CALL TO ORDER/ROLL CALL The City Council for the City of Miami Gardens, Florida, met in regular session, May 08 2024, beginning at 05:30:00 PM, in the Council Chambers, 18605 NW 27th Avenue, Miami Gardens, Florida. The following members of the City Council were present: Mayor Rodney Harris, Vice Mayor Katrina Wilson, Councilwoman Shannon Campbell, Councilwoman Shannan Ighodaro, Councilwoman Linda Julien, Councilman Reggie Leon, and Councilman Robert Stephens. Also in attendance were: City Manager Cameron Benson, City Attorney Sonja Dickens, and City Clerk Mario Bataille. 2. INVOCATION Councilman Robert Stephens delivered the Invocation. 3. PLEDGE OF ALLEGIANCE 4. APPROVAL OF MINUTES 4.1. Regular City Council Meeting Draft Minutes – April 24, 2024 City Clerk Bataille withdrew the minutes. 5. ORDER OF BUSINESS The following items were added to the Consent Agenda:  ADD-ON ITEM #1 - A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF MIAMI GARDENS, FLORIDA, ALLOCATING FUNDS FROM COUNCILMAN STEPHENS’ COMMUNITY BENEFIT ACCOUNT IN AN AMOUNT NOT TO EXCEED THREE THOUSAND DOLLARS ($3,000) IN SUPPORT OF PAIGE AND FRIENDS HELPING HANDS, INC.; PROVIDING FOR THE ADOPTION OF REPRESENTATIONS; PROVIDING FOR AN EFFECTIVE DATE. (SPONSORED BY COUNCILMAN ROBERT STEPHENS, III)  ADD-ON ITEM #2 - A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF MIAMI GARDENS, FLORIDA, WAIVING RENTAL FEES AND SERVICE CHARGES FOR THE USE OF THE SENIOR FAMILY CENTER AND PAYING ASSOCIATED STAFFING COSTS FROM THE SEAT 6 PUBLIC AFFAIRS SPECIAL EVENTS ACCOUNT IN SUPPORT OF NORTH DADE MIDDLE SCHOOL’S 8TH GRADE PROM; PROVIDING FOR THE ADOPTION OF REPRESENTATIONS; PROVIDING FOR AN EFFECTIVE DATE. A motion made by Councilman Leon, seconded by Councilwoman Julien, to approve the agenda as amended passed and carried by a unanimous voice vote. 6. SPECIAL PRESENTATIONS (5 MINUTES EACH) 6.1. LEGISLATIVE UPDATE BY CITY LOBBYIST YOLANDA C. JACKSON, ESQ. LaToya Sheals, Senior Government Relations Consultant of Becker & Poliakoff, appeared before the City Council and provided a state legislative update on the items effecting the City of Miami Gardens. 6.2. MENTAL HEALTH AWARENESS MONTH HONOREE RUBAN ROBERTS. As part of Mental Health Awareness Month, Councilwoman Julien was joined by the Mayor and City Council in honoring Mr. Ruban Roberts for his dedication to address mental health challenges in the community. 7. PUBLIC COMMENTS Gale Cunningham, 19001 NW 14th Avenue Road, Miami Gardens, FL, appeared before the City Council and spoke on temporary noncommercial campaign signs while also encouraging the residents to be informed voters and exercise their right to vote. Rea Hughes, 335 NW 180th Street, Miami Gardens, FL, appeared before the City Council and encouraged the residents to not lose their focus on the candidates who are running for election and continue to stay focus on the current local officials. She encouraged the residents to take necessary steps to be informed voters. Mamon Tisdol, 17031 NW 11th Avenue, Miami Gardens, FL, appeared before the City Council and shared concerns regarding police enforcement to a loud disturbance that had been taking place near his home. Lennon Hernandez, 18400 NW 22nd Avenue, Miami Gardens, FL, appeared before the City Council and shared concerns with regards to the living conditions of his neighborhood. Nancy Smith, 4450 NW 169th Terrace, Miami Gardens, FL, appeared before the City Council and requested clarification on an unsafe structure notice placed on her property. A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF MIAMI GARDENS, FLORIDA, AMENDING THE PROTOCOL MANUAL, ATTACHED HERETO AS EXHIBIT “A”; PROVIDING FOR THE ADOPTION OF REPRESENTATIONS; PROVIDING FOR AN EFFECTIVE DATE. This was pulled from the Consent Agenda. 11.2. A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF MIAMI GARDENS, FLORIDA, AWARDING REQUEST FOR QUALIFICATIONS (RFQ) NO. 23-24-014 - PREPARATION OF RESILIENCE PLAN FOR THE CITY OF MIAMI GARDENS, TO CHEN MOORE AND ASSOCIATES; AUTHORIZING THE CITY MANAGER TO NEGOTIATE AND EXECUTE A CONTRACT FOR THIS PURPOSE; AUTHORIZING THE CITY MANAGER TO PROCEED WITH NEGOTIATIONS AND CONTRACT WITH KIMLEY-HORN AND ASSOCIATES, INC., IF NEGOTIATIONS WITH CHEN MOORE AND ASSOCIATES ARE NOT SUCCESSFUL; PROVIDING FOR THE ADOPTION OF REPRESENTATIONS; PROVIDING FOR AN EFFECTIVE DATE. 11.3. A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF MIAMI GARDENS, FLORIDA, AUTHORIZING THE CITY MANAGER AND THE CITY CLERK TO EXECUTE AND ATTEST, RESPECTIVELY, THAT CERTAIN INTERLOCAL AGREEMENT BETWEEN MIAMI-DADE COUNTY AND THE CITY OF MIAMI GARDENS RELATING TO A GRANT FROM THE BUILDING BETTER COMMUNITIES' GENERAL OBLIGATION BOND PROGRAM PROJECT NO. 320 ECONOMIC DEVELOPMENT FUND IN AN AMOUNT UP TO $7,500,000.00, A COPY OF WHICH IS ATTACHED HERETO AS EXHIBIT “A”; PROVIDING FOR INSTRUCTIONS TO THE CITY CLERK; PROVIDING FOR THE ADOPTION OF REPRESENTATIONS; PROVIDING FOR AN EFFECTIVE DATE. A motion offered by Councilman Leon, seconded by Councilwoman Julien, to approve the Consent Agenda passed and carried by a 7 to 0 voice vote of the City Council. 12. A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF MIAMI GARDENS, FLORIDA, AMENDING THE PROTOCOL MANUAL, ATTACHED HERETO AS EXHIBIT “A”; PROVIDING FOR THE ADOPTION OF REPRESENTATIONS; PROVIDING FOR AN EFFECTIVE DATE. Councilwoman Campbell recommended a review of the protocol manual in order to adjust and update the manual. City Clerk Bataille confirmed at the request of Councilwoman Campbell to forward copies of the manual to the Council and work with the Council individually on drafting any proposed amendments to be brought back for consideration. A motion offered by Councilman Leon, seconded by Councilman Stephens, to approve the Resolution passed and carried by a 7 to 0 voice vote of the City Council. 12.2. A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF MIAMI GARDENS, FLORIDA, AUTHORIZING THE CITY MANAGER TO NEGOTIATE A GROUND LEASE OF THE PROPERTY GENERALLY LOCATED AT 2775 NW 183RD STREET, MIAMI GARDENS, FL 33056 IN ACCORDANCE WITH THE TERM SHEET ATTACHED HERETO IN SUBSTANTIAL FORM AS EXHIBIT “A”; PROVIDING FOR THE ADOPTION OF REPRESENTATIONS; PROVIDING FOR AN EFFECTIVE DATE. City Manager Benson provided an overview of the item and introduced Deputy City Manager Craig Clay who presented the item. Attorney Robert Holland representing Redwood Development appeared before the City Council to present the planned development of the property as part of the ground lease agreement. A motion was made by Councilman Leon, seconded by Councilwoman Julien, to approve the Resolution. Vice Mayor Wilson shared her unreadiness on the item. Answering questions posed by Vice Mayor Wilson, City Manager Benson stated the intent of the item is for the Council to provide approval for the manager to negotiate the ground lease agreement; to which said agreement will be brought to the Council for consideration once the negotiation is complete. Furthermore, Manager Benson confirmed there is no lease agreement in place. DocuSign Envelope ID: 7DCED152-0329-4000-BA9D-79C34146E95A Page 5 of 8 May 22, 2024 Regular City Council Meeting Answering a question posed by Vice Mayor Wilson, Mr. Holland explained the proposed financial terms and phases of the project based on the current term before the Council this evening. Vice Mayor Wilson shared some concerns on the current financial term. In addition, she spoke in opposition of selling land owned by the City and the living affordability of the development for current Miami Gardens residents and employees. Vice Mayor Wilson continued to request as part of the Manager's negotiation that this development aligns with the City's Strategic Plan. Vice Mayor Wilson continued to speak in opposition of the item. City Manager Benson indicated the Development Agreement will be brought back to the City Council for consideration in two public hearings as it will be brought back as an Ordinance. Deputy City Manager Craig Clay provided an overview and financial benefit of the Ground Lease Agreement currently presented to the City Council. Answering a question posed by Councilman Leon, Attorney Holland indicated the intent of this development is to provide housing stock to current residents of the City. Councilman Stephens spoke in support of the development project, however he shared his concern on the timeliness of project. Councilwoman Julien spoke in support of the development project, however she shared concern on the limited amount of workforce housing and would like to see the percentage increased. Councilwoman Julien recommended defer this item until the next meeting in order to allow Members of the Council an opportunity to address any questions or concerns they may have with staff. Councilman Stephens suggested should this item be deferred, he would like the Council to have a Workshop on this development overall. A motion was made by Councilwoman Julien, seconded by Councilman Stephens, to defer the item to the May 22, 2024 City Council Meeting. Councilman Stephens requested a workshop on this item be held prior to the next City Council Meeting. A motion offered by Councilwoman Julien, seconded by Councilman Stephens to defer this Item to the May 22, 2024, City Council Meeting passed and carried by a 7-0 voice vote. 13. Vice Mayor Wilson requested for an item to be brought before the City Council to address the order of business. Vice Mayor Wilson shared concerns with regards to campaign speeches during Council meeting by the public. Answering a question posed by Mayor Harris, City Clerk Bataille indicated he will work with Vice Mayor Wilson on the concerns raised and include the City Attorney.
