CALL TO ORDER/ROLL CALL The City Council for the City of Miami Gardens, Florida, met in regular session, Dec 14 2022, beginning at 05:30:00 PM, in the Council Chambers, 18605 NW 27th Avenue, Miami Gardens, Florida. The following members of the City Council were present: Mayor Rodney Harris, Councilman Reggie Leon, Councilwoman Shannon Campbell, Councilwoman Shannan Ighodaro, Councilwoman Linda Julien, Councilman Robert Stephens, and Vice Mayor Katrina Wilson. Also in attendance were: City Manager Cameron Benson, City Attorney Sonja Dickens, and City Clerk Mario Bataille. 2. INVOCATION Mayor Gilbert delivered the Invocation. 3. PLEDGE OF ALLEGIANCE 4. APPROVAL OF MINUTES 4.1. Special City Council Meeting Draft Minutes - November 16, 2022 A motion made by Councilman Leon, seconded by Councilman Stephens, to approve the draft minutes passed and carried by a unanimous voice vote. 5. ORDER OF BUSINESS Councilwoman Campbell requested 11.6 be pulled from the Consent Agenda. Councilman Stephens requested item 11.1 be pulled from the Consent Agenda. A motion made by Councilman Leon, seconded by Councilwoman Campbell, to approve the Agenda as amended passed and carried by a unanimous voice vote. 6. SPECIAL PRESENTATIONS (5 MINUTES EACH) 6.1. SPECIAL PRESENTATION HONORING MGPD OFFICERS AND CMG PUBLIC WORKS STAFF. Mayor Harris was joined by the City Council and Manager in recognizing City of Miami Gardens Police Officers and Public Work employees who assisted in the Hurricane Ian west coast relief efforts. 7. Francis Ragoo, 889 NW 214th Street, Miami Gardens, FL, appeared before the City Council on behalf of the Miami Gardens Neighborhood Watch Inc. to present a plaque of appreciation to Code Enforcement Supervisor Cedric Deveaux. Gale Cunningham, 19001 NW 14th Avenue Road, Miami Gardens, FL, appeared before the City Council and shared her appreciation on the City's effort to increase communication and transparency with the residents. Tina Alexander, 2453 NW 179th Terrace, Miami Gardens, FL, appeared before the City Council and shared concerns regarding the possibility of a lien being placed on her home. Sharon Frazier-Stephens, 145 NE 1st Place, Miami, FL appeared before the City Council and shared her appreciation of Councilwoman Ighodaro spear heading a past African Roots project experienced by the youth and encourage the City Council fund this historical trip in the future. Djenaba Gregory-Faal, 2119 Plunkett Court, Hollywood, FL, appeared before the City Council and invited the City Council to participate Delou Africa, Inc projects to be hosted in the City of Miami Gardens. She continued to request if their banner can be placed outside of BTF Recreational Complex on the day of their events. Pat Wright, 1221 NW 179th Street, Miami Gardens, FL, appeared before the City Council appeared before the City Council and shared concern regarding the traffic incident along NW 12th Avenue within the Scott Lake Community. 8. ORDINANCE(S) FOR FIRST READING: 8.1. AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF MIAMI GARDENS, FLORIDA, AMENDING ARTICLE VI SECTION 6-215 OF THE CODE OF ORDINANCES TO INCLUDE A RETENTION SYSTEM TO BE UTILIZED BY BUSINESSES PROVIDING SHOPPING CARTS FOR USE BY THEIR PATRONS AND AMENDING ARTICLE VI SECTION 6-219; PROVIDING FOR ADOPTION OF REPRESENTATIONS; REPEALING ALL ORDINANCES IN CONFLICT; PROVIDING A SEVERABILITY CLAUSE; PROVIDING FOR INCLUSION IN CODE; PROVIDING AN EFFECTIVE DATE. Assistant City Attorney Jonell Murphy provided an overview on the item. A motion was made by Councilman Leon, seconded by Councilman Stephens, to approve the Ordinance on First Reading. Councilman Stephens further explained the intent of the Ordinance and spoke on how aggressive he would like the City to enforce this proposed Ordinance. There being no further discussion, Mayor Harris called the question. AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF MIAMI GARDENS, FLORIDA, AUTHORIZING THE CITY MANAGER TO EXECUTE THAT VACANT LAND SALE AGREEMENT AND ALL ATTENDANT DOCUMENTS WITH LEGACY DEVELOPMENT ALLIANCE, LLC, ATTACHED HERETO AS EXHIBIT “A” FOR THE SALE OF THAT REAL PROPERTY LOCATED AT 15880 NW 27TH AVENUE FOR FIVE HUNDRED AND TWENTY THOUSAND DOLLARS ($520,000.00); PROVIDING FOR INSTRUCTIONS TO THE CITY MANAGER; PROVIDING FOR ADOPTION OF REPRESENTATIONS; REPEALING ALL ORDINANCES IN CONFLICT; PROVIDING A SEVERABILITY CLAUSE; PROVIDING AN EFFECTIVE DATE. City Manager Benson provided an overview on the item. A motion was made by Councilman Leon, seconded by Councilwoman Julien, to approve the Ordinance on First Reading. Answering a question posed by Councilman Stephens, Attorney Robert Holland representing Legacy Development made it known they are ready to begin development on the project. Councilman Leon spoke in support of the item. A motion offered by Councilman Leon, seconded by Councilwoman Julien, to approve the Consent Agenda passed and carried by a 6 to 1 roll call vote of the City Council. Councilwoman Ighodaro cast the dissenting vote. 12. RESOLUTION(S) 12.1. A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF MIAMI GARDENS ENCOURAGING THE FLORIDA DEPARTMENT OF TRANSPORTATION (FDOT), MIAMI-DADE EXPRESSWAY AUTHORITY (MDX) AND ANY AND ALL ENTITIES RESPONSIBLE FOR THE CLEANING AND PLANTING OF THE LANDSCAPING AREAS ON SR-826 (PALMETTO EXPRESSWAY) AND ALL ON RAMP AREAS, TO CLEAN AND MAINTAIN THE AREAS ALONG SR-826; PROVIDING FOR INSTRUCTIONS TO THE CLERK; PROVIDING FOR THE ADOPTION OF REPRESENTATIONS; AND PROVIDING AN EFFECTIVE DATE. Councilman Stephens spoke in support of the item, however he questioned if there is a more aggressive approach the City can undertake. City Manager Benson suggested bringing this concern to Miami-Dade County Transportation Planning Organization (TPO). Vice Mayor Wilson spoke on the City requesting for funding from TPO in order to address the concern. Councilman Stephens spoke in support of contracting the work should we receive funding from the organizations. Councilman Leon suggested a friendly reminder to include South Florida Water Management to address the canals. Councilman Stephens requested if he can be a co-sponsor of this item. A motion offered by Councilman Stephens, seconded by Councilwoman Julien, to approve the Resolution passed and carried by a 7 to 0 voice vote of the City Council. 12.2. A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF MIAMI GARDENS, FLORIDA, ALLOCATING FUNDS FROM COUNCILWOMAN LINDA JULIEN'S SPECIAL EVENTS ACCOUNT IN AN AMOUNT NOT TO EXCEED FIVE THOUSAND, FIVE HUNDRED SEVENTY-NINE DOLLARS AND 40 CENTS ($5,579.40), FOR THE MIAMI FOUNDATION’S ANNUAL GIVE MIAMI DAY; PROVIDING FOR ADOPTION OF REPRESENTATIONS; PROVIDING FOR AN EFFECTIVE DATE. Answering questions posed by Councilwoman Campbell, Councilwoman Julien provided an overview on the item. A motion offered by Councilman Leon, seconded by Councilman Stephens, to approve the Resolution passed and carried by a 7 to 0 voice vote of the City Council. 13. QUASI-JUDICIAL ZONING HEARINGS/JENNINGS DISCLOSURE: Planning and Zoning Director Nakeisha Smith provided the rules of procedure for the Quasi-Judicial Items. City Clerk Bataille administered the Oath of Truthfulness. 13.1 ORDINANCES ON FOR FIRST READING/PUBLIC HEARING(S): 13.1.1. City Manager Benson provided a brief overview on the Item and introduced Planning and Zoning Director Nakeisha Smith who provided a detailed presentation on the item. Answering a question posed by Councilman Stephens, Attorney Dickens clarified the limited ability to regulate home based businesses. Vice Mayor Wilson spoke on the City's ability to communicate the changes of this ordinance to the community. Attorney Dickens indicated her office will place summary on this Ordinance in the Community Newsletter. There being no further discussion, Mayor Harris called the question.
