A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
MIAMI GARDENS. FLORIDA, REJECTING ALL PROPOSALS
RECEIVED IN RESPONSE TO INVITATION TO BID NUMBER 16-
17-048 WESTSIDE BLUEWAY TRAIL; AUTHORIZING THE CITY
MANAGER TO RE-SOLICIT THE BID FOR THE CONSTRUCTION
OF THE BLUEWAY TRAIL; PROVIDING FOR INSTRUCTIONS TO
THE CITY CLERK; PROVIDING FOR THE ADOPTION OF
REPRESENTATIONS; PROVIDING FOR AN EFFECTIVE DATE.
WHEREAS, on October 5, 2017, Invitation to Bid (ITB) No. 16-17-048 Westside
Blueway Trail was solicited via BidSync, and
WHEREAS, the City of Miami Gardens - Public Works Department requested
sealed bids from Florida Department of Transportation (FDOT) Pre-qualified general
contractor(s) for Local Agency Program (LAP) site preparation, earthwork, construction
of pedestrian asphalt pathway, lighting, outdoor exercise equipment, sign installation
and pavement markings per construction drawings within City of Miami Gardens,
Florida, and
WHEREAS, the ITB closed on November 15, 2017, and Bids from Metro
Express, Inc.; E.H. Paschen, S.N. Nielsen, LLC.; Acosta Tractors, Inc.; and General
Asphalt Co., Inc. were received and publicly read, and
WHEREAS, the lowest bidder Metro Express, Inc., failed to submit mandatory
documents and was deemed non-responsive to the requirements in the ITB, and
WHEREAS, the second lowest bidder; E.H. Paschen, S.N. Nielsen, LLC.
exceeded the independent cost estimate to a significant degree, and
WHEREAS, the third lowest bidder, Acosta Tractors, Inc., exceeded the
independent cost estimate to a significant degree, and

WHEREAS, the fourth lowest bidder, General Asphalt Co., exceeded the
independent cost estimate to a significant degree, and
WHEREAS, in accordance with Section 2-752(4) of the Code of Ordinances of
the City of Miami Gardens, the City Council may instruct the City Manager to reject all
bids and re-advertise for bids, and
WHEREAS, City Staff recommends the City Council authorize the City Manager
to reject all bids in response to Invitation to Bid No. 16-17-048 Westside Blueway Trail,
and resolicit a bid for the construction of the Blueway Trial,
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF MIAMI GARDENS, FLORIDA AS FOLLOWS;
Section 1: ADOPTION OF REPRESENTATIONS: The foregoing Whereas
paragraphs are hereby ratified and confirmed as being true, and the same are hereby
made a specific part of this Resolution.
Section 2: REJECTION OF BIDS: The City Council of the City of Miami
Gardens hereby rejects all proposals received in response to Invitation to Bid No. 16-
17-048 Westside Blueway Trail, and authorizes the City Manager to resolicit a bid for
the construction of the Blueway Trial.
Section 3: INSTRUCTIONS TO THE CITY CLERK: The City Clerk is hereby
directed to record the Second Amendment to Declaration of Restrictions upon
execution.
Section 3: EFFECTIVE DATE: This Resolution shall take effect immediately
upon its final passage.

Staff Summary:
BACKGROUND
The City of Miami Gardens – Public Works Department requested sealed bids from Florida Department
of Transportation (FDOT) Pre-qualified general contractor(s) for Local Agency Program (LAP) site
preparation, earthwork, construction of pedestrian asphalt pathway, lighting, outdoor exercise
equipment, sign installation and pavement markings per construction drawings within City of Miami
Gardens, Florida. This is a Florida Department of Transportation (FDOT), Federal Project, Federal
Standards apply.

This project is federally assisted and bidders must comply with the Davis Bacon Act of 1968, as
amended; and all other applicable federal, state and local ordinance. Submittals are required to be in
compliance with the solicitation requirements.
CURRENT SITUATION
On October 5, 2017, Invitation to Bid (ITB) No. 16-17-048 Westside Blueway Trail was solicited via
BidSync. The ITB closed on November 15, 2017. Bids from Metro Express, Inc., E.H. Paschen, S.N.
Nielsen, LLC Acosta Tractors, Inc. and General Asphalt Co., Inc. were received and publicly read on
November 15, 2017.
The low bidder Metro Express, Inc., failed to submit mandatory documents and deemed non-responsive
to the requirements in the Invitation to Bid.
The second lowest bidder; E.H. Paschen, S.N. Nielsen exceeded the Independent cost estimate to a
significant degree. The third lowest bidder; LLC Acosta Tractors, Inc., exceeded the Independent cost
estimate to a significant degree. The fourth lowest bidder; General Asphalt Co., exceeded the
Independent cost estimate to a significant degree. It is recommended that all bids be rejected and
resolicitation for Westside Blueway Trail project in bidsync.
Proposed Action:
The City Council approves the attached resolution authorizing the City Manager to reject all bids and to
resolicit bid for the Westside Blueway Trail project.
