HomeMy WebLinkAbout2026-010-499_-_Rezone_of_El_Dorado_from_Single_Family_to_Light_Industrial_-_Adopted_-_PdfORDINANCE NO. 2026-010-499 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF MIAMI GARDENS, FLORIDA, APPROVING THE REZONING OF THAT CERTAIN PROPERTY LOCATED AT SOUTHWEST OF 4200 NW 167TH STREET IN MIAMI GARDENS, FLORIDA, MORE PARTICULARLY DESCRIBED IN EXHIBIT “A” ATTACHED HERETO, FROM SINGLE FAMILY ("R-1") TO LIGHT INDUSTRIAL ("I-1"); PROVIDING FOR ADOPTION OF REPRESENTATIONS; IN ORDINANCES ALL REPEALING CONFLICT; PROVIDING A SEVERABILITY CLAUSE; PROVIDING FOR INCLUSION IN CODE; PROVIDING AN EFFECTIVE DATE. WHEREAS, Capo & Sons Corp., also known as El Dorado Furniture Store (“Applicant”), is the owner of that certain property approximately located at Southwest 4200 NW 167th Street in Miami Gardens, more particularly described in Exhibit “A”, and WHEREAS, the subject property consists of a vacant lot totaling 4.21 acres surrounded by largely industrial and government- related uses with some residential uses, and WHEREAS, Applicant wishes to expand the existing El Dorado furniture store and distribution center to support the loading, unloading, and staging operations associated with El Dorado’s warehouse function, and WHEREAS, the subject property is currently zoned Single Family Dwelling (“R- 1”) in order to facilitate the expansion, Applicant is requesting a rezoning to Light Industrial (“I-1”), and WHEREAS, the rezoning request is deemed to be generally consistent with the Goals, Objectives and, Policies of the City of Miami Gardens Comprehensive Development Master Plan (CMDP), and satisfies the criteria for granting of amendments or adoption of changes to the text of the LDRs or change of the actual official zoning map designation of a parcel or parcels, and WHEREAS, City Staff recommends the City Council approve the Ordinance rezoning that certain property located at Southwest 4200 NW 167th street in Miami Gardens from Single Family Dwelling (“R-1”), to Light Industrial (“I-1”), and WHEREAS, the City Council has considered the testimony of the Applicant, if any, and WHEREAS, the City Council also considered the testimony of the City’s Planning and Zoning staff and the staff’s report, a copy of which is attached hereto as Exhibit “B” and incorporated herein by reference, Page 1 of 14 Docusign Envelope ID: 73373484-E516-8509-809A-7FC36CC5DFE6 NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF MIAMI GARDENS, FLORIDA, AS FOLLOWS: Section 1. ADOPTION OF REPRESENTATIONS: The foregoing Whereas paragraphs are hereby ratified and confirmed as being true, and the same are hereby made a specific part of this Ordinance. Section 2. APPROVAL: The City Council of the City of Miami Gardens, Florida, hereby approves the rezoning of that certain property located at Southwest 4200 NW 167th Street in Miami Gardens, more particularly described in the attached Exhibit “A”, from Single Family Dwelling (“R-1”) to Light Industrial (“I-1”). Section 3. CONFLICT: All ordinances or Code provisions in conflict herewith are hereby repealed. Section 4. SEVERABILITY: If any section, subsection, sentence, clause, phrase or portion of this Ordinance is for any reason held invalid or unconstitutional by any court of competent jurisdiction, such portion shall be deemed a separate, distinct and independent provision and such holding shall not affect the validity of the remaining portions of this Ordinance. Section 5. INCLUSION IN CODE: It is the intention of the City Council of the City of Miami Gardens that the provisions of this Ordinance shall become and be made a part of the Code of Ordinances of the City of Miami Gardens and that the section of this Ordinance may be renumbered or relettered and the word “Ordinance” may be changed to “Chapter,” “Section,” “Article” or such other appropriate word or phrase, the use of which shall accomplish the intentions herein expressed. Section 6.EFFECTIVE DATE: This Ordinance shall become effective immediately upon its final passage. PASSED ON FIRST READING ON THE 27th DAY OF MAY, 2026. On February 25, 2026, the applicant, CAPO & SONS CORP, submitted a request to rezone a vacant parcel located southwest of 4200 NW 167th Street from Single-Family Dwelling Residential to Heavy Industrial. On March 25, 2026, during the second reading of the proposed rezoning item, the City Council voted to deny the application. The applicant has since submitted a new request to rezone the same parcel from Single-Family Dwelling Residential to Light Industrial in lieu of the previously requested Heavy Industrial designation. The revised application proposes a warehouse expansion that is identical to the prior submittal. El Dorado’s development plan proposes an expansion of the existing facility, consisting solely of additional warehouse space. There will be no additional showroom or retail space added to the proposed addition. Some notable improvements include 12,340-square-foot loading dock, 36 new truck parking spaces, upgraded pavement for heavy-duty traffic, internal drive aisles, directional signage, and a 12-foot water easement. The expansion seeks to improve on-site circulation, propose enhanced landscaped buffers that provide screening and separation from adjacent uses. Rezoning to Light Industrial is intended to support the loading, unloading, and staging operations associated with El Dorado’s warehouse function. The proposed rezoning will enable El Dorado to expand its business into a successful distribution center and furniture store at this location. Pursuant to Section 34-14 (i) of the City Code: (i) I-1 Light Industrial district. Provides for a wide range of land uses including research, assembly, fabrication, manufacturing, repair, service, retail, entertainment, and places of assembly. Implements the CDMP urban industrial component of the commerce land use category Consistency with City of Miami Gardens Comprehensive Development Master Plan (CDMP) The City’s development can be viewed as two distinct areas: commercial corridors and neighborhoods. The City has generally designated residential areas as the “Neighborhood” land use category, and major commercial corridors as the “Commerce” land use category. The subject site is designated as Commerce within the City of Miami Gardens Comprehensive Development Master Plan (CDMP) Future Land Use Map (FLUM). The Commerce land use designation is intended for planned urban commercial, urban industrial, urban cultural and economic hubs. Commerce areas shall include existing and planned activity centers that are primarily located along the City’s three major arterial roadway corridors. Based on the vacant land use analysis in the City Comprehensive Plan, the City is essentially built out and the focus now is on infill development opportunities. The Comprehensive Plan also states the following: “The City’s Future Land Use concept reflects a combination of existing land use characteristics, currently approved Industrial, zoning and development trends. El Dorado’s showroom, retail, and warehouse functions are located along a major arterial roadway corridor, further aligning with the Commerce land use designation. Commerce land use designation as outlined in the City’s CDMP Goals, Objectives and Policies as follows: Policy 1.3.1: Commerce areas shall provide for a wide variety of uses that range from major educational institutions, civic and governmental centers to major retail services as well as single purpose industrial areas. Policy 1.3.6: Uses that are consistent with the Commerce land use category include mixed use developments such as Urban Center, Urban Core and Golden Glades-Palmetto Area, single use developments including Urban Commercial and Office, Urban Industrial, residential development including Medium Density Residential, Medium- High Density Residential, High Density Residential, and Very High Density Residential plus Public and Semi-Public uses. Zoning Review and Analysis The City Council may grant the rezoning of the property subject to meeting the criteria set forth in Section 34-49(f) of the City’s Land Development Regulations: “(f) Criteria for granting of amendments or adoption of changes to the text of the LDRs, or change of the actual official zoning map designation of a parcel or parcels.
