HomeMy WebLinkAbout2024-074-2148_-_Authorizing_Ground_Lease_Agreement_for_5_Acre_Property_-_Adopted.docxRESOLUTION NO. 2024-074-2148 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF MIAMI GARDENS, FLORIDA, AUTHORIZING THE CITY MANAGER TO NEGOTIATE A GROUND LEASE OF THE PROPERTY GENERALLY LOCATED AT 2775 NW 183RD STREET, MIAMI GARDENS, FL 33056 IN ACCORDANCE WITH THE TERM SHEET ATTACHED HERETO IN SUBSTANTIAL FORM AS EXHIBIT “A”; PROVIDING FOR THE ADOPTION OF REPRESENTATIONS; PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, City Council authorized the City Manager to proceed with negotiations for the development of city-owned land located at 2775 NW 183rd Street, Miami Gardens, FL 33056 conversationally known as the “5 acre”, and WHEREAS, the site is currently vacant but has a future land use designation of Commerce and a zoning classification of PCD (Planned Corridor Development) with an Entertainment Overlay (EO), and WHEREAS, the Administration seeks to enter into a long-term lease agreement to develop the vacant land into an approximate 500 unit mixed-use development comprised of studios, 1-bedroom, 2-bedroom and 3 bedroom units along with associated parking and approximately 12,000 sq. feet of curated retail and restaurant space servicing the community; additionally, a linear park which will be managed and maintained by the lessee’s property manager will be created on the exterior of the project to be accessible and usable by the community, and WHEREAS, the proposed lease term is fifty (50) years, plus a one-time option to renew the ground lease for an additional fifty (50) years; the total lease rate is $10,000,000, as outlined on the Term Sheet attached hereto as Exhibit “A” and WHEREAS, it is recommended that the City Council approve the Term Sheet for Ground Lease of 2775 NW 183rd Street, attached hereto as Exhibit “A” with a lease agreement to be presented before Council thereafter, NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF MIAMI GARDENS, FLORIDA AS FOLLOWS: Section 1: ADOPTION OF REPRESENTATIONS: The foregoing Whereas paragraphs are hereby ratified and confirmed as being true, and the same are hereby made a specific part of this Resolution. Section 2: AUTHORIZATION: The City Council of the City of Miami Gardens hereby authorizes the city manager to negotiate a ground lease of the property generally located at 2775 NW 183rd street, Miami Gardens, FL 33056 in accordance with the term sheet attached hereto in substantial form as Exhibit “A”.
