REGULAR CITY COUNCIL MINUTES
NOVEMBER 9, 2016
(A) CALL TO ORDER/ROLL CALL
The City Council for the City of Miami Gardens, Florida, met in regular session,
Wednesday, November 9, 2016, beginning at 7:00 PM, in the City Council Chambers, 18605
NW 27th Avenue, Miami Gardens, Florida.
The following members of the City Council were present: Mayor Oliver Gilbert, Vice
Mayor Erhabor Ighodaro, Councilmembers Lisa C. Davis, Lillie Q. Odom, Rodney Harris,
Felicia Robinson, and David Williams Jr.
Also in attendance were: City Manager Cameron Benson, City Attorney Sonja K.
Dickens, and City Clerk Ronetta Taylor.

D-1) Regular City Council Minutes — October 12, 2016
Motion offered by Councilman Williams, seconded by Councilwoman Davis to approve
the minutes, with the necessary corrections if any.
There being no discussion the motion to adopt passed and carried by a unanimous vote of
the Council members.
(E) ORDER OF BUSINESS (Items to be pulled from Consent Agenda at this time)
Item K-12 was pulled from the Consent Agenda by Councilman Williams.
Mayor Gilbert added under Special Presentation, Item F-1 "The Florida Youth Orchestra.
Mayor Gilbert moved the Quasi -Judicial items to be heard after Special Presentations.
The discussions for those items are reflected under each item in order on the agenda.
The following item was added to the official agenda as Item H-1 "AN ORDINANCE OF
THE CITY COUNCIL OF THE CITY OF MIAMI GARDENS, FLORIDA,
AUTHORIZING THE CITY MANAGER TO EXECUTE THAT CERTAIN
DEVELOPMENT AGREEMENT AND AGREEMENT REGARDING LIENS IN
SUBSTANTIAL FORM AS THOSE AGREEMENTS ATTACHED HERETO AS
EXHIBIT "A" AND "B"; AUTHORIZING THE TRANSFER OF THAT CERTAIN
CITY -OWNED PROPERTY GENERALLY LOCATED AT U.S. 441/STATE ROAD 7

Motion offered by Councilman Williams, seconded by Councilwoman Odom and
Councilman Harris to adopt the Official Agenda with the necessary changes.
This motion passed by a unanimous vote of the Council members present.
(F) SPECIAL PRESENTATIONS (5 minutes each)
F-1) Mayor Oliver Gilbert — The Florida Youth Orchestra
The Council and listening audience were treated to an extraordinary performance by
members of the Florida Youth Orchestra.
(G) PUBLIC COMMENTS
Doris Johnson, 2031 NW 184th Street, Miami Gardens, Florida, appeared before the City
Council to ask when deliberating the Fallen Leaves item to keep what's best for our children's
safety in mind. She emphasized the importance of not losing sight of that.
Shirley Gibson, former Mayor of the City of Miami Gardens, Florida, appeared before
the City Council to get clarification relative to the applicant requesting a deferral. She asked
when the applicant asks for a deferral whether the Council can still have discussion and public
comments prior to the deferral vote.
Mayor Gilbert reminded former Mayor Gibson that questions and answers are not
conducted during public comments. In response to former Mayor Gibson's question, Mayor
Gilbert said he did not know whether the Council has ever done that.
Attorney Dickens for clarification purposes asked if the question is whether the City
Council has the right to deny the deferral.
Former Mayor Gibson clarified that her question was "when the applicant comes before
the Council and the item is on the agenda and they are asking for a deferral can the public give
their comments and the applicant actually presents their case before the Council takes the vote to
defer the item.
Attorney Dickens in response to former Mayor Gibson inquiry said that she could not
recall every doing that. The Council has allowed the applicant to request a deferral, which is the
applicant's right.
Former Mayor Gibson expounded on the concern raised by Ms. Johnson. She said there
are hundreds of children in Miami Gardens that are in the foster care system who walk to school.
She stated the applicant is a business. Businesses have positive and negative impacts on a

community. She said when looking at many of the businesses in this community she found that
they do not list themselves as being located in the City of Miami Gardens; instead they are listed
as North Dade, North Miami or Miami. She asked that the Council take that into consideration
when the Fallen Leaves comes back before Council.
Ledell Jackson, 1241 NW 174th Street, Miami Gardens, Florida, appeared before the City
Council to speak about the deferral of the Fallen Leaves item. He recounted the representative
for this application requested a deferral because they need more time to meet with the residents.
He shared the applicant has already met with the residents; however no flyers or notification of
the October 20th meeting were every distributed in his community. He asked what else is there
to talk about when Fallen Leaves representatives have already met with some members of the
community.
Mayor Gilbert disclosed that he met with Mr. Jackson and his neighbors at his (Jackson)
home.
Mr. Jackson opined it was not fair to those residents who made sacrifices in order to be
here tonight, only to have the item deferred.
Mayor Gilbert shared when he was at Mr. Jackson's home he talked about fairness and
the process. What would really be unfair is if the Council deviated from its procedures in how
this application is handled and gave the applicant grounds to appeal. He said the community can
met with the applicant again. It is their choice.
Mr. Jackson opined meeting with the community should have been done prior to
initiating the process. This applicant has not reached out to the community at all.
Patricia Wright, 1221 NW 179th Street, Miami Gardens, Florida, appeared before the City
Council to speak on the Fallen Leaves item. She said the facility is a drug treatment center. This
is a 170 bed facility that will treat multi -drug addictions and mentally ill patients in a residential
community. The reasons why the community does not want this facility in the neighborhood are:
safety, impact on property values, class of the patients that are being admitted to the facility from
other cities and applicant needs to be proactive by engaging the community first. She asked that
the Council deny this application.
Mayor Gilbert shared this Council adopted the PCD "Planned Corridor Development",
which means this is the Council that decided what would go in that area. When the decision was
made as to what would go in that area, this type of business was not included. When the
applicant submitted the application, staff reviewed and gave a negative recommendation.
Elisa Jones Ferguson, 1350 NW 173rd Terrace, Miami Gardens, Florida, appeared before
the City Council to express concern with the fact that children walk to and from school every day
down NW 12th Avenue to 171St Street. That route is cattycorner to this facility. She shared that
most of the residents along NW 171s' Street are working. She opined that people with drug
addictions or mental illnesses cannot be kept behind walls. They cannot be imprisoned. The
patients have rights. She emphasized there are children walking home at the same time those

patients would be outside.

Manager Benson recounted staff has been in negotiations over this past year to sell this
piece of property to Urban Holdings who in turn will lease this property to TopGolf USA Miami
Gardens LLC. TopGolf will develop an entertainment facility in the City of Miami Gardens.
This also allows the city to receive future revenues, as well as diminishes the City's debt over a
period of time. The initial investment on this property is approximately between 20-30 Million
dollars. It is anticipated that this development will create 250 new construction jobs, as well as
permanent jobs.
Mayor Gilbert shared during the discussions a job fair for Miami Gardens' residents was
talked about.
Motion offered by Mayor Gilbert, seconded by Councilman Harris to adopt this item on
first reading.
At the conclusion of this discussion, the motion to adopt on first reading passed and
carried by a 6-1 vote.

RESOLUTION NO. 2016-190-3089

EXECUTE AN AGREEMENT WITH CREATIVE OUTDOOR
ADVERTISING OF AMERICA, INC. FOR BUS
BENCHES/SHELTERS AND TRASH RECEPTACLE
ADVERTISING; PROVIDING FOR THE ADOPTION OF

Councilman Williams said that the documentation indicates there will be 350
benches/shelters. He asked what is the current total number of benches/shelters.
Tom Ruiz, Public Works Director appeared before the Council in response to
Councilman Williams' inquiry. He said currently there are approximately 475 benches.
Councilman Williams asked whether 350 more would be added or would 350 of the
current number be converted.
Mr. Ruiz in response to Councilman Williams' inquiry said there will probably be a little
bit of both depending on the assessment.
Mayor Gilbert clarified the City would not be adding 350 to the existing benches.
Councilman Williams also asked about the trash receptacles and whether all of that was
included in the $70,000, revenue the City could receive.
Mr. Ruiz in response to Councilman Williams comment replied, "Yes."
Councilman Williams asked whether this item was an open bid.
Mr. Ruiz in response to Councilman Williams' inquiry replied, "Yes."
Mayor Gilbert said he notice that the glass keep shattering on the bus shelters on NW 27th
Avenue and asked whether any knew what was going on with that.
Mr. Ruiz in response to Mayor Gilbert's inquiry said there have incidents where BB
Guns have been used to shatter the glass. He said what he has noticed no incidents of shattered
glass when advertisement is place on the glass. The advertisement acts as a deterrent.

Graham Penn, 200 South Biscayne Boulevard, Suite 850, Miami, Florida, appeared
before the City Council representing the applicant. He said event though the applicant got a
positive recommendation from staff, they are requesting a deferral to the December 14th City
Council meeting. He further shared that the applicant has been working with the Andover Civic
Association and Coconut Cay Association. The applicant received notice today that the
Coconut Cay Association had some concerns, which have not been discussed as of yet. The
deferral of this item would provide the applicant with the opportunity to meet with all concerned
prior to the next City Council meeting. To date there has been several meetings, which resulted
in several modifications being made.
Motion offered by Councilwoman Robinson, seconded by Councilman Harris to defer
this item to the December 14, 2016, City Council meeting.
There being no discussion, the motion to defer passed and carried by a unanimous vote of
the City Council.

MIAMI GARDENS, FLORIDA APPROVING THE SPECIAL
EXCEPTION APPLICATION SUBMITTED BY FALLEN LEAVES
RECOVERY, LLC., TO ALLOW A TREATMENT FACILITY IN
THE PLANNED CORRIDOR DEVELOPMENT DISTRICT (PCD)
FOR THE PROPERTY LOCATED AT 16805 N.W. 12TH AVENUE;
PROVIDING FOR THE ADOPTION OF REPRESENTATIONS;
PROVIDING FOR AN EFFECTIVE DATE. (SPONSORED BY THE
CITY MANAGER)
Albert Dotson, 1450 Brickell Avenue, Suite 2300, Miami Gardens, Florida, appeared
before the City Council representing the applicant. He stated the applicant would like an
opportunity to continue its conversation with the surrounding communities therefore he was
asking for a deferral to the December 14th City Council meeting.
Motion offered by Mayor Gilbert, seconded by Councilman Harris and Councilwoman
Robinson to defer this item to the December 14, 2016, City Council meeting.
There being no discussion, the motion to defer passed and carried by a unanimous vote of
the City Council.
Mayor Gilbert explained as a matter of procedure the Council generally allows an
applicant to defer their item at least once. He said both items have been deferred and encouraged
all interested parties to attend the December 14th City Council meeting.

(Q) REPORTS OF MAYOR AND COUNCIL MEMBERS
Councilman Williams thanked the community and his Council members for supporting
him during the Run -Off Election.
Councilwoman Davis congratulated Councilman Williams on his recent re-election win.
She further thanked the Mayor and Council for their support of the 2"d Wine and Food event.
The event is scheduled for Saturday, November 12, 2016, from 7:00 PM — 12 Midnight. She
wished everyone a Happy and Healthy Thanksgiving.
Councilwoman thanked the Parks and Recreation Department for their support of the
Medicare Workshop held earlier today.
Councilman Harris congratulated Councilman Williams on his recent re-election win. He
shared this past Saturday, the second annual walk to cure cancer was held. Over the past two
years more than $12,000, has been raised. The American Cancer Society was presented with a
$4000.00, check. Last year a check was presented to St. Jude Hospital for more than $7,500.00.

On Tuesday, November 22nd the third annual community Thanksgiving dinner will be held at
Love Fellowship Church, 2245 West Bunche Park Drive, from 6:00 — 8:00 PM.
Councilwoman Robinson thanked everyone that support the Paint the City Pink campaign
during the month of October. Furthermore Living Well Miami Gardens has been conducting
healthy cooking classes. A new class with begin November 19th. Each free class has six
sessions. She further congratulated Councilman Williams on his recent re-election win. She
further wished everyone a happy holiday.
Vice Mayor Ighodaro congratulated Councilman Williams on his recent re-election win.
Mayor Gilbert congratulated Councilman Williams on his recent re-election win. He
thanked those that came out in support of the relief efforts for the hurricane victims in Haiti. He
said the item approved tonight authorizing a partnership with Florida Youth Orchestra is an
important one. It shows the city's continuing efforts to expand offerings to our kids. Our kids
don't have as many opportunities as kids in other communities. It is incumbent upon the Council
to change that.
Mayor Gilbert shared that the Council has taken steps to finalize the TopGolf agreement.
This is a big deal. In fact every other city in South Florida wanted the first TopGolf facility. It is
not about golf. It is about restaurants and gathering places. It is an entertainment facility.
Besides giving Miami Gardens' resident an opportunity for jobs it also provides an opportunity
for other people to come to Miami Gardens.
Mayor Gilbert shared that the Janie Garvin CPR class was taken to Sharpe Towers where
the residents there were taught CRP. The class is being taken to the senior centers. The CPR
class is also being offered to groups. He emphasized we have to have the ability to save a life.
Mayor Gilbert commented that every elected official on the dais is a resident of Miami
Gardens and loves the City. The Council understands the concerns of the residents and will
always do things that are positive for the City and would never put something in place that was
bad for the community. This is not in regard to any one particular item, but for every item.
