Crew Department: Police Department Short Title: A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF MIAMI GARDENS, FLORIDA, AUTHORIZING THE CITY MANAGER AND CITY CLERK TO EXECUTE AND ATTEST, RESPECTIVELY, THAT CERTAIN MEMORANDUM OF UNDERSTANDING BETWEEN THE CITY OF MIAMI GARDENS AND THE MIAMI JOB CORPS CENTER ATTACHED HERETO AS EXHIBIT “A;” PROVIDING FOR INSTRUCTIONS TO THE CLERK; PROVIDING FOR THE ADOPTION OF REPRESENTATIONS; PROVIDING AN EFFECTIVE DATE Staff Summary: The Department of Labor, a governing body of the Miami Job Corp, requires that a written agreement with the the local law enforcement agency be entered into for purposes of compliance. To be compliant, the Miami Job Corps Center (Job Corp), located in the City of Miami Gardens must have a Memorandum of Understanding (MOU) that establishes various rules and regulations. The MOU will require Job Corp to report criminal offenses committed on the campus, dismiss students that have committed felony crimes, and possibly terminate for any student that is arrested for a drug related offense that is a misdemeanor. The MOU also reinforces Miami Gardens Police Department’s obligation to provide law enforcement services and continue routine patrols. ITEM J-2) CONSENT AGENDA RESOLUTION Memorandum of Understanding w/Miami Job Corps Center 1515 NW 167 Street, Building 5 Suite 200 Miami Gardens, Florida 33169 Recommendation: That the City Council accept the Memorandum of Understanding between Miami Job Corp and Miami Gardens Police Department in effort to assist Miami Job Corp in the Department of Labor’s compliance requirements. Attachment: Attachment A: Memorandum of Understanding between Miami Gardens Police Department and Miami Job Corps Center MEMORANDUM OF UNDERSTANDING BETWEEN MIAMI GARDENS POLICE DEPARTMENT AND MIAMI JOB CORPS CENTER The Miami Job Corps Center, located in the County of Miami-Dade, operates on the property located at 3050 Northwest 183rd Street in Miami Gardens, Florida, which is owned by the United States Department of Labor. The Department of Labor requires the Miami Job Corps Center to have written agreement with the local law enforcement agency having concurrent jurisdiction over the property as per Policy and Requirement Handbook PRH Chapter 5, Management Page 5.4-1, R2. The Miami Job Corps Center is also required to report criminal offenses committed at the Center. Crimes of violence must be reported, including any serious assault of a student upon another. Job Corps regulations require that any student arrested for a felony must be terminated from the program within 48 hours. In addition, any student arrested for a drug related misdemeanor will also face possible termination from the program within 48 hours. As the Miami Miami Gardens Police Department is the municipal law enforcement agency having concurrent jurisdiction with Miami-Dade County Police Department, the signing of this agreement serves notice that the Department of Labor officially requests that the Miami Gardens Police Department provide law enforcement services and routine patrol, and that the Miami Gardens Police Department agrees to provide such services. The Center Director or his Designee is the only authorized staff that shall call the Miami Gardens Police Department on the behalf of the Center. This agreement will remain in effect for a period of five (5) years after the date the last signature, or may be terminated automatically. The agreement may also be terminated by either party by providing written notice of such termination.
