A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
MIAMI GARDENS, FLORIDA, APPROVING THE APPLICANT,
CHABAD OF MID MIAMI BEACH, INC., REQUEST FOR
VARIANCE FOR PROPERTY LOCATED AT 1515 NW 167TH
STREET, MORE PARTICULARLY DESCRIBED IN EXHIBIT “A”
ATTACHED HERETO, TO ALLOW 41,652 SQUARE FEET OF
RECREATION/PLAY AREA WHERE 163,950 SQUARE FEET IS
REQUIRED; PROVIDING FOR THE ADOPTION OF
REPRESENTATIONS; PROVIDING FOR AN EFFECTIVE DATE.
WHEREAS, the subject property is located at 1515 NW 167th St within the PCD
(Planned Corridor Development) zoning district and the site includes 4 buildings that have
an existing use of office and religious assembly, and
WHEREAS, Chabad of Mid Miami Beach, Inc. (“Applicant”) proposes a private
school serving up to 663 students, ranging from grades 6 through 12 which will be
renovated to include classrooms, office space, indoor and outdoor recreation/play areas,
and
WHEREAS, pursuant to Section 34-288 of the City of Miami Gardens Code of
Ordinances Recreation Playground/Play Areas for educational facilities must provide
adequate recreation/play area based on the number of students attending the facility, and
WHEREAS, based on the anticipated number of students to be enrolled, the
required recreation/play area is 163,950 square feet and the Applicant is only proposing
41,652 square feet of indoor and outdoor recreation space, and
WHEREAS, City Staff recommends that the City Council approve the Applicant’s,
Chabad of Mid Miami Beach, Inc., request for variance for property located at 1515 NW
167th Street, more particularly described in Exhibit “A” attached hereto, to allow 41,652
square feet of recreation/play area where 163,950 square feet is required, and
WHEREAS, the City Council considered the testimony of the Applicant, if any, and
WHEREAS, the City Council also considered the testimony of the City’s Planning
and Zoning Staff, and the Staff Report attached hereto as Exhibit “B” is hereby
incorporated by reference,
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF MIAMI GARDENS, FLORIDA AS FOLLOWS:
Section 1: ADOPTION OF REPRESENTATIONS: The foregoing Whereas
paragraphs are hereby ratified and confirmed as being true, and the same are hereby
made a specific part of this Resolution.

Section 2: AUTHORIZATION: The City Council of the City of Miami Gardens
hereby approves the Applicant, Chabad of Mid Miami Beach, Inc., request for variance
for property located at 1515 NW 167th Street, more particularly described in Exhibit “A”
attached hereto, to allow 41,652 square feet of recreation/play area where 163,950
square feet is required.
Section 3. EFFECTIVE DATE: This Resolution shall take effect immediately upon
its final passage.
