HomeMy WebLinkAbout2024-228-2302_-_Zoning_Application_by_Chabad_of_Mid_Miami_Beach_Inc_-_Adopted.docxRESOLUTION NO. 2024-228-2302 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF MIAMI GARDENS, FLORIDA, APPROVING THE APPLICATION SUBMITTED BY CHABAD OF MID MIAMI BEACH, INC., FOR THE PROPERTY LOCATED AT 275 NW 199TH STREET, MORE PARTICULARLY DESCRIBED IN EXHIBIT “A” ATTACHED HERETO, FOR A NON-USE VARIANCE OF SECTION 34- 288(20)(g) OF THE LAND DEVELOPMENT REGULATIONS TO ALLOW 20,000 SQUARE FEET OF RECREATION/PLAY AREA WHERE 76,200 SQUARE FEET IS REQUIRED; PROVIDING FOR THE ADOPTION OF REPRESENTATIONS; PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, the subject property consists of 2 commercial buildings located at 275 NW 199th Street within the Planned Corridor Development (PCD) zoning district as shown in Exhibit “A” attached hereto, and WHEREAS, Chabad of Mid Miami Beach, Inc. (“Applicant”), is proposing to renovate the existing buildings converting the facility into a boarding school campus with dorms, classrooms, student dining facilities, library/study areas and multipurpose rooms, and WHEREAS, Section 34-288(20)(g)(1) Physical Standards, of the City of Miami Gardens Code of Ordinances requires educational facilities to provide recreation/play areas based on the number of students attending the facility, and WHEREAS, based on 204 anticipated students to be enrolled at Applicant’s school, the required recreation/play area would be 76,200 square feet, however, Applicant is proposing 20,000 square feet of recreational space which will include both indoor and outdoor recreation areas as shown in Exhibit “B” attached hereto, and WHEREAS, a non-use variance is required to reduce the required amount of recreation/play area square footage by this amount and, if the variance is approved, the applicant will still be required to meet all other standards and obtain all permits/licenses required to operate the school prior to the issuance of a Business License and Certificate of Use, and WHEREAS, the City’s Planning and Zoning Staff recommends approval of the application for a non-use variance to allow a 74% reduction in the amount of recreation/play area required, and WHEREAS, the City Council considered the testimony of the Applicant, if any, and Docusign Envelope ID: B960D9B5-D6A1-4BC6-8217-365818368333 Page 2 of 3 Resolution No. 2024-228-2302 WHEREAS, the City Council also considered the testimony of the City’s Planning and Zoning Staff, and the Staff Report attached hereto as Exhibit “C” is hereby incorporated by reference, NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF MIAMI GARDENS, FLORIDA AS FOLLOWS: Section 1: ADOPTION OF REPRESENTATIONS: The foregoing Whereas paragraphs are hereby ratified and confirmed as being true, and the same are hereby made a specific part of this Resolution. Section 2: AUTHORIZATION: The City Council of the City of Miami Gardens hereby approves the application submitted by Chabad of Mid Miami Beach, Inc., for the property located at 275 NW 199th Street, more particularly described in Exhibit “A” attached hereto, for a non-use variance of section 34-288(20)(g) of the Land Development Regulations to allow 20,000 Square Feet of recreation/play area where 76,000 Square Feet is required. Section 3: EFFECTIVE DATE: This Resolution shall take effect immediately upon its final passage.
