FOR DEMOLITION OF THE
PROPERTY LOCATED AT 17300 NW 7TH AVE, MIAMI
GARDENS; A COPY OF WHICH IS ATTACHED HERETO AS
EXHIBIT OF“A”; PROVIDING FOR THE ADOPTION
REPRESENTATIONS; PROVIDING FOR AN EFFECTIVE DATE.
WHEREAS, BSD of Miami Gardens, LLC previously owned the property located
at 17300 NW 7th Avenue Road in Miami Gardens. The property also formerly known as
'Parkway West Regional Medical Center', is an abandoned 11-story structure that has
been vacant for nearly two decades, and
WHEREAS, the City entered into an agreement with BSD of Miami Gardens, LLC
whereby within 30 days of the effective date of the agreement, the owner would remit
$350,000 to the City and $650,000 in the form of cash collateral to be held in an escrow
account, and
WHEREAS, per the agreement, if the owner failed to cure the property within 33-
months of the effective date, the cash collateral would be liquidated from escrow, and,
WHEREAS, if the owner successfully completed the project within the allotted timeframe,
the City would instead receive $150,000 from escrow upon issuance of a temporary or
final Certificate of Occupancy/Use, and
WHEREAS, in February 2022 BSD of Miami Gardens, LLC subsequently sold the
property to The Haimov Group, LLC who proposed to rehabilitate the site in a manner to
include potential uses such as a hotel, condos or a multifamily development which will
provide jobs, improve community aesthetics, and contribute to an increase in the tax
base, and
WHEREAS, in an effort to encourage redevelopment, the City seeks to collaborate
with The Haimov Group, LLC regarding demolition by entering into an Agreement
permitting the escrow agent to disburse $150,000 to the City and the remaining $500,000
held in escrow to America King Services, Inc., the demolition contractor, once certain
conditions are fulfilled, a copy of the Agreement is hereto attached as Exhibit “A”, and
WHEREAS, staff recommends that the City Council authorize the City Manager to
enter into an Agreement with The Haimov Group, LLC permitting the escrow agent to

disburse $150,000 to the City and the remaining $500,000 held escrow to American King
Services, Inc., upon completion of certain conditions,
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF MIAMI GARDENS, FLORIDA AS FOLLOWS:
Section 1: ADOPTION OF REPRESENTATIONS: The foregoing Whereas
paragraphs are hereby ratified and confirmed as being true, and the same are hereby
made a specific part of this Resolution.
Section 2: AUTHORIZATION: The City Council of the City of Miami Gardens
hereby authorizes the City Manager and City Clerk to execute and attest that certain
Agreement with The Haimov Group, LLC permitting the escrow agent to disburse
$150,000 to the City and the remaining $500,000 held in escrow to American King
Services, Inc. for demolition of the property located at 17300 NW 7th AVE, Miami
Gardens, FL .
Section 3: EFFECTIVE DATE: This Resolution shall take effect immediately upon
its final passage.

GARDENS AT ITS REGULAR MEETING HELD ON SEPTEMBER 28, 2022.
