REGULAR CITY COUNCIL MINUTES
JANUARY 14, 2015
A) CALL TO ORDER/ROLL CALL
The City Council for the City of Miami Gardens, Florida, met in regular session,
Wednesday, January 14, 2015, beginning at 7:00 p.m., in the City of Miami Gardens, 18605
NW 27t' Avenue, Miami Gardens, Florida.
The following members of the City Council were present: Mayor Oliver Gilbert, Vice
Mayor Felicia Robinson and Council members Lisa C. Davis, Lillie Q. Odom, Rodney Harris,
David Williams Jr., and Dr. Erhabor Ighodaro.
Also in attendance were: City Manager Cameron Benson, City Attorney Sonja K.
Dickens and City Clerk Ronetta Taylor.
B) INVOCATION
Mayor Gilbert delivered the Invocation.
C) PLEDGE OF ALLEGIANCE
Recited in unison.
D) APPROVAL OF MINUTES
Motion offered by Councilman Williams, seconded by Councilman Harris to approve the
minutes with necessary corrections, if any. This motion passed and carried by a unanimous
voice vote of the members present.
E) ORDER OF BUSINESS (Items to be pulled from Consent Agenda at this time)
Councilwoman Davis pulled Item K-3 from the Consent Agenda.
Motion offered by Councilman Ighodaro, seconded by Vice Mayor Robinson to adopt the
official agenda with the necessary changes/deletions/additions.
There being no further discussion, the motion to adopt the official agenda passed and
carried by a unanimous vote of the members present.
F) SPECIAL PRESENTATIONS (5 minutes each)
F-1) Office of the City Clerk
Clerk Taylor along with the staff from the Office of the City Clerk presented Deputy City
Clerk Mario Bataille with a plaque for his dedicated service during his employment with the City

of Miami Gardens. Mr. Bataille has accepted the position of City Clerk for the City of
Hallandale Beach, Florida.
G) PUBLIC COMMENTS
Francis Ragoo appeared before the City Council to share information about the American
Cancer Society and the Relay for Life Event scheduled for April 17-18, 2015, at the Betty T.
Ferguson Recreation Center.
Damien Morgan representing the American Cancer Society appeared before the City
Council to further expound on the Relay For Life Event. He stated that Relay For Life wanted to
be a part of the Jazz in the Gardens event scheduled in March. Chili's, 19801 NW 2"d Avenue,
Miami Gardens is also participating by contributing ten percent (10%) of meals purchased to the
American Cancer Society. That participating will take place January 22"d from 11:00AM -
11:00PM
Patrick Lowrie, 110 NW 208th Street, Miami Gardens, Florida, appeared before the City
Council to thank the City of Miami Gardens Police Department for their quick response as it
related to speeding in his neighborhood. He asked whether some type of signage could be
erected in the area thanking people for not speeding.
Mayor Gilbert informed Mr. Lowrie that someone from Public Works and the Police
Departments would be speaking with him about his inquiry.
JoAnn Harris, 5020 NW 197th Street, Miami, Florida 33055, appeared before the City
Council to share that her group had performed during the Elderly Affairs Advisory Committee
Annual Holiday Party.
Athena H. Grant, 1045 Curtiss Drive, Opa-locka, Florida, appeared before the City
Council to ask when was the New City Hall built.
Mayor Gilbert offered to provide Ms. Grant with a tour of the building.
Marcelle B. Jones a representative from Goldson Spine Rehabilitation Center appeared
before the City Council and shared that a big part of her organization is community outreach.
Goldson Spine Rehabilitation Center selected Miami Gardens to bring its 5K Run event, this
year. The event is scheduled, February 21, 2015, starting at Betty T. Ferguson Recreation Center.
Dr. David Jackson, 18821 NW 19th Avenue, Miami Gardens, Florida, appeared before the
City Council to express concern with the violent crimes in his neighborhood. He also expressed
concern with speeding and the lack of police presence in his neighborhood. He further expressed
concern with having the City of Miami Gardens identified; certain areas of the City are being
called Opa-locka and Carol City.

Mayor Gilbert informed Dr. Jackson that someone will speak with him with regards to
increased police presence. The zip code issue is also being addressed, but it is a process.
Ulysses Harvard, 1693 NW 193`d Street, Miami Gardens, Florida, appeared before the
City Council to express concern with Item L-1. He shared that one of the individuals that bided
on the Planning Services is actual a product of this community. He asked the Council to
consider E.L. Waters & Company, LLC., for Planning Services.
Sonia Flowers, 17435 NW 17th Avenue, Miami Gardens, Florida, appeared before the
City Council to express concern with the Granny B Restaurant Property, which is vacant; also
the gas station on NW 19th Avenue and 183`d Street. She said these properties are becoming
homes for the homeless. She shared that she was told previously that this matter would be taken
care of within 60-90 days, which did not happen. She announced that Scott Lake Crime
Prevention meeting is scheduled for January 29, 2015, starting at 6:30 p.m., at Scott Lake
Elementary School. This group will be hosting its annual outing to Orlando, Florida to the Holy
Land, February 28, 2015. The ticket price is $95.00, which includes the bus fee as well as food
and the entrance fee.
Charles McCoy, 16200 NW 18th Place, Miami Gardens, Florida, appeared before the City
Council to express concern with noise in his neighborhood.
Mayor Gilbert informed Mr. McCoy that the City has a noise ordinance in place. It is
just a matter of getting enforcement out to his neighborhood.
Betty T. Ferguson, 1625 NW 188th Terrace, Miami Gardens, Florida, appeared before the
City Council to speak on behalf of UP -PAC and many others in the community, as she has done
for the past 30 years. She shared when the City was created she limited her political comments
to Saturday mornings at UP -PAC.
Ms. Ferguson stated that it has been painful for her to watch a brand-new city with the
opportunity to be different, as it was created to be. However, the City is starting to look very
much like the County. The City Council will vote tonight to award a contract that cuts to the
very heart of why she is feeling pushed tonight to the point of speaking out. She said residents
want to understand why decision -makers in the City of Miami Gardens appear not to be
concerned enough about the perception all over this County that qualified African-Americans
don't get opportunities. She opined one of the reasons Miami Gardens was created was because
residents believed we could better govern ourselves and that African-Americans could have a
fair chance to get contracts to grow and develop their businesses. We of all people understand
the excuse used by the power structure to keep us at the back of the bus.
Ms. Ferguson emphasized the importance of giving African-Americans who are truly
qualified opportunities here in Miami Gardens; opportunities that did not exist in the same
system that we pulled away from. She conveyed her belief that the City Manager if allowed

could spread the word around that major contracts are given to qualified people. Many will feel
that they are being treated fairly. We have professionals to manage our City, and opined the
Council should not be micromanaging because they are not the paid professionals. The council
members were elected to represent constituents not to rubberstamp. She further opined that each
Council member should have a Legislative Aide that would do the researched, to assist the
Council in making decisions.
Ms. Ferguson opined, in the wake of good government elected officials should have to
justify why they voted a certain way. When it comes to major contracts we should not feel there
is an uneven playing field.
Latasha Pickett, 9431 Live Oak Place, Davie, Florida, appeared before the City Council
to express concern about not being able to become a vendor at the Jazz in the Gardens Music
Festival. She indicated that she has been trying to become a vendor for the past four years.
Mayor Gilbert asked Ms. Pickett to speak with Assistant City Manager Vernita Nelson
about this matter.
Melissa Williams, 1810 NW. 152nd Terrace, Miami Gardens Florida, appeared before the
City Council to speak about the character of Mr. Elbert Waters and his company. She shared
that she has known Mr. Waters for over 51 years. His parents lived around the corner from her.
She shared that she is very familiar, as well as she is sure the Council members are about Title
VII, which relates to equal opportunity, and not be judged because of the color of one skin or
religion, race and all the other stuff. She shared that Mr. Waters is a graduate from FAMU. He
was a city planner for the City of Miami, as well as a supervisor for the Water and Sewer
Department for Broward County. She stated that she did not want the Council to award the
contract because he's black; she wanted the Council to award the contract to Mr. Waters because
she believe this company is the best qualified. She commented, "If not now, when."
Mayor Gilbert took this opportunity to present Mario Bataille, Deputy City Clerk with a
proclamation. He shared that it was only ten years ago that Mario was working at a movie
theater picking up popcorn. He started here in the City as an assistant in the Office of the City
Clerk. He was smart, intelligent and conveyed his interest in becoming a City Clerk. Our Clerk
who is a teacher sent him to every training session required for his certification. That is not a
story only related to him, but a story throughout the city and its employees. People who started
at the bottom have moved up. Vemita Nelson started out as a contract employee she is now an
Assistant City Manager. The city provided job training and gave them not just jobs; the City
gave them careers. Mario is leaving us to become a City Clerk. Mario's story is not uncommon
because whether it be Daniel Rosemond or Renee Miller, or any number of black municipal
professionals around Broward and Dade County; they got their training here in the City of Miami
Gardens. So when you say why the City was created I give you Mario Bataille, a guy who was
picking up popcorn ten years ago. He is going to be a City Clerk in the City of Hallandale
Beach. I give you Renee Miller, who is the City Manager of Hallandale Beach. I give you

Daniel Rosemond who is the Deputy City Manager of Hallandale Beach. I give you
administrators from around this area that we offered opportunities to. They are gone.
Mayor Gilbert commented, so, you say why this City was created. One of the interesting
questions was if not now, when and shared one of the contractors for the City Hall complex was
Foster Construction; which was not only black but local and lives here in the Andover area.
When the bond was done all three law firms used were black. When we do public relations,
Sonshine For All, and Circle of One are black. We are the Council that sent residents to the
police academy, and gave them careers in law enforcement. That is who this Council is. So,
when you say that as a City we have deviated from the message that is not true.
Mayor Gilbert shared that the production crew, which provides the staging and
equipment services for Jazz in the Gardens, "Drummer Boy" is a black company. The City
Manager, the Assistant City Managers, the Chief of Police and the two Assistant Chiefs of Police
are all African Americans. This Council did that. These are the facts. He encouraged residents
to ask the City Manager who the City is doing business with. He also shared that the City has
been doing a good job in hiring residents. He further shared that the City has the only African-
American female Building Official in the State of Florida.
Mayor Gilbert presented Mario Bataille with a proclamation, proclaiming, Wednesday,
January 14, 2015, as Mario Bataille Day in the City of Miami Gardens.
Mario Bataille thanked each member of the Council for their support over the years. He
also thanked the City Manager and City Attorney for their support. He further thanked the City
Clerk of believing in him and his ability; for her guidance and leadership.

Councilwoman Davis inquired about the dollar amount paid for lobbyist services, last
year.
Mayor Gilbert in response to Councilwoman Davis' inquiry explained that there were
some issues in Tallahassee, which prompted him to have to travel there for several meetings.
Even though the lobbyist contract had expired, service was provided. He placed emphasis on the
importance of approving this contract. The amount is the same as last year's.
Motion offered by Mayor Gilbert, seconded by Councilman Harris to adopt this item.

voice vote.
RESOLUTION NO. 2015-09-2206

Shellie Ransom -Jackson, Director of Development Services and Code Compliance
appeared before the City Council to answer any questions.
Councilwoman Davis inquired about the dollar amount to be paid to the contractor.
Ms. Ransom -Jackson said staff was looking at a revenue component, and cash recovery
component.
Mayor Gilbert clarified the City is not paying any money at all.
Motion offered by Mayor Gilbert, seconded by Vice Mayor Robinson to award the
contract to Calvin Giordano & Associates, Inc. He shared his rationale for selecting Calvin
Giordano & Associates, Inc. He emphasized the importance of voting for the benefit of the City.
He said this contract encompasses the Planning and Zoning Department; the whole thing, which
is a big deal. He expressed concern with not having enough staff to address those Planning and
Zoning items. He stated if you read the specs and read what was presented, the proposals were
not close to what was being asked for, and that is why he was going with Calvin Giordano &
Associates, Inc.
There being no further discussion, the motion to adopt with Calvin Giordano &
Associates, Inc., failed by a 3-4 vote.

(Q) REPORTS OF MAYOR AND COUNCIL MEMBERS
Councilwoman Davis announced that she is hosting a Town Hall meeting, Monday,
January 26, 2015, for Residential Area Seat -2. The meeting is scheduled from 6:30PM to
8:30PM. The topic of discussion is the renovation of the City's parks. She encouraged everyone
with questions to come out for this informative meeting.
Councilman Williams shared that the Miami Herald partnered with the City during the
Science and Engineering Fair. At a date to be determined in February, the Miami Herald is
going to invite all the winners and their families to the Miami Herald Building to meet other

Vice Mayor Robinson announced the Dr. Martin Luther King Jr., celebration is scheduled
for this upcoming weekend. Alpha Kappa Alpha Sorority will be hosting a summit for youth at
New Way Baptist Church, from 4-6 p.m., Sunday, January 18, 2015.
Mayor Gilbert shared that he had an opportunity to attend the Miami City Ballet. He said
this was the first time he had ever attended a ballet. He shared his desire to bring this type of
event to the youth of Miami Gardens. He emphasized the importance of exposing our youth to
art and cultural programs.
