DECEMBER 9, 2015
(A) CALL TO ORDER/ROLL CALL
The City Council for the City of Miami Gardens, Florida, met in regular session,
Wednesday, December 9, 2015, beginning at 7:OOPM, in the City Hall, Council Chambers,
18605 NW 27thAvenue, Miami Gardens, Florida.
The following members of the City Council were present: Mayor Oliver Gilbert, Vice
Mayor Felicia Robinson and Council members: Lisa C. Davis, Lillie Q. Odom, Rodney Harris,
David Williams Jr., and Dr. Erhabor Ighodaro.
Also in attendance were: City Manager Cameron Benson, City Attorney Sonja K.
Dickens and City Clerk Ronetta Taylor.

Motion offered by Councilman Williams, seconded by Councilman Harris to adopt the
minutes, with necessary corrections, if any.
There being no discussion, the motion to adopt passed and carried by a unanimous voice
vote.
(E) ORDER OF BUSINESS (Items to be pulled from Consent Agenda at this time)
Vice Mayor Robinson pulled Items K-3 and K-5, from the Consent Agenda.
Councilwoman Odom pulled Item K-2, from the Consent Agenda.
Councilman Ighodaro pulled Item K-7, from the Consent Agenda.
Manager Benson pulled Item K-12, from the Consent Agenda.

FLORIDA, APPROVING THE FINAL PLAT FOR "MAJORCA ESTATES",
SUBMITTED BY D.R. HORTON, INC., FOR THE PROPERTY GENERALLY
LOCATED AT NW 208' STREET AND NW 9TH COURT, MORE PARTICULARLY
DESCRIBED ON EXHIBIT "A" ATTACHED HERETO; PROVIDING FOR THE
ADOPTION OF REPRESENTATIONS; PROVIDING FOR AN EFFECTIVE DATE.

Mayor Gilbert moved Items M-2 and M-3, forward on the agenda to be heard after
Special Presentations.
Motion offered by Councilman Ighodaro, seconded by Councilman Williams to approve
the Official Agenda, with the changes/additions/deletions/amendments. There being no further
discussion, this motion passed and carried by a unanimous vote of the City Council.
(F) SPECIAL PRESENTATIONS (5 minutes each)
F-1) Vice Mayor Robinson — Amerigroup
Cheretha Ferguson appeared before the City Council representing the Amerigroup. She
presented a check in the amount of $5,000 to Global Teen Solutions for their work with the City
of Miami Gardens' Afterschool Program. She further thanked Vice Mayor Robinson's for her
partnership with Global Teen Solutions. Certificates of Appreciation were to give to each
Council member for their support.
(G) PUBLIC COMMENTS
Robert L. Brown, 20394 NW 14th Place, Miami Gardens, Florida, appeared before the
City Council to express concern with Coconut Cay. He asked why was City staff signing off on
the various projects when there were issues with the project, especially with flooding. He opined
that someone did not do their job.
Mayor Gilbert in response to Mr. Brown's concerns shared that Miami -Dade County
approved the plans for the Coconut Cay project. He shared that he is open to meet with Mr.
Brown. He asked the City Attorney to be prepared to provide a briefing on the CDC.
Mr. Brown asked why was the city still signing off on this particular developer's projects.
Tanya James, Elderly Affairs Advisory Committee Chair appeared before the City
Council to report on the activities of the Committee. She thanked Mayor Gilbert, Councilman
Williams, Councilwoman Odom, Chief Antonio Brooklen and City Clerk Ronetta Taylor for
attending the Senior Holiday Party.
Marlene Arribas, 20630 N. Miami Avenue, Miami Gardens, Florida, appeared before the

City Council to congratulate Councilwoman Davis for spearheading the Wine and Food
Experience Event. She shared this was a wonderful event and many of the people that did not
attend the event are sorry they did not attend. She opined this event and Jazz in the Gardens
really shows the other side of Miami Gardens. She conveyed hopes that this event is continued.
Dorothy Smith, 20484 NW 14th Place, Miami Gardens, Florida, appeared before the City
Council to express concern with D.R. Horton, the developer of Coconut Cay, and the flooding in
her neighborhood. She requested that the City Council not approve Item L-1 (the final plat for
"Majorca Estates", submitted by D.R. Horton, Inc.). She stated that D.R. Horton has not
addressed the flooding problems in Coconut Cay.
Lonnie Lawrence, 831 NW 207th Street, Miami Gardens, Florida, appeared before the
City Council to thank them for the all the things they are doing to bring awareness to the City.
He shared that he'd once mentioned to the City Manager that Miami Gardens should be a
destination spot. He shared that he missed the Wine and Food Experience because of the
NOBLE Gala was scheduled at the same time. He encouraged the Council to continue doing
what it is doing because of the positivity events such as Jazz in the Gardens and the Wine and
Food Experience brings to the City. He made reference to the Science and Engineering event
sponsored annually by Councilman Williams and shared that type of positive activity is not
reported on the 10:00 PM news.
Elizabeth Garcia, 5451 NW 169th Terrace, Miami, Florida, appeared before the City
Council in support of the Wine and Food Experience event. She shared that she has lived in this
area for over 27 years. She opined the 2015 Wine and Food Experience sponsored by
Councilwoman Davis was a phenomenal event. She further shared that she was a vendor at the
event and many of her clients came out in support.
Roosevelt Murray, 1420 NW 192nd Street, Miami Gardens, Florida, appeared before the
City Council in opposition to bringing more churches into the community.
Mary C. Reeves, 1521 NW 168th Terrace, Miami Gardens, Florida, appeared before the
City Council to express concerns with her neighborhood. She said safety in the community
should be a high priority. She stated that she wanted to get involve with the City but did not
know where to start.
Mayor Gilbert advised Ms. Reeves that the Police Department and Code Compliance
would speak with her about her concerns.
Mykita Cherry Prime, 3101 NW 171 St Terrace, Miami Gardens, Florida, appeared before
the City Council as the Chair of the Progressive Young Adult Advisory Committee. She
recounted the original Committee was dissolved a few years back. She applauded the Mayor and
Council members for reinstating the Committee. She shared that the Committee would be
hosting a Voter Registration Drive during the month of January at Florida Memorial, St. Thomas
Universities and Job Corp.

Deen Tyler, 20820 NW 25th Avenue, Miami Gardens, Florida, appeared before the City
Council to thank the City Attorney for her response as it related to the LeVar Hall item. He
asked for clarification on the 60 Million Dollars Bond funds when Mayor Gilbert has stated that
the funds were moved to One United Bank. He asked whether the entire 60 Million Dollars was
placed with this financial institution. He further stated that he was opposed to the Shot Spotter
Program.
Bentley Francis, 1545 NW 183`d Street, Miami Gardens, Florida, appeared before the
City Council to convey appreciation to the City Council and commended the police department
for doing a good job.
Chef Troy Tingling, 3329 NW 201" Street, Miami Gardens, Florida, appeared before the
City Council and shared that he grew up in this community. He later moved to New York where
he acquired the much needed skills to become a success. Subsequently he returned home to
Miami Gardens. He thanked Councilwoman Davis for allowing him to be a part of the Wine and
Food Experience. He shared that he has some ideas, which he would like to explore to help
young people in this area.

Councilwoman Odom inquired whether this item supports the School Board
establishment of Success Centers for students.
Councilwoman Davis explained this item supports HB 625, which would require school
districts to establish success centers.
Councilwoman Odom asked whether the success centers would be set up in districts.
Vice Mayor Robinson shared Success Centers are up and running and are set up in
districts. There are two Success Centers in Miami Gardens: 1) Parkway Middle School and 2)
Andover.

Vice Mayor Robinson said the Wine and Food Experience event was great. She opined

we might be moving prematurely. She said she had spoken with the city manager about the cost
of the event. She suggested holding off on this until the Council knows whether this is
something that can actually be fitted into the budget.
Mayor Gilbert opined that Vice Mayor Robinson has a very good point.
Vice Mayor Robinson further shared from her understanding with the city manager
everything has not been reconciled. She said she would feel more comfortable voting for this
item after she has seen some numbers.
Councilwoman Davis said she sponsored this event because she wanted to do something
different. She said the City has Jazz in the Gardens, which is a signature event. Now the City
has another signature event, which received so much positive reviews that it was compared to
Art Basel. She stated that she did not see a reason why the Council needs to stop the momentum.
Vice Mayor Robinson conveyed belief that this is a really great event. She said she
needed to see the numbers because money does matter.
Mayor Gilbert noted there is a revised item, which puts the event in FY 2016-17 budget.
He opined it is important to get the numbers so that there is a clear financial picture of the event.
He said when we consider the budget we will have another opportunity to actually vote on this
item.
Councilwoman Odom stated that she too would like to see the preliminary figures for this
event.
Craig Clay, Assistant City Manager appeared before the City Council and shared that as
it stands right now the City underwrote approximately $130,000.00.
Motion offered by Councilwoman Davis, seconded by Councilman Harris to adopt this
item. There being no further discussion, the motion to adopt passed and carried by a 5-2 voice
vote. Vice Mayor Robinson and Councilwoman Odom cast the dissenting votes.
K-5) A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
MIAMI GARDENS, FLORIDA, AUTHORIZING THE LAUNCH
OF THE CITY OF MIAMI GARDENS "GRIO" RADIO STATION
WITH LIVE 365; AUTHORIZING THE CITY MANAGER TO
TAKE ANY AND ALL STEPS NECESSARY TO LAUNCH THE
MIAMI GARDENS "GRID" RADIO STATION; PROVIDING FOR
THE ADOPTION OF REPRESENTATIONS; PROVIDING FOR AN

Motion offered by Councilwoman Odom, seconded by Mayor Gilbert to adopt this item.
Vice Mayor Robinson opined that the City did not have the staff to man a radio station at
this time.

Councilwoman Odom asked whether this was an AM or FM station.
Mayor Gilbert said this radio station is on the internet.
Councilwoman Odom said her concern is how would this radio station actually benefit
the city as a whole.
Councilman Ighodaro said from the feedback he has been receiving from his Uni'Tea
Events residents are wanting information. The cost is a fixed cost.
Councilman Williams commented this would be a free internet radio station.
Vice Mayor Robinson reiterated that it will take city staff to maintain this radio station.
She also expressed concern with the regulation of advertisement.
Mayor Gilbert opined having several forms of communication is a good idea. He said the
item has to be something that directs the city manager to draft applicable policy for this type of
service. He said he did not like the idea of Councilman Ighodaro paying for the monthly
maintenance.
At the conclusion of this discussion, motion offered by Councilman Williams, seconded
by Councilwoman Odom to defer this item to the January 13, 2016, City Council meeting, at

Councilman Ighodaro said he had pulled this item because he did not approve of utilizing
inmates when there are so many residents seeking employment. He further expressed concern

program. The inmates participating in this program are all volunteers and receive no special

such as a Men's Ministry.

Councilman Williams said this request is to rezone from Agriculture to Neighborhood
Commercial and asked whether there would be a future need for Agriculture in this area.

Mayor Gilbert opened the floor for this public hearing.
The Consultant for this application appeared before the City Council to solicit support of
the rezoning application. The request is to rezoning from Planned Corridor Development to R-1,
Single Family. This would accommodate 71 single family homes on 14 acres of property.
Flora Johnson, 1910 NW 163rd Street Road, Miami Gardens, Florida, appeared before the
City Council to express concern with this request as it relates to Miami Gardens' residents. Prior
developments have become Section 8 Housing, which does not provide a benefit for the working
class citizens of this community. She further expressed concerned that the elderly population is
being forced out of the community because they can no longer afford to live in their homes.
There are no affordable elderly housing options for Miami Gardens' seniors.
There being no other interested parties to speak on this item, the public hearing was
closed.

this item on first reading.
Councilwoman Odom asked about the square footage of the proposed single family
homes.
The Consultant in response to Councilwoman Odom's inquiry said between 1,400 and
1,700 square feet. The price is also market driven.
Councilman Williams inquired about whether a traffic study was conducted.
Elbert Waters, City Zoning Consultant appeared before the City Council to clarify that
the only thing that is being requested right now is a zoning change. Once the zoning change has
been approved, the developer would be putting together a development plan for the City's
Development Review Committee for review. At that particular time all items including the site
plan will be reviewed.
Mayor Gilbert clarified that the site plan review will not come before the Council for

review.
Mr. Waters further shared that the City has a very good Land Development Regulation
program, with strict criteria in place.
Mayor Gilbert asked whether there is a mandate that the properties would be owner
occupied.
Ms. Ransom Jackson in response to Mayor Gilbert's inquiry said there is no mandate that
the properties be owner occupied. She said a Declaration of Restrictions would have to be
agreed upon.
Mayor Gilbert shared that he might be the only person on the dais who actually voted
against this rezoning the last time. He shared that he would be supporting this application this
time. He explained the last time the development translated into apartments, which were thought
to become low income. At that time the developer was told that they needed to bring the City a
development that was for single family homes that would be owner occupied. This will also put
this property back on the tax roll.
