HomeMy WebLinkAbout2025-056-2358_-_34_Ways_Waiver_of_Plat_(North)_-_Adopted.docxRESOLUTION NO. 2025-056-2358 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF MIAMI GARDENS, FLORIDA, APPROVING A WAIVER OF PLAT FOR 34 WAYS FOUNDATION INC., FOR THE PROPERTY LOCATED BETWEEN NW 194TH STREET AND NW 195TH STREET, AND BETWEEN NW 45TH COURT AND NW 44TH COURT, ATTACHED HERETO AS EXHIBIT "A"; PROVIDING FOR THE ADOPTION OF REPRESENTATIONS; PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, the subject property Folio Number 34-2105-014-0930 is located between NW 194th Street and NW 195th Street, and between NW 45th Court and NW 44th Court, and WHEREAS, the site is currently zoned R-15, Multiple Family Dwelling Residential, and WHEREAS, the proposed development involves the construction of a townhouse building, designed to accommodate two units with a shared common wall separating the units, and WHEREAS, the proposed design supports the intent of the R-15 zoning district while maintaining the functional integrity of the neighborhood, and WHEREAS, in order to comply with the development standards for R-15 lots as outlined in Section 34-342, Table 1, the existing parcel must be subdivided, and WHEREAS, this subdivision is necessary to ensure that each unit is situated on its own legally conforming lot, consistent with the zoning and dimensional requirements of the R-15 zoning district, and WHEREAS, Article VII - Plats, Subdivisions, Excavations, Address Assignment of the City of Miami Gardens Land Development Regulations (LDRs) requires Waiver of Plat approval be granted by the City prior to recordation by Miami-Dade County, and WHEREAS, the Waiver of Plat has been reviewed by Planning and Zoning staff and by a Professional Surveyor and Mapper on behalf of the City of Miami Gardens for compliance with the City’s Land Development Regulations and with Chapter 28 of the Miami-Dade County Code as shown in Exhibit ‘A’, and WHEREAS, the applicant has provided all the necessary documents and the Waiver of Plat as shown in Exhibit ‘B’ has been determined to be in compliance with the City’s LDRs and with Section 177.081(1) – Platting Dedication and Approval of Florida Statues, and Docusign Envelope ID: FACEDE52-A676-4BED-A121-1A38E8BB0EF8 Page 2 of 3 Resolution No. 202-056-2358 WHEREAS, once resolution is approved by City Council, the Waiver of Plat will then be reviewed and approved by the Miami-Dade County Plat Committee and subsequently recorded in the Official Records of Miami-Dade County, and WHEREAS, Staff recommends adoption of the Resolution approving the Waiver of Plat for the property owned by 34 Ways Foundation Inc., in order to meet development standards for R-15 lots, NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF MIAMI GARDENS, FLORIDA AS FOLLOWS: Section 1: ADOPTION OF REPRESENTATIONS: The foregoing Whereas paragraphs are hereby ratified and confirmed as being true, and the same are hereby made a specific part of this Resolution. Section 2: AUTHORIZATION: The City Council of the City of Miami Gardens hereby approves Waiver of Plat for 34 Ways Foundation Inc., for the property located between NW 194th Street and NW 195th Street, and between NW 45th Court and NW 44th Court, attached hereto as Exhibit "A". Section 3: EFFECTIVE DATE: This Resolution shall take effect immediately upon its final passage.
