The following members of the City Council were present: Mayor Oliver Gilbert, Vice Mayor Felicia Robinson and Council members: Lillie Q. Odom, Lisa C. Davis, Rodney Harris, David Williams Jr., and Dr. Erhabor Ighodaro. Also in attendance were: City Manager Cameron D. Benson, City Attorney Sonja K. Dickens and City Clerk Ronetta Taylor. There being no discussion the motion to adopt passed and carried by a unanimous voice vote. (E) ORDER OF BUSINESS (Items to be pulled from Consent Agenda at this time) Items K-2; K-4; and K-9 were pulled from the Consent Agenda. A replacement for Item N-01 was provided to the Council. The following item was added to the official agenda as Item K-11 "A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF MIAMI GARDENS, FLORIDA, SUPPORTING MIAMI-DADE COUNTY COMMISSION CHAIRMAN JEAN MONESTIME AND THE FOR SOUTH FLORIDA HAITIAN RELIEF GROUP FOR THEIR TRANSPARENCY RELIEF EFFORTS; PROVIDING FOR THE ADOPTION OF REPRESENTATIONS; PROVIDING FOR AN EFFECTIVE DATE. There being no further discussion the motion to approve the official agenda passed and carried by a unanimous voice vote. (F) SPECIAL PRESENTATIONS (5 minutes each) None (G) PUBLIC COMMENTS Sondra Wallace, 4350 NW 181" Terrace, Miami Gardens, Florida, appeared before the City Council to express concern with some of the homes in her neighborhood (NW 183rd to 167th Street between NW 42nd Avenue and 57th Avenue) that have become rooming houses. Mayor Gilbert shared that the area Ms. Wallace was referencing was not in the corporate boundaries of the City of Miami Gardens. He explained on NW 183rd Street the City's boundary ends at NW 47th Avenue. Ms. Wallace shared within her immediate area NW 183rd Street to NW 181" Terrace from NW 47th Avenue to 42nd Avenue the same conditions apply. She stated that she has spoken numerous times with representatives from the City's Code Compliance Division about her concerns. Mayor Gilbert informed Ms. Wallace that Ms. Bispot will speak with her about conducting a Code Enforcement Sweep in this area. Ledell Jackson, 1241 NW 174th Street, Miami Gardens, Florida, and members of the Scott Lake Crime Watch appeared before the City Council to express concern with the rehabilitation center (Fallen Leaves) near their neighborhood. He stated a meeting to discuss this matter with Councilman Harris was cancelled due to the hurricane threat. He asked that this meeting be rescheduled. He further stressed the importance of rescheduling this meeting as soon as possible with all the Council members in attendance. Mayor Gilbert informed Mr. Jackson of the Sunshine Law requirements when two or more Council members are attending a meeting where a matter has the potential of being brought before Council. Staff was directed to coordinate a meeting between residents, Fallen Leaves representatives and possible Council Members. The City Clerk would ensure all applicable actions were taken to satisfy the Sunshine Law requirement. Rita Pierre, 1000 NW 197th Terrace, Miami Gardens, Florida, appeared before the City Council to thank everyone for their support during her time of her bereavement as well as her hospitalization. She especially thanked Councilwoman Davis, her senior group and the UPPAC family. (SPONSORED BY THE CITY MANAGER) Councilman Williams asked whether staff would provide a report on how this money was spent. Manager Benson in response to Councilman Williams' inquiry said this grant would not only pay for bicycles but some of the overtime cost from an operational standpoint. He said he would be happy to provide a report on how the overtime is being managed as well as the expenditure for the bicycles. item. RESOLUTION NO. 2016-170-3069 K-9) A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF MIAMI GARDENS, FLORIDA, AUTHORIZING THE CITY MANAGER TO APPLY FOR AND ACCEPT A GRANT FROM THE ECONOMIC DEVELOPMENT ADMINISTRATION; AUTHORIZING THE CITY MANAGER TO TAKE ANY AN ALL STEPS NECESSARY TO APPLY FOR AND ACCEPT THE GRANT; AUTHORIZING A MATCH OF FUNDS; PROVIDING FOR THE ADOPTION OF REPRESENTATIONS; PROVIDING FOR AN EFFECTIVE DATE. (SPONSORED BY THE CITY MANAGER) Councilman Ighodaro asked about the City of Miami Gardens' Chamber of Commerce as it relates to a partnership with the City's Economic Development Program. He asked whether such a partnership was contemplated. Manager Benson in response to Councilman Ighodaro's inquiry asked for further clarification as to what he was asking. Councilman Ighodaro said he was asking whether the Chamber could assist the City with its Business Development Program, which is what it was designed to do. He said after reviewing the agenda item the goal is to promote the City's Business Development activities. He opined this is consistent with what the Chamber is supposed to be doing. October 12, 2016 City Council Minutes Page 7 Manager Benson explained this grant if successful will allow the City to do some economic development. Mayor Gilbert further clarified that the answer is generally "no", but the Chamber will be able to piggyback on some of the programs. QUASI-JUDICIAL ZONING HEARINGS: Nakeischae Smith, Planning and Zoning Director appeared before the City Council to explain the process for this Quasi -Judicial Proceeding. (SPONSORED BY THE CITY MANAGER) (1St Reading — July 27, 2016) (Deferred from September 13, 2016) Attorney Dickens explained that an amendment is being offered to restrict the development to a Senior Center, Senior Housing or uses that already exist there. Mayor Gilbert opened the floor for this public hearing. October 12, 2016 City Council Minutes Page 8 Sandra McDowell, 18240 NW 41" Place, Miami Gardens, Florida, appeared before the City Council to inquire about the age group for the senior housing. She asked about an impact study. She questioned whether this is the right thing to do for the seniors. She suggested revitalizing some of the dilapidated properties in the City of Miami Gardens instead. Mary A. Williams, 1871 NW 39th Court, Miami Gardens, Florida, appeared before the City Council representing the senior citizens of Miami Gardens. She recounted the history of the City acquiring this property from the Archdiocese of Miami and what the intent was at that time. She said the seniors supports senior housing but not on this property. She asked the Council members to vote "no" on the rezoning of this property. Abraham J. Thomas, 17320 NW 17th Avenue, Miami Gardens, Florida, appeared before the City Council in support of the senior housing complex on this property. He shared all his children are grown and he no longer wants to cut the grass or maintain his house. He stated that he would love to live in a complex like this; where he can interact with people in his same age group. Robert W. Holland, 3250 NE First Avenue, Suite 334, Miami, Florida, appeared before the City Council representing Urban League of Greater Miami. He stated this rezoning would provide an opportunity for the City to create an Oasis for the seniors. The senior housing facility would pay for the maintenance of the entire area. The city owns the land therefore it can determine who the residents will be. He reemphasized the city controls this property therefore it can place restrictions deemed necessary. There being no other interested parties to speak on this item, public hearing closed. Motion offered by Councilwoman Davis, seconded by Councilman Harris to adopt this ordinance. Motion offered by Mayor Gilbert, seconded by Councilmen Harris and Ighodaro to accept the amendment as outlined by the City Attorney. Councilwoman Odom questioned the difference between "Senior Family Center", which was the old language and the new language "Community Family Center". She explained in 2009, the language use was "Senior Family Center". Mayor Gilbert in response to Councilwoman Odom's inquiry said there is no "Senior" Zoning Category, but there is a "Community" category. However, the Zoning Code is very broad. The word "Family" was added by staff so that the City could apply for federal dollars. A senior center will have to go on this property because that is what is in the bond language. He shared if we do not build the senior center there the city defaults on its General Obligation Bond. He shared defaulting on a GOB is one of the most significant financial mistakes a city can make. He reiterated there has to be a senior center or senior family center, totally dedicated to seniors built. Councilwoman Odom indicated her understanding as it relates to the COB hat a senior October 12, 2016 City Council Minutes Page 9 center has to be built, but the City did not have to build a "multi -family housing unit". Mayor Gilbert explained there is no language category in the Zoning Ordinance for senior housing. He shared the City Manager proposed language that would address concerns about other types of housing being able to be built there. He said if the rezoning is approved the only thing that can be built on the property is the senior family center along with the senior housing. Mayor Gilbert for clarification purposes said the Council is voting on an amendment to the ordinance, which would limit the development to senior center and senior housing. Attorney Dickens suggested that a lot of the concerns the Council have can be addressed during the lease process because someone else will be building the senior housing. She reiterated the Council still has the opportunity to put restrictions in place through the lease process. Mayor Gilbert stated he wanted this item passed with a clear understanding of what the Council's limitations and expectations are. He said the question is whether the Council wanted to vote on the City Manager's proposed amendment right now of did Council members want to add other things that they might want to address. Councilman Williams asked what is the rush to do this. Mayor Gilbert in response to Councilman Williams' question said the funding cycle with Miami -Dade County. Councilman Williams asked whether this proposal has to go through the bidding process. Mayor Gilbert in response to Councilman Williams' question said "no." This came to the city as an unsolicited proposal. The City is not selling the property and is not relinquishing control and ownership of the property. Councilman Williams asked whether the City would be leasing the property. Mayor Gilbert in response to Councilman Williams' question said yes, this would be a long term lease. Councilwoman Davis asked about the maintenance of the property. Mayor Gilbert in response to Councilwoman Davis' question said the lessee will maintain the property. He said he also wanted to put a condition in the lease that requires the lessee to not only maintain the housing side but for the entire site. He further shared that he's spoken with Ms. Williams about some of the seniors serving on a committee to not only review the design of the senior center but also the senior housing. He stated the senior can have input on how that entire campus functions. October 12, 2016 City Council Minutes Page 10 Councilman Harris asked about the other restrictions needed to be discussed. Mayor Gilbert said he wanted to give preference to Miami Gardens' seniors. He said one of the complaints he received is that seniors not from this community are taking the senior housing in this community. He shared his preference is to transition those seniors that are here into senior housing within the City. He clarified that he wanted that preference in the ordinance as well as the contract. The age restriction would be 55 and over. Councilwoman Odom said she would like to see a study done to determine whether senior housing is warranted. She shared that what she has found from her research is that senior housing in other areas had to change to allow other age groups in because the demand for senior housing was as not there. She suggested more investigation needs to be done to determine if senior housing was needed. She further stated that this item should be brought back with the restrictions included before it is voted on. Councilman Williams asked what happens if this agency defaults. Mayor Gilbert said if the agency defaults the City has reversion rights. All the City would need to do is to bring an entity in to operate the facility. The reversion would be included in the contract. Mayor Gilbert stated that he met with Ms. Williams and the seniors and has heard all of their concerns. He also conveyed appreciation of their attendance tonight. He stated that he supports this item because he knows that he can build a senior center, have it separated; build senior housing; get Miami Gardens' residents into this senior housing and have a way to transition people out of their homes in Miami Gardens to senior housing in Miami Gardens. He emphasized the need for senior housing for our seniors. Councilwoman Odom stated that she was not against having senior housing in the city of Miami Gardens but was completely against having it on that particular property. She stated that she would like the senior center placed on that property. Mayor Gilbert further amended the language in the ordinance to change community center to senior center. The article did not highlight the City of Miami Gardens or its major landmark the Hard Roc Stadium. He passed this article to the City Manager and asked him to find out why the City of Miami Gardens was not included. Councilwoman Davis shared that her friend Tommy Ford passed away today. She asked everyone to keep Mr. Ford's family in their prayers. She further thanked Ms. Pierre for continuing to work with the residents of Miami Gardens. Councilwoman Odom asked everyone to keep Pastor Nettie Davis in their prayers. Councilman Ighodaro acknowledged the presence of Wilbur T. Holloway, School Board Representative. He further thanked those who attend the monthly Uni'tea meetings. He invited residents to attend these very informative meeting. However if a resident cannot attend they can always call in at: 712-432-3900. He invited everyone out to the 3rd Annual Hispanic Heritage event, October 191h, at City Hall from 4-8 PM. Vice Mayor Robinson announced that October is Breast Cancer Awareness month. She shared that a schedule of the events can be found on the City's website. Mayor Gilbert asked everyone to keep Shellie Ransom -Jackson's family in their prayers during her family's time of bereavement. Mayor Gilbert informed Vice Mayor Robinson that her Breast Cancer Awareness kickoff event was great. He encouraged everyone to come out to the scheduled events because we all know someone who has been affected by breast or prostate cancer. Mayor Gilbert further encouraged residents to support Councilwoman Davis' Food and Wine event. Information about this event can be found on the City's website.
