A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
MIAMI GARDENS, FLORIDA, APPROVING THE APPLICATION
SUBMITTED BY EDWARD MARTOS FOR CDX DEVELOPERS, LLC
FOR AN INCREASE IN THE MAXIMUM BUILDING SQUARE FROM
49,981 SQUARE FEET TO 193,673 SQUARE FEET FOR
PROPERTY LOCATED AT NW 35TH AVENUE & NW 168TH
STREET, MIAMI GARDENS, FLORIDA; PROVIDING FOR THE
ADOPTION OF REPRESENTATIONS; PROVIDING FOR AN
EFFECTIVE DATE.
WHEREAS, Development of the Palmetto Palms Business Park began in 1988
and continued through various phases of development over the years, and
WHEREAS, the Business Park is zoned for 1-2, Heavy Industrial and consists
mainly of light industrial warehouses located on the north side of NW 168th Street
between NW 33rd Avenue and NW 35th Avenue as shown on Exhibit "A" of the
attachments, and
WHEREAS, the subject parcel Folio Number 34-2109-021-0010 is the last
remaining vacant lot in the Business Park with approximately 2.3 acres, and
WHEREAS, a site plan was approved in 2017 for the construction of a light
industrial warehouse development with six (6) bays totaling 49,910 square feet, and
WHEREAS, the applicant, Edward Martos on behalf of CDX Developers, LLC,
wishes to amend the site plan in order to construct a multi-story self-storage facility with
a ground floor restaurant, and
WHEREAS, the design would require an increase in the maximum allowable
square footage from 49,981 square feet to 193,673 square feet, and
WHEREAS, as this figure exceeds the threshold for an administrative variance,
approval by the City Council is required, and
WHEREAS, all other development standards are intended to be met and the
structure will otherwise be consistent with the current code, and
WHEREAS, the City's Planning and Zoning staff has reviewed the Application,
the Staff Report is attached hereto as Exhibit "B",
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF MIAMI GARDENS, FLORIDA AS FOLLOWS:
Section 1: ADOPTION OF REPRESENTATIONS: The foregoing Whereas
paragraphs are hereby ratified and confirmed as being true, and the same are hereby
made a specific part of this Resolution.
Section 2: AUTHORIZATION: The City Council of the City of Miami Gardens
hereby approves the application submitted by Edward Martos for CDX Developers, LLC, for
an increase in the maximum building square footage for property located at NW 35th
Avenue & NW 168th Street from 49,981 square feet to 193,673 square feet.
Section 3: EFFECTIVE DATE: This Resolution shall take effect immediately
upon its final passage.

GARDENS AT ITS REGULAR MEETING HELD ON MAY 22, 2019.
