A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
MIAMI GARDENS, FLORIDA, APPROVING THE CITY’S RED
LIGHT CAMERA (“RLC”) ANNUAL REPORT FOR SUBMISSION
TO THE FLORIDA DEPARTMENT OF HIGHWAY SAFETY AND
MOTOR VEHICLES, TO COMPLY WITH FLORIDA STATUTE
SECTION 316.0083(4)(a), ATTACHED HERETO AS EXHIBIT “A”
PROVIDING FOR THE ADOPTION OF REPRESENTATIONS;
PROVIDING FOR AN EFFECTIVE DATE.
WHEREAS, per section 316.0083(4)(a) of Florida Statute, jurisdictions must place
for review their annual RLC information on the agenda at a regular or special meeting of
their jurisdiction’s governing body in order to add or renew red light cameras, and,
WHEREAS, the governing body must approve the use of the cameras based on
traffic data and other evidence supporting the use of cameras in areas where needs for
additional traffic safety measures are warranted, and
WHEREAS, the governing body must annually report the results of all traffic
infraction detectors within the municipality’s jurisdiction by placing the annual report to the
Department of Highway Safety and Motor Vehicles (“FLHSMV”), required under section
316.0083(4)(b) as a single reporting item on the agenda of a regular or special meeting
of the municipality’s governing body, and,
WHEREAS, before a municipality contracts or renews a contract to place or install
one or more traffic infraction detectors, the municipality must approve contract or contract
renewal at a regular or special meeting of the county’s or municipality’s governing body,
and
WHEREAS, under section 316.0083(4)(a)2.b., Fla.Stat., when submitting RLC
data to FLHSMV, jurisdictions must confirm that their data was considered at a regular or
special meeting of their governing body, and must provide FLHSMV with the date the
meeting took place, and
WHEREAS, it is recommended that the City Council approve the RLC annual
report,
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF MIAMI GARDENS, FLORIDA AS FOLLOWS:
Section 1: ADOPTION OF REPRESENTATIONS: The foregoing Whereas
paragraphs are hereby ratified and confirmed as being true, and the same are hereby
made a specific part of this Resolution.

Section 2: AUTHORIZATION: The City Council of the City of Miami Gardens
hereby approves the Red-Light Camera Annual Report, attached hereto as Exhibit “A”.
Section 3: EFFECTIVE DATE: This Resolution shall take effect immediately upon
its final passage.
