HomeMy WebLinkAbout2026-031-2488_-_Waiving_Competitive_Bidding_Process_for_Town_Center_Infrastructure_Developments_-_AdRESOLUTION NO. 2026-031-2488 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF MIAMI GARDENS, FLORIDA, WAIVING THE COMPETITIVE BIDDING PROCESS, PURSUANT TO SECTION 2-757 OF THE CITY OF MIAMI GARDENS CODE OF ORDINANCES, FOR NV2A GROUP, LLC, TO CONSTRUCT THE LIFT STATION, FLORIDA POWER & LIGHT (“FPL”) INFRASTRUCTURE, AND ROADWAY INFRASTRUCTURE IMPROVEMENTS FOR THE PERFORMING ARTS CENTER AND MIAMI GARDENS TOWN CENTER INFRASTRUCTURE RELATED DEVELOPMENTS; AUTHORIZING THE CITY MANAGER TO NEGOTIATE AND EXECUTE ALL DOCUMENTATION NECESSARY FOR THIS PURPOSE; PROVIDING FOR THE ADOPTION OF REPRESENTATIONS; PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, on November 8, 2023, the Miami Gardens City Council awarded RFQ No. 22-23-036 – Miami Gardens Performing Arts Center CMAR – to NV2A Group, LLC, and WHEREAS, the construction of the Performing Arts Center includes critical infrastructure work, with a targeted completion date of June 1, 2026, for the lift station, utilities, and roadway improvements, and WHEREAS, on October 22, 2025, the City Council approved Resolution No. 2025-131-2432, authorizing the First Addendum to the Miami Gardens Town Center Infrastructure Agreement which enabled the City to assume responsibility for completing the lift station, Florida Power & Light (“FPL”) infrastructure, and roadway improvements, and WHEREAS, Section 2-757—Exceptions/waivers to bid and quotation—provides that competitive bidding process may be waived upon recommendation by the City Manager that it is in the city's best interest to do so to obtain goods and services which cannot be acquired through the normal purchasing process due to insufficient time, the nature of the goods or services, or other factors, and WHEREAS, the City Manager is recommending a waiver of the competitive bidding process because the City must expend Project 320 funds and complete the referenced scope of work by August 19, 2026, as outlined in Miami-Dade County Resolution R-712-24, and WHEREAS, further, NV2A has played a key role in coordinating with design professionals, City staff, public-private partners, and external agencies to develop the infrastructure scope of work for development of the Lift Station, Florida Power & Light (“FPL”) infrastructure, and roadway improvements and they are uniquely positioned to perform this work without undue delay or additional cost impacts that could jeopardize project timelines, and Docusign Envelope ID: 79FB5009-8B07-86CF-821B-766252E7BDE1 Page 2 of 3 Resolution No. 2026-031-2488 WHEREAS, City Staff recommends that the City Council waive the competitive bidding process pursuant to Section 2-757 of the City of Miami Gardens Code of Ordinances and authorize the City Manager to negotiate and execute all documentation necessary for the construction of the lift station, FPL, and roadway infrastructure improvements by NV2A Group, LLC, NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF MIAMI GARDENS, FLORIDA AS FOLLOWS: Section 1: ADOPTION OF REPRESENTATIONS: The foregoing Whereas paragraphs are hereby ratified and confirmed as being true, and the same are hereby made a specific part of this Resolution. Section 2: AUTHORIZATION: The City Council of the City of Miami Gardens hereby waives the competitive bidding process, pursuant to Section 2-757 of the City of Miami Gardens Code of Ordinances, for NV2A Group, LLC, to construct the Lift Station, Florida Power & Light (“FPL”) infrastructure, and roadway infrastructure improvements for the Performing Arts Center and Miami Gardens Town Center Infrastructure related developments. Further, the City Council of the City of Miami Gardens hereby authorizes the City Manager to negotiate and execute all documentation necessary for this purpose. Section 3. EFFECTIVE DATE: This Resolution shall take effect immediately upon its final passage.
