A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
MIAMI GARDENS. FLORIDA, AUTHORIZING THE CITY
MANAGER AND CITY ATTORNEY TO ACCEPT A DEED OF
DEDICATION FROM CONTINENTAL EQUITIES, INC.,
RELATING TO "THE ARCH OF INDUSTRY" LOCATED ON
NORTHWEST 167™ STREET AND NORTHWEST 13TH
AVENUE: PROVIDING FOR DIRECTIONS TO THE CITY
ATTORNEY AND CITY MANAGER; PROVIDING FOR THE
ADOPTION OF REPRESENTATIONS; PROVIDING FOR AN
EFFECTIVE DATE.
WHEREAS, Mayor Gilbert has been approached by Continental Equities, Inc.,
the owner of the "Arch of Industry" (Arch) located at the intersection of Northwest 167th
Street and Northwest 13th Avenue to transfer ownership of the Arch to the City, and
WHEREAS, the Arch is an important landmark in the City, and is in fact a part of
the City's logo, and
WHEREAS, Mayor Gilbert is proposing, that the City Manager and City Attorney
review the viability of accepting ownership of the Arch and if the Arch is structurally
sound and if there are no encumbrance issues related to the Arch, that the City accept a
deed of dedication for the Arch, and
WHEREAS, once the City takes ownership of the Arch, the City will have all
rights to the Arch as well as the land immediately surrounding the foot of the Arch, and
WHEREAS, Continental Equities has agreed to transfer rights to the Arch to the
City for a nominal fee of ten ($10) dollars, but would like to retain the right to use the
Arch for its advertising and logos,
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF MIAMI GARDENS, FLORIDA AS FOLLOWS:
Section 1: ADOPTION OF REPRESENTATIONS: The foregoing Whereas
paragraphs are hereby ratified and confirmed as being true, and the same are hereby
made a specific part of this Resolution.
Section 2: DIRECTIONS TO THE CITY MANAGER AND CITY ATTORNEY:
The City Manager and the City Attorney are directed to determine the structural
soundless of the structure and any encumbrance issues related to the property; and
upon proper review, the City Manager and the City Attorney are to accept a Deed of
Dedication relating to "The Arch of Industry" located on Northwest 167"^ Street and
Northwest 13th Avenue.
Section 4: EFFECTIVE DATE: This Resolution shall take effect immediately
upon its final passage.
PASSED AND ADOPTED BY THE CITY COUNCIL OF THE CITY OF MIAMI
GARDENS AT ITS REGULAR MEETING HELD ON OCTOBER 11, 2017.
