HomeMy WebLinkAbout2024-075-2149_-_Urging_Miami_Dade_County_Mayor_to_Create_Public_Notice_Accessible_Website_-_Adopted.RESOLUTION NO. 2024-075-2149 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF MIAMI GARDENS, FLORIDA, URGING THE MAYOR OF MIAMI- DADE COUNTY TO TAKE ALL NECESSARY STEPS TO PROVIDE FOR PUBLICATION OF LEGAL ADVERTISEMENTS AND PUBLIC NOTICES ON A PUBLICLY ACCESSIBLE WEBSITE OF THE COUNTY FOR USE BY MUNICIPALITIES, IN ACCORDANCE WITH SECTION 50.0311 OF THE FLORIDA STATUTES; PROVIDING FOR INSTRUCTIONS TO THE CITY CLERK; PROVIDING FOR THE ADOPTION OF REPRESENTATIONS; PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, the Florida Constitution requires all meetings of a county, municipality, school board, or special district at which official acts are to be taken or at which public business is to be discussed or transacted be open to the public and notice be given of such meetings, and WHEREAS, prior to January 1, 2023, legal notices of the City of Miami Gardens had to be published in a newspaper that met specified requirements, and WHEREAS, during the 2022 Legislation Session, the State approved House Bill 7049 which amended Florida Statutes 50.0311 by giving governmental agencies the option to publish legal notice on a publicly accessible website of a county instead of in a print newspaper under specified conditions, and WHEREAS, on April 2, 2024, the Miami-Dade County Board of County Commissioners adopted County Ordinance No. 24-32 which established advertisement and notice by publication on publicly accessible website of the County, and WHEREAS, In addition, the Board of County Commission directed the Mayor to provide a publicly accessible website for public notices and to develop a form interlocal agreement for use by the County and another local government in Miami-Dade County when such local government wishes to utilize the County’s website to publish legal advertisements and notices, and WHEREAS, the City Clerk strongly recommends that the City Council urges the Mayor of Miami-Dade County to undertake all essential measures to develop the publication of legal advertisements and public notices on a publicly accessible County website for use by municipalities in compliance with state regulations, NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF MIAMI GARDENS, FLORIDA AS FOLLOWS: DocuSign Envelope ID: 7DCED152-0329-4000-BA9D-79C34146E95A Page 2 of 2 Resolution No. 2024-075-2149 Section 1: ADOPTION OF REPRESENTATIONS: The foregoing Whereas paragraphs are hereby ratified and confirmed as being true, and the same are hereby made a specific part of this Resolution. Section 2: EXPRESSION OF SUPPORT: The City Council of the City of Miami Gardens urges the Mayor of Miami-Dade County to undertake all essential measures to develop the publication of legal advertisements and public notices on a publicly accessible County website for use by municipalities in compliance with state regulations. Section 3: INSTRUCTIONS TO THE CITY CLERK: The City Clerk is hereby directed to transmit an executed copy of this Resolution to the Office of Mayor Daniella Levine Cava, Miami-Dade County Association of City Clerks, and Miami-Dade County League of Cities. Section 3: EFFECTIVE DATE: This Resolution shall take effect immediately upon its final passage.
