A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
MIAMI GARDENS, FLORIDA, SUPPORTING HOUSE BILL 247
AND SENATE BILL 248 TO ESTABLISH PUBLIC RECORDS
EXEMPTIONS FOR MUNICIPAL CLERKS AND MUNICIPAL
EMPLOYEES WHO MANAGE PUBLIC RECORDS; PROVIDING
FOR INSTRUCTIONS TO THE CITY CLERK; PROVIDING FOR
THE ADOPTION OF REPRESENTATIONS; PROVIDING FOR AN
EFFECTIVE DATE.
WHEREAS, the City Clerk serves as the records custodian for the City of Miami
Gardens, carrying out essential functions including the management, protection, and
retention of all official municipal documents; and
WHEREAS, municipal clerks and staff who administer public records programs
frequently handle sensitive personal information that may expose them to heightened
risks of harassment, identity theft, or personal endangerment; and
WHEREAS, House Bill 247 and Senate Bill 248, currently filed for consideration
by the Florida Legislature, would establish public records exemptions to ensure that the
personal identifying information of municipal clerks and employees responsible for
managing public records is protected from public disclosure; and
WHEREAS, the City Council recognizes that safeguarding the personal
information of these employees is essential to preserving the integrity and safety of public
records management operations; and
WHEREAS, protecting these employees from unnecessary exposure fosters a
secure working environment and supports the continued professionalism, impartiality,
and effectiveness required of public records custodians; and
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF MIAMI GARDENS, FLORIDA AS FOLLOWS:
Section 1: ADOPTION OF REPRESENTATIONS: The foregoing Whereas
paragraphs are hereby ratified and confirmed as being true, and the same are hereby
made a specific part of this Resolution.
Section 2: EXPRESSION OF SUPPORT: The City Council of the City of Miami
Gardens hereby supports HB 247 and SB 248 to establish public records exemptions for
municipal clerks and municipal employees who manage public records.
Section 3: The City Clerk is hereby directed to transmit certified copies of this
Resolution to the Speaker of the Florida House of Representatives and to the President
of the Florida Senate.

Section 4: EFFECTIVE DATE: This Resolution shall take effect immediately upon
its final passage.
