The following members of the City Council were present: Mayor Oliver Gilbert, Vice Mayor Erhabor Ighodaro and Council members: Lillie Q. Odom Lisa C. Davis, Rodney Harris and Felicia Robinson. Councilman David Williams Jr was not present. Also in attendance were: City Manager Cameron D. Benson, City Attorney Sonja K. Dickens and City Clerk Ronetta Taylor. (B) INVOCATION Delivered by Mayor Gilbert (C) PLEDGE OF ALLEGIANCE Recited in unison (D) APPROVAL OF MINUTES D-1) Regular City Council Minutes —June 28, 2017 Motion offered by Vice Mayor Ighodaro, seconded by Councilman Harris to adopt the minutes, with the necessary corrections if any. There being no discussion the motion to adopt the minutes passed and carried by a unanimous vote of the Council members present. (E) ORDER OF BUSINESS (Items to be pulled from Consent Agenda at this time) Mayor Gilbert requested that the following item be added to the Official Agenda as Item K-9 "A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF MIAMI GARDENS, FLORIDA, RATIFYING THE "DECLARATION OF A LOCAL EMERGENCY" IMPOSED BY THE MAYOR ON SEPTEMBER 5, 2017, DUE TO HURRICANE IRMA; PROVIDING FOR THE ADOPTION OF REPRESENTATIONS; PROVIDING FOR AN EFFECTIVE DATE" Vice Mayor Ighodaro withdrew Item Resolution L-1 from the Official Agenda. Motion offered by Vice Mayor Ighodaro, seconded by Councilwomen Davis to adopt the Official Agenda with the necessary changes. There being no discussion the motion to adopt the official agenda passed and carried by a unanimous vote of the members present. September 12, 2017, City Council Minutes Page 1 (F) SPECIAL PRESENTATIONS (5 minutes each) There were no special presentations. (G) PUBLIC COMMENTS (2 minutes each) Alexander Coleman, 3740 NW 1791' Street, Miami Gardens, Florida, appeared before City Council to express concern regarding FPL and the T -Mobile cellular tower being installed in his neighborhood. Mayor Gilbert directed Mr. Coleman to speak with the City's Building Official Osvaldo Diaz who was present. After there were no other interested parties to speak during public comments. Public comments were closed. (H) ORDINANCE(S) FOR FIRST READING/PUBLIC HEARING(S): H-1) AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF MIAMI GARDENS, FLORIDA, AUTHORIZING THE CITY MANAGER TO EXECUTE THAT LEASE AGREEMENT WITH NEW URBAN DEVELOPMENT, LLC, IN SUBSTANTIAL FORM AS THAT AGREEMENT ATTACHED HERETO AS EXHIBIT "A" AND TO LEASE THE PROPERTY DESCRIBED IN THE LEASE; PROVIDING FOR INSTRUCTIONS TO THE CITY MANAGER AND CITY ATTORNEY; PROVIDING FOR ADOPTION OF REPRESENTATIONS; REPEALING ALL ORDINANCES IN CONFLICT; PROVIDING A SEVERABILITY CLAUSE; PROVIDING AN EFFECTIVE DATE. (SPONSORED BY THE CITY MANAGER) Manager Cameron explained the lease terms with New Urban Development agreement for the leasing of the Senior Center development site. The terms include a fifty (50) year initial lease term, a nominal rent, an opportunity to reap additional revenue and all (interior/exterior) maintenance of the senior housing would be the responsibility of New Urban Development LLC. Motion offered by Vice Mayor Ighodaro, seconded by Councilwoman Davis, to adopt this item on first reading. -1 vote. There being no discussion, the motion to adopt the Consent Agenda passed and carried by a unanimous vote of the City Council members present. (L) RESOLUTIONS) Vice Mayor Ighodaro requested for a waiver of the fees for the use of the facility as RJT is an organization that has been assisting the victims for many years in our community. Mayor Gilbert expressed concern with Items L-1 through L-5, on tonight's agenda. Every Council Members gets a certain number of allotted rentals that they to use for their events or they use for community events. He said he'd like to see in the request is whether the Council member making the request has used their allotted rentals; and whether it is a building that is not normally staffed during that time. If this is the case the City will incur cost. He said he wanted to know whether all allotted days have been used before bringing this matter before Council. The City gives those allotted rentals to Council Members to help the community and in all honesty, those allotted rentals days have a financial cost to the city. Mayor Gilbert stated he was not against any of these requests. He opined we have to be more prudent because this is going to open the flood gate so that everyone who wants to do anything at any of our facilities will come to request a waiver. Once we get into issuing waivers, the city will have to determine which organization should receive the waiver; and the city will be funding by proxy these meetings/events. That is not fiscally sustainable. He told Vice Mayor Ighodaro that this is not just about his events; it is about everyone's events. When the Manager and his people look at these, and the Parks Department goes through their one-year budget in nine months because they are working overtime because Council is doing stuff like this. He September 12, 2017, City Council Minutes Page 6 emphasized the importance of having a conversation as to whether you use your days or not, and then incorporate how we do this. Perhaps incorporating an annual plan where everyone comes with a list of people/organizations and we pass it at once; therefore, we know we can factor it in at budget time. However there has to be something more than just having these people/organizations come to us and we give them a day; just schedule the overtime and it's all good, we can't keep doing it that way. Councilman Harris stated that he was under the impression that Council was already doing that with having a certain amount of allotted rentals. However, at one of the meetings, Council said that each event sponsored by Council would have to be budgeted out and that is why it is on the agenda. Mayor Gilbert in response to Councilman Harris said that was a misunderstanding. Each event that you want to sponsor past the number of allotted rentals should be brought to Council. What is happening is that people would give away their number of allotted rentals and then a request would have to come before the Council. So let's say you have five allotted rentals, and you use five days and its July and you want to sponsor a very well deserving not -for profit community group during the month of August before the new fiscal year when you get your allotted rentals. Generally speaking, if you have not used your allotted rentals, no you don't have to come to Council to ask because that is why we set aside the allotted rentals days to help the community groups without having to come to Council. That is why we did that." Councilman Harris expressed the importance of clarifying this policy because he didn't understand it that way. He conveyed his understanding was that the Council members are to bring everything back before the Council if we were going to have events at city Parks or Betty T Ferguson. Mayor Gilbert in response to Councilman Harris stated, "No that is not correct." He asked for clarification if they have not used all of their allotted rentals, they can just ask for their allotted rentals; Correct? That does not have to come to Council." Manager Benson responded: "That is Correct. Councilwomen Davis shared this was her understanding and if you used your allotted days, you have used your allotted days. Mayor Gilbert asked whether everyone has everyone who is requesting a park waiver used all their allotted rentals?" Vice Mayor Ighodaro responded "no." Councilman Harris responded "no." Councilwomen Robinson stated she got a different understanding from staff. Mayor Gilbert said he would like to see when doing requests like this that the cover September 12, 2017, City Council Minutes Page 7 memorandum include additional language saying whether the person requesting it has used their allotted rentals. If they haven't, and it really speaks to fiscal impact because we factor in those allotted rentals days, and we say Council members you can use those days. If a Council member has not used their allotted rentals, then there is no fiscal impact, but if they have used their allotted rentals days, then there is a fiscal impact. I think that is information we need to know before we vote on it. Manager Benson said "I just want to make sure to clarify, we have to make sure that even in those allotted days, if there is an impact on staff cost, overtime cost, that has to come forward." Mayor Gilbert in response to Manager Benson comment conveyed his disagreement and said let me be clear as to why; when we say the Council members can have the allotted rental days that they can use for community groups or one of their events in the community. So that would be the allotment for RJT, we make the allowance. We say every Councilmember can have six allotted rentals we were not saying you can have six allotted days and those six days we expect the building to be completely empty and no employees to be there. At some point somebody had to consider the fact that when you gave them those six days of rentals, there was going to have to be people to staff it. If there is extraordinary event like the like the three-day conference, you cannot use your days to take the entire center. No that is an extraordinary event and that has to come to Council. But if it's a room to do something or an award ceremony for a school or stuff like that, we factor in when we give those days. Mayor Gilbert opined I don't think any of us thought that when they said you have six days that you just had the room but nothing else. No, you give them six days to help the community but once they go past the sixth day there is a fiscal impact. I am not necessarily willing to say oh yeah we should eat that. Because if we start, there are too many organizations doing far too many good things in this community. We are going to see not -for profit get real nasty because essentially you are going to start have to choose one or the other because we cannot afford to do it for all of them. We really cannot afford to do it for all of them." Councilwoman Odom stated this is sort of late, however, speaking on the same order, we have an agency that one of our council people is donating to. That agency has already received CDBG dollars from the Council. In that same order, we'll have different agencies come back to each Council person for additional dollars. We have an agency that overall city has allocated funds to this agency and then we have a Councilmember who is coming back, I am actually talking about Item K-1. This agency has been given donated dollars. I thought this item was pulled but Item L-1 was pulled instead. Mayor Gilbert in response to Councilwoman Odom's comment said that item has already been adopted. He opined we cannot stop agencies from continuing to ask Councilmembers for assistance. The Council members give them that money to use at their discretion. They can use it within their discretion. I am not going to get into that. What I will say is this, I say no to a lot of people. because I get ask probably more than you do and I just don't have the capacity to actually give to everybody; but this room thing, if we start going past the six and waiving fees, it is going to cost us so much more and this won't be a 2020 problem. September 12, 2017, City Council Minutes Page 8 Mayor Gilbert stated I will be off the dais when you all start to realize how much of a problem this created but I am telling you it's going to be a problem. If you are going to go past six rentals and you are going to do it for free, you need to have a really good reason. He said the cover memorandum should include this. He stated that he needs to know in these waivers, whether the Council member has used their free days already because then if they haven't used their free days, they can use their free days. Councilman Harris requested item L-4 and L-5 be removed from the agenda since he has not exhausted his six (6) allotted rental days. Mayor Gilbert accepted the request to withdraw L-4 and L-5 and asked Vice Mayor Ighodaro if he has used his allotted rentals days. Vice Mayor Ighodaro responded "no, the understanding I got from our conversation was what you just explained. If you have used your six allotted days you have to bring the item before Council, but my staff has told me that everything now has to come before Council and that is why this is here. I have not used the allotted days" Mayor Gilbert stated "let me provide a clarity, it is not six days at each park. It is six uses that you do not have to come to Council for. I cannot speak as to what your staff advised you, but that is not correct. That is not fundamentally not correct as it would defeat the system of assigning the days. Councilwomen Odom asked has the resolution that was originally done for usage been changed from four allotted rental days to the six allotted rental days. Councilwomen Robison responded stating the allotment was for six days. Mayor Gilbert responded stating it was six and that he is not trying to be difficult. Vice Mayor Ighodaro requested item L-1 and L-3 be removed from the agenda since he has not exhausted his six (6) allotted days. Councilwomen Davis explained "I have been using my allotted rentals days for seven years and I have never ever had a problem. Seven year I have been using the ones that are allotted and it shouldn't be a problem with us using the days, I just don't understand". Mayor Gilbert stated "that is why I was really flummox by the number of fee waivers on the agenda right now. In the future, in the agenda review, when these items come, include a line about whether they have used their allotted rental days. Include the line just so we know." Councilwomen Odom asked "so we have withdrawn L2-L5? Is that what we are saying?" Mayor Gilbert confirmed that all the L -items have been withdrawn and moved on to reports as there were no other discussion items. (P) REPORTS OF CITY MANAGER/CITY ATTORNEY/CITY CLERK September 12, 2017, City Council Minutes Page 10 City Manager Benson thanked Assistant City Manager Vernita Nelson, Public Works Director Tom Ruiz, Police Chief Delma Noel -Pratt and all staff involved in preparation and restoration of City functions after hurricane Irma. (Q) REPORTS OF MAYOR AND COUNCIL MEMBERS Vice Mayor Ighodaro thanked Chief Delma Noel -Pratt, Public Works Director Tom Ruiz for taking care of the City during hurricane Irma. Councilwoman Robinson welcomed resident's public comments and announced Meet Me Mondays are held every second Monday at Carol City Park. Councilwoman Odom thanked the entire Council and Police Chief Delma Noel -Pratt for their support during her brother's passing. Mayor Gilbert introduced Lobbyist Yolanda Cash Jackson from Becker & Poliakoff and allowed her to speak to residents. Lobbyist Yolanda Cash Jackson thanked Miami Gardens State Representatives. She encouraged residents to be very aggressive towards infrastructure. Mayor Gilbert commented on hurricane Irma preparations and drainage issues on private properties. He encouraged the community to participate in the preparation and restoration of the City by helping each other.
