A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
MIAMI GARDENS, FLORIDA, AUTHORIZING THE CITY
MANAGER AND CITY CLERK TO EXECUTE AND ATTEST,
RESPECTIVELY, THAT CERTAIN ROAD JURISDICTION
TRANSFER (RJT) AGREEMENT WITH THE FLORIDA
DEPARTMENT OF TRANSPORTATION (FDOT); PROVIDING
FOR INSTRUCTIONS TO THE CITY CLERK; PROVIDING FOR
THE ADOPTION OF REPRESENTATIONS; PROVIDING FOR AN
EFFECTIVE DATE.
WHEREAS, there are twelve (12) segments of frontage roadways along State
Road 860/Miami Gardens Drive, between NW 2 Court and NW 43 Court, which are
currently under the ownership of the City of Miami Gardens, and
WHEREAS, FDOT agreed to accept the owner transfer of the twelve (12)
segments of frontage roadway from the City Street System to the State Highway System,
and
WHEREAS, under the terms and conditions of the transfer, FDOT will accept all
responsibility for the right-of-way of the frontage roads and for operation and maintenance
of the roads, and
WHEREAS, the Agreement also includes the transfer of all curbs, culverts, and
drainage structures within the right-of-way of the roads at the time of transfer and FDOT
shall be responsible for maintenance of public sidewalks, bike paths, and other ways in
the right-of-way, and
WHEREAS, there will be no fiscal impact to the City as part of this transfer,
however, operational funds that are currently expended by the Public Works Department
for maintenance of the frontage roads shall be redirected to the maintenance of other
roadway segments throughout the City, and
WHEREAS, City Staff recommends that the City Council authorize the City
Manager and City Clerk to execute and attest, respectively, that certain Road Jurisdiction
Transfer (RJT) Agreement with the Florida Department of Transportation (FDOT),
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF MIAMI GARDENS, FLORIDA AS FOLLOWS:
Section 1: ADOPTION OF REPRESENTATIONS: The foregoing Whereas
paragraphs are hereby ratified and confirmed as being true, and the same are hereby
made a specific part of this Resolution.

Section 2: AUTHORIZATION: The City Council of the City of Miami Gardens
hereby authorizes the City Manager and City Clerk to execute and attest, respectively,
that certain Road Jurisdiction Transfer (RJT) Agreement with the Florida Department of
Transportation (FDOT).
Section 3: INSTRUCTIONS TO THE CITY CLERK: The City Clerk is hereby
authorized to obtain two (2) fully executed copies of the subject Agreement with one to
be maintained by the City, and one to be delivered to the Florida Department of
Transportation.
Section 4: EFFECTIVE DATE: This Resolution shall take effect immediately upon
its final passage.

AT ITS REGULAR MEETING HELD ON APRIL 23, 2025.
