AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF MIAMI
GARDENS, FLORIDA, AMENDING CHAPTER 2 - ADMINISTRATION,
ARTICLE III. - BOARDS, COMMITTEES, COMMISSIONS, OF THE
CODE OF ORDINANCES BY CREATING A HISTORIC ADVISORY
COMMITTEE (HAC); PROVIDING FOR THE ADOPTION OF
REPRESENTATIONS; REPEALING ALL ORDINANCES IN CONFLICT;
PROVIDING FOR A SEVERABILITY CLAUSE; PROVIDING FOR AN
EFFECTIVE DATE.
WHEREAS, Historic Preservation preserves cultural heritage and historic
resources for future generations, and
WHEREAS, HAC will assist with the preservation of City of Miami Gardens ("City")
historical documents, landmarks, architectural and archaeological sites and provide
recommendations to the City Council concerning the designation, preservation and
protection of the City's history, and
WHEREAS, Councilwoman Lillie Q. Odom recommends that the City Council
approves this Ordinance and creates HAC,
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY
OF MIAMI GARDENS, FLORIDA, AS FOLLOWS:
Section 1 . ADOPTION OF REPRESENTATIONS: The foregoing Whereas
paragraphs are hereby ratified and confirmed as being true, and the same are hereby made
a specific part of this Ordinance.
Section 2. AMENDMENT: CHAPTER 2 - ADMINISTRATION, ARTICLE III. -
BOARDS, COMMITTEES, COMMISSIONS
DIVISION 12. - HISTORIC ADVISORY COMMITTEE
Sec. 2-367 - Created; composition.
There is hereby created a historic advisory committee. The historic advisory committee
shall consist of seven (7) members.

Sec. 2-368. - Appointment
The mayor and each city council member shall have the right to appoint one (1) member
to the committee.
Sec. 2-369 - Terms of office.
The terms of all committee members shall commence upon appointment, and shall
coincide with the term of the mayor or city council member making the appointment.
Sec. 2-370. - Duties and powers.
The powers and duties of the historic advisory committee shall include, but not be limited
to, the following duties functions powers and responsibilities:
(1) Assist with the preservation of historical records, areas, and archeological
sites;
(2) Recommend historical designations of records, individual landmarks and
landmark site;
(3) Recommend an annual budget and plan for historical preservation;
(4) Create a quarterly report to be presented to the City Council;
(5) Create an annual historic advisory committee event;
Sec. 2-174. - Meetings.
Members of the committee shall meet no less than four times per year.
Sec. 2-175. - Applicability.
All provisions of Division 1 of this article not in conflict herewith shall apply to the historic
advisory committee.
Section 3. CONFLICT: All ordinances or Code provisions in conflict herewith
are hereby repealed.
Section 4. SEVERABILITY: If any section, subsection, sentence, clause,
phrase or portion of this Ordinance is for any reason held invalid or unconstitutional by
any court of competent jurisdiction, such portion shall be deemed a separate, distinct and
independent provision and such holding shall not affect the validity of the remaining
portions of this Ordinance.

Section 5. INCLUSION IN CODE: It is the intention of the City Council of the
City of Miami Gardens that the provisions of this Ordinance shall become and be made a
part of the Code of Ordinances of the City of Miami Gardens and that the section of this
Ordinance may be renumbered or relettered and the word "Ordinance" may be changed
to "Chapter," "Section," "Article" or such other appropriate word or phrase, the use of
which shall accomplish the intentions herein expressed.
Section 6. EFFECTIVE DATE: This Ordinance shall become effective
immediately upon its final passage.
PASSED ON FIRST READING ON THE 26TH DAY OF JUNE, 2019.
PASSED AND ADOPTED on second reading this 24TH day of JULY, 2019.
