A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
MIAMI GARDENS, FLORIDA, AUTHORIZING AND DIRECTING
THE CITY MANAGER TO RELEASE A PREVIOUSLY
APPROVED DECLARATION OF COVENANT WITH CALDER
RACE COURSE, INC., RECORDED IN CONNECTION WITH
RESOLUTION NO. 2009-01-947-Z-83, FOR THE PROPERTIES
IDENTIFIED BY FOLIO NUMBERS 34-1134-014-0020 AND 34-
1134-014-0015 CURRENTLY OWNED BY EASTGROUP
PROPERTIES L.P.; PROVIDING FOR THE ADOPTION OF
REPRESENTATIONS; PROVIDING FOR AN EFFECTIVE DATE.
WHEREAS, in April of 2009, pursuant to Resolution No. 2009-02-947-Z-83, the
City of Miami Gardens approved and entered into a Declaration of Covenant (Declaration)
with Calder Race Course, Inc. for the property located at 21001 NW 27th Avenue, Miami
Gardens, Florida, identified by Folio Number 1134-014-0010 to permit a Casino Gaming
Operation, and
WHEREAS, in November of 2016 Calder Race Course, Inc., conveyed a portion
of Folio Number 1134-014-0010 to EastGroup Properties, L.P. thereby creating Folio
Number 34-1134-014-0015, and
WHEREAS, in November 2016 EastGroup Properties, L.P. conveyed a portion of
Folio Number 34-1134-014-0015 to EastGroup TRS Inc. creating Folio Number 34-1134-
014-0020, and
WHEREAS, in October of 2020 EastGroup TRS Inc. conveyed Folio Number 34-
1134-014-0020, back to EastGroup Properties L.P. who now is the owner of the
properties identified by Folio Numbers 34-1134-014-0015 and 34-1134-014-0020, and
WHEREAS, the properties are subject to the restrictions outlined in the
Declaration which are strictly pertinent to the operation of a casino, nightclub and
equestrian race track, and
WHEREAS, EastGroup Properties L.P. seeks to utilize the Property for a purpose
other than that recorded in the Declaration and the restrictions contained therein should
be released and of no further force or effect, and
WHEREAS, City Staff recommends the City Council release the Declaration of
Restrictions for the properties identified by Folio Numbers 34-1134-014-0015 and 34-
1134-014-0020, to facilitate the development,
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF MIAMI GARDENS, FLORIDA, AS FOLLOWS:

Section 1: ADOPTION OF REPRESENTATIONS: The foregoing Whereas
paragraphs are hereby ratified and confirmed as being true, and the same are hereby
made a specific part of this Resolution.
Section 2: AUTHORIZATION: The City Council of the City of Miami Gardens
hereby authorizes and directs the City Manager to release a previously approved
Declaration of Covenant with Calder Race Course, Inc., recorded in connection with
Resolution No. 2009-01-947-Z-83, for the properties identified by Folio Numbers 34-
1134-014-0020 and 34-1134-014-0015 currently owned by EastGroup Properties L.P.
Section 3: EFFECTIVE DATE: This Resolution shall take effect immediately upon
its final passage.
PASSED AND ADOPTED BY THE CITY COUNCIL OF THE CITY OF MIAMI
GARDENS AT ITS REGULAR MEETING HELD ON MAY 27, 2026.
