A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
MIAMI GARDENS, FLORIDA, APPROVING THE SPECIAL
EXCEPTION APPLICATION SUBMITTED BY HM DEVELOPERS
FOR THAT CERTAIN PROPERTY LOCATED AT 3700 NW
167TH STREET, MORE PARTICULARLY DESCRIBED ON
EXHIBIT “A” ATTACHED HERETO, PERMITTING A SELF
STORAGE BUSINESS; WAIVING THE MINIMUM
REQIUREMENT TO PROVIDE A MIXED-USE DEVELOPMENT
CONSISTING OF 40% RESIDENTIAL USE, 15% COMMERCIAL
OR OFFICE USE, AND 10% RETAIL, SERVICE, OR
ENTERTAINMENT USE IN ORDER TO QUALIFY FOR
DEVELOPMENT INCENTIVES OF INCREASED FLOOR AREA
RATIO (FAR) AND INCREASED BUILDING HEIGHT AS
REQUIRED BY SECTION 34-532(G) OF THE CITY OF MIAMI
GARDENS CODE OF ORDINANCES; PROVIDING FOR THE
ADOPTION OF REPRESENTATIONS; PROVIDING FOR AN
EFFECTIVE DATE.
WHEREAS, the property located at 3700 NW 167th Street (“Subject Property”)
currently has a zoning designation for Planned Corridor Development (“PCD”) and a land
use designation as “Neighborhood” as per the City of Miami Gardens Comprehensive
Development Master Plan, and
WHEREAS, HM Developers, (“Applicant”) has filed an application for Special
Exception approval to construct and operate a Self Storage business on the Subject
Property with a 4-story 134,495 sq. ft. building equal to a Floor Area Ratio (FAR) of 2.49,
and
WHEREAS, Section 34-532(g) of the City of Miami Gardens Code of Ordinance
provides that developments over 2 stories and over 0.5 FAR within the Palmetto
Expressway PCD sub-district must be developed as mixed-use with a minimum of 40%
residential use, 15% commercial/office use, and 10% retail/service/entertainment use,
and
WHEREAS, the proposed building does not meet the minimum of 40% residential
use or 10% retail/service/entertainment use and the Applicant is requesting a waiver of
this requirement, and
WHEREAS, the City Council considered the testimony of the Applicant, if any, and
the Staff Report attached hereto as Exhibit “B” and incorporated by reference, and
WHEREAS, City Staff recommends the City Council approve the Special
Exception, Waiver, and that Conceptual Plan attached hereto as Exhibit “C” to construct
and operate a Self Storage business on the Subject Property with a 4-story 134,495 sq.
ft. building equal to a Floor Area Ratio (FAR) of 2.49,

NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF MIAMI GARDENS, FLORIDA AS FOLLOWS:
Section 1: ADOPTION OF REPRESENTATIONS: The foregoing Whereas
paragraphs are hereby ratified and confirmed as being true, and the same are hereby
made a specific part of this Resolution.
Section 2: AUTHORIZATION: The City Council of the City of Miami Gardens
hereby approves the Special Exception application for that certain property located at
3700 NW 167th Street, more particularly described on Exhibit “A” attached hereto,
permitting a Self Storage business. The City Council also hereby waives the minimum of
40% residential use, 15% commercial or office use, and 10% retail, service, or
entertainment use as set forth in Section 34-532(g) of the City of Miami Gardens Code
of Ordinances.
Section 3: EFFECTIVE DATE: This Resolution shall take effect immediately upon
its final passage.
