A RESOLUTION OF THE CITY OF MIAMI GARDENS FLORIDA,
RATIFYING AND ACCEPTING RESOLUTIONS PASSED BY
MIAMI-DADE COUNTY APPROVING THE EXECUTION OF AN
INTERLOCAL AGREEMENT FOR THE TRANSFER OF CONTROL
FROM MIAMI-DADE COUNTY TO THE CITY OF MIAMI GARDENS
OF THE LAKES OF TUSCANY PHASE ONE STREET LIGHTING
SPECIAL TAXING DISTRICT LOCATED ENTIRELY WITHIN THE
CITY; AUTHORIZING THE CITY MANAGER TO DO ALL THINGS
NECESSARY TO EFFECTUATE THE INTENT OF THIS
RESOLUTION, PROVIDING FOR INSTRUCTIONS TO THE CITY
CLERK; PROVIDING FOR THE ADOPTION OF
REPRESENTATIONS; PROVIDING FOR AN EFFECTIVE DATE.
WHEREAS, Miami-Dade County ("County") approved the creation of the ("Special
Taxing District") in County Ordinance No. 02-179, and
WHEREAS, the Special Taxing District is located entirely within the City of Miami
Gardens ("City"), and Section 18-3.1 of the Code of Miami-Dade County provides that for
a special taxing district located entirely within municipal boundaries, the County may
designate the governing body of the municipality as the governing body of the special
taxing district, subject to a majority vote of the qualified electors residing in the district;
and
WHEREAS, the City Council, by Resolution No. 2018-01-3314, requested the
transfer of control of the Special Taxing District from Miami-Dade County to the City of
Miami Gardens (Exhibit "A"), and approved the execution of an interlocal agreement to
transfer control of the Special Taxing District from the County to the City, and
WHEREAS, the next step in the process to transfer control of the Special Taxing
District from the County to the City is the County's approval of the interlocal agreement
regarding the transfer of control and the calling of a special election in the Special Taxing
District; and
WHEREAS, on May 7, 2019, the County passed and adopted Resolution No.
R-475-19, which approved the interlocal agreement and the transfer of control of the
Special Taxing District, subject to the City adopting this Resolution (Exhibit "B"); and
WHEREAS, in addition, on May 7, 2019, the County adopted Resolution No.
R-476-19, which called a special election for the Special Taxing District and in December
2019, the electors within the Special Taxing District approved the transfer of the Special
taxing District from the County to the City (Exhibit "C"); and
WHEREAS, the City Council finds it to be in the best interest of the City to approve
this Resolution and to ratify and accept the aforementioned County Resolutions,
NOW, THEREFORE, BE IT DULY RESOLVED BY THE MAYOR AND CITY
COUNCIL OF THE CITY OF MIAMI GARDENS AS FOLLOWS:
SECTION 1.ADOPTION OF REPRESENTATIONS: The foregoing Whereas
paragraphs are hereby ratified and confirmed as being true, and the same are hereby made
a specific part of this Resolution.
SECTION 2: APPROVAL: The Mayor and City Council of the City of Miami
Gardens hereby approves this Resolution and a) ratifies and accepts County Resolution
No. R-475-19 approving the transfer of control of the Special Taxing District and the
interlocal agreement, and b) ratifies and accepts County Resolution No. R-476-19 calling
for a special election in the Special Taxing District to seek approval or disapproval from
the qualified electors residing in the Special Taxing District of a resolution designating the
City as the governing body of the Special Taxing District pursuant to Section 18-3.1 of the
Code of Miami-Dade County,

SECTION 3: DIRECTIONS: The Mayor and City Council hereby authorize and
direct the City Manager to do all things necessary to effectuate the intent of this
Resolution, and direct the City Clerk to transmit a copy of this Resolution to the Miami-
Dade County Clerk of the Board of County Commissioners.
SECTION 4: EFFECTIVE DATE: This Resolution shall take effect immediately
upon its final passage.

GARDENS AT ITS REGULAR MEETING HELD ON JULY 10, 2019.
