HomeMy WebLinkAbout2025-028-2330 - Recreation Program Screening - Adopted - PdfRESOLUTION NO. 2025-028-2330 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF MIAMI GARDENS, FLORIDA, AUTHORIZING THE CITY MANAGER TO IMPLEMENT THE ATTACHED SCREENING AND OBTAINING SPONSORS FOR RECREATION PROGRAMS GUIDELINES; PROVIDING FOR ADOPTION OF REPRESENTATIONS; PROVIDING AN EFFECTIVE DATE. WHEREAS, the City of Miami Gardens is committed to preserving the peace, safety, and well-being of its residents, particularly in public spaces such as city-owned parks and senior centers, and WHEREAS, City-owned parks and facilities are intended to provide safe, welcoming, and harassment-free environments for recreation, socialization, and community engagement, and WHEREAS, relating to programs, services, presentations, information or materials by outside organizations, businesses, agencies or individuals in these public spaces may disrupt the intended use of these facilities, cause discomfort to residents, and create potential safety concerns, and WHEREAS, Councilwoman Linda Julien is authorizing the City Manager to implement the attached "Screening and Obtaining Sponsors for Recreation Programs" guidelines. The guidelines ensure that all sponsorship activities align with the City's mission while maintaining the well-being, privacy and security of all participants, and WHEREAS, City-sponsored events, first amendment non-commercial speech, and city-invited presentations are exempt from this policy as authorized by the City Manager, NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF MIAMI GARDENS, FLORIDA AS FOLLOWS: Section 1: ADOPTION OF REPRESENTATIONS: The foregoing Whereas paragraphs are hereby ratified and confirmed as being true, and the same are hereby made a specific part of this Resolution. Section 2: AUTHORIZATION: The City Council of the City of Miami Gardens hereby authorizes the City Manager to prohibit realtors, insurance agents, medical providers, or their representatives from engaging in solicitation within city-owned parks and facilities. Section 3: EFFECTIVE DATE: This Resolution shall take effect immediately upon its final passage. The purpose is to ensure that all sponsorship activities align with the City’s mission while maintaining the Well-being, privacy and security of ALL participants. Sponsor Eligibility and Screening Process •Potential sponsors must submit a formal letter, detailing their organization’s intent for sponsoring the program. •Organizations will be vetted through Sunbiz to verify legitimacy and active status. •Community Center Manager will review letter and conduct an interview with potential sponsors before approval. •Approved sponsors must sign an agreement adhering to the center’s policies and guidelines. Sponsorship Conditions •Sponsors shall not collect, access, or request names, contact details, or any other personal information of program participants. However, they will be allowed to distribute brochures, literature, and business cards. •For a Senior Family Center Agreement - Sponsors must provide financial or in-kind support for both senior program groups equally; partial sponsorship of one group without the other is not permitted. •Sponsorship activities must align with City’s mission and contribute positively to the participants' experiences. Staff and Sponsor Interaction •At least one Community Center staff member must be present during all sponsor interactions, visits, or activities within the facility. •Sponsors shall never be left alone with participants without staff supervision. •Staff must monitor all sponsor activities to ensure compliance with center policies and participant safety. •Any concerns regarding sponsor behavior must be reported immediately to the Community Center Manager. Screening and Obtaining Sponsors for Recreation Programs Date of Issue/Update: March 2025 City Manager Cameron Benson SOP #: Department/Division Director Paulette Murphy Page 3 of 4 Compliance and Enforcement •Sponsors found in violation of these policies will receive a warning or may be asked to leave, depending on the severity of the violation. •The Community Center Manager reserves the right to terminate partnership if a sponsor fails to comply with these guidelines. Acknowledgment and Agreement •All sponsors must sign a compliance agreement confirming their understanding and adherence to these guidelines before beginning any sponsorship activities. Page 4 of 4
