D/B/A JUDSON AND PARTNERS ARCHITECT AND CLYDE JUDSON, JR., CASE NO. 08-78731 CA 11; AUTHORIZING THE CITY ATTORNEY AND CITY MANAGER TO TAKE ANY AND ALL STEPS NECESSARY TO EXECUTE A SETTLEMENT AGREEMENT; PROVIDING FOR THE ADOPTION OF REPRESENTATIONS; PROVIDIN G FOR AN EFFECTIVE DATE. Staff Summary: On June 1, 1999, Judson and Partners Architect (“Judson Architecture”) entered into an Agreement with Miami D ade County for consulting and professi onal services relating to the “Carol City Center”, now known as The Betty T. Ferguson Recr eation Complex. In November 2004, the City Council authorized a transfer of the agreement with Juds on and Partners from Miami-Dade County to the City of Miami Gardens. In 2008, th e City Council authorized the termination of the Agr eement between the City and Judson Architecture.
1515 NW 167 Street, Building 5 Suite 200 Miami Gardens, Florida 33169 The City ultimately filed litigat ion against Judson Architecture and it is being recommended that the City Council authorize a settl ement of the litigatio n in this matter. The settlement would require that Judson Architecture pay the City the sum of Four Hundred Twenty-Five Thousand Dollars ($425,000.00), and in addition Judson Architecture would agr ee to assign to the City, the right to pursue claims against sub-consul tants who worked for Judson Architecture.
