A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
MIAMI GARDENS, FLORIDA, ACCEPTING ANNUAL TRAFFIC
INFRACTION DETECTOR REPORT; PROVIDING FOR THE
ADOPTION OF REPRESENTATIONS; PROVIDING FOR AN
EFFECTIVE DATE.
WHEREAS, per Section 316.0776(3)(c) of Florida Statues, jurisdictions must place
for review their annual school zone speed detection systems information on the agenda
a regular or special meeting of their jurisdiction's governing body (city council, county
commission, etc.) in order to place or install cameras, and
WHEREAS, the governing body must approve the use of speed detection cameras
based on traffic data and other evidence demonstrating that such measures are
warranted to enhance roadway safety within school zones, and
WHEREAS, the report must include a written summary to be read out load at the
regular or special meeting and the summary must contain, the number of notices of
violation issued, the number that was contested, the number that was upheld, the number
that was dismissed, the number that was issued as uniform traffic citations, and the
number that were paid and how collected funds were distributed and in what amounts,
and
WHEREAS, the signed Resolution, which includes the above Summary and report
as attached, will be formally submitted to the Florida Department of Highway Safety and
Motor Vehicles (FLHSMV) in fulfillment of Florida State Statute 316.1896(16)(a), and
WHEREAS, to ensure continued automated school zone safety efforts throughout
the City of Miami Gardens, it is recommended that the City Council approves this
resolution,
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF MIAMI GARDENS, FLORIDA AS FOLLOWS:
Section 1: ADOPTION OF REPRESENTATIONS: The foregoing Whereas
paragraphs are hereby ratified and confirmed as being true, and the same are hereby
made a specific part of this Resolution.
Section 2: AUTHORIZATION: The City Council of the City of Miami Gardens
hereby accepts the Annual Traffic Infraction Detector Report.
Section 3: EFFECTIVE DATE: This Resolution shall take effect immediately upon
its final passage.
