1515 NW 167 Street, Building 5 Suite 200 Miami Gardens, Florida 33169 In July 2010, the City Council adopted Resolution No. 2010 ‐138 ‐1319 authorizing the City Manager to issue a Purchase Order for $3,274,571 to URS Corporation (URS) for the design and construction administration services for the new Miami Gardens City Hall Municipal Complex. URS has completed all of the Construction Documents for the entire facility and the Miami Gardens Building Department approved the project on April 20, 2012. The Miami Gardens City Hall Municipal Complex project is being developed with a phased approach to expedite the design and construction. Phase I of the new construction consists of the Earthwork Package which prepared the site for the construction of the Municipal Complex. In September 2011, City Council adopted Resolution No. 2011 ‐144 ‐1537 awarding the construction for the Earthwork Package Guaranteed Maximum Price #1 (GMP #1) in the amount of $1,563,397 to Skanska Building USA, Inc. Skanska achieved Substantial Completion on February 21, 2012. The Punch List has been completed by Skanska and the Phase I Earthwork project is in the close ‐out phase. Included in the GMP #1 Earthwork scope of work is a Rain Water Harvesting System (RWHS) for the irrigation of the entire site. In December 2011 Skanska announced that it would not be possible to complete the RWHS within the 90 ‐day duration required by the contract. The City Manager granted Skanska a 44 day time extension so that the new Substantial Completion date was February 21, 2012. The construction for GMP #1 achieved Substantial Completion on February 21, 2012. Included in the Earthwork scope is new domestic water pipes and fire hydrants around the site and fire department connections for each of the future buildings. The Miami ‐Dade Fire Department conducted what was anticipated to be the Final Inspection for the fire service on February 23, 2012. Even though the Fire Department service was installed as indicated on the construction documents that were approved by Miami ‐Dade County, the inspectors requested that the location be revised. Several meetings occurred between Miami Gardens Building Department, City Staff, Skanska, URS and the Miami ‐Dade Fire Department to coordinate the relocation of the fire service. URS issued Field Order #1 to Skanska to relocate the fire service on March 14, 2012. A change order was negotiated for the additional work. Skanska attempted to complete all of the new work within the contractual Final Completion duration but was unable to do so. Skanska has relocated the connections and provided revised information for the as ‐built drawings which have to be approved by North Miami Beach (water service provider) and the Miami ‐Dade Health Department. Skanska has analyzed the time required to reinstall the fire service, provide the revised information for the as ‐built drawings and get all of the work approved by the agencies having jurisdiction. Skanska has requested a 108 day time extension to complete all of the contract requirements and achieve Final Completion for the Phase I Earthwork project. The City Manager has negotiated several additional service change orders with URS to increase the scope of the work that was required. The additional service items included: Relocation of all of the existing trees on the site;
1515 NW 167 Street, Building 5 Suite 200 Miami Gardens, Florida 33169 Demolition for the existing Wachovia building; Separate package for the Phase I Earthwork (GMP #1); Separate package for Phase II City Hall, Mechanical building and Garage (GMP#2); Separate package Phase III Police Department Headquarters (GMP #2); Design for the new NW 185 th Terrace; New roadway lighting for N.W. 27 Avenue and N.W. 187 Street and; Design for all of the open office systems furniture for the City Hall and Police Department. The total for all previously approved additional services is $324,707.50, which is approximately 10% of the original contract value. Current Situation: Due to the 44 ‐day Time Extension granted to achieve Substantial Completion for the GMP #1 Earthwork project and the 108 day Time Extension to achieve Final Completion, URS has had to provide extended Construction Administration Services which included: Attend 8 additional Construction Meetings; Review and approve 3 additional Monthly Pay Requisitions; Revise and resubmit previously approved drawings to all of the agencies due to the relocation of the fire service by the Miami ‐Dade Fire Department. URS also provided additional Construction Administration Services that are attributed to submittals and construction that did not conform to the Construction Documents. The Construction Contract specifies that non ‐conforming work will be charged back to Skanska. The non ‐conforming work includes: Shop Drawings and submittals that required more than two reviews; Field Orders associated with non ‐conforming work; Meetings and design work associated with non ‐conforming work; Site Visits associated with non ‐conforming work. URS submitted proposals for the Extended Construction Administration Services, agency revisions and non ‐conforming work to the City on June 1, 2012. Staff negotiated the scope and the fee for this additional work and received a revised fee proposal on June 18 th and 19 th . The combined additional fee is $24,595. The City Manager’s 10% approval threshold for change order items for this project has already been met. Staff is recommending that Council approve the additional fee for the Extended Construction Administration Services and work associated with the Fire Department Revisions that was completed by URS. Proposed Action:
1515 NW 167 Street, Building 5 Suite 200 Miami Gardens, Florida 33169 It is recommended that the City Council approve the attached resolution authorizing the City Manager to issue a change order to URS Corporation in the amount of $24,595 for the Extended Construction Administration Services, Agency Revisions, and Construction Administration associated with the non ‐conforming work for the Miami Gardens Municipal Complex.
