Staff Summary: The Guarantee Company of North America, a surety company, filed a lawsuit against the City alleging equitable subrogation, breach of contract and common law indemnification, all of which arose out of a construction contract betw een the City and Solo Construction Company. 1515 NW 167 Street, Building 5 Suite 200 Miami Gardens, Florida 33169 Although the City denies the all egations asserted by Guarantee, t here is no certainty that the City will prevail. In light of t hese facts, the City Attorney recomm ends settling this matter in the amount of $85,000.00 to limit the City’s poten tial exposure. Proposed Action: That the City Council approve the attached Resolution. Attachment: None
