A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF MIAMI GARDENS, FLORIDA, PROVIDING
CONTINUATION HEALTH INSURANCE BENEFITS
FOR ELIGIBLE CITY COUNCIL MEMBERS UNDER
THE CITY'S PLAN; ESTABLISHING ELIGIBILITY
CRITERIA; PROVIDING FOR INSTRUCTIONS TO
THE CITY MANAGER; AUTHORIZING THE
EXPENDITURE OF BUDGETED FUNDS; AND
PROVIDING FOR AN EFFECTIVE DATE.
WHEREAS, Section 112.0801, Florida Statutes, authorizes municipalities
that provide health insurance for its officers and employees and their dependents
to offer retirees and their eligible dependents the option of continuing to
participate in the municipality's group health insurance plan; and
WHEREAS, Section 112.08, Florida Statutes, authorizes municipalities in
Florida to provide and pay out of its available funds all or part of the contributions
for health insurance for municipal officers and employees and eligible
dependents; and
WHEREAS, the City maintains a group health plan for both its active and
retired employees and their eligible dependents; and
WHEREAS, the City currently provides its elected officials with health
insurance for themselves and their eligible dependents at no cost to the elected
officials;
WHEREAS, the City desires to extend group health insurance coverage to
its retired council members and their eligible until the councilmember at no cost
becomes Medicare-eligible; and
WHEREAS, the City also desires to establish eligibility criteria for former
City council members to receive City-subsidized health care coverage following
retirement; and
WHEREAS, the City has determined that it is in its best interests to provide
City council members who serve at least two (2) consecutive terms in office, with
fully subsidized continuation health coverage for themselves and their eligible
dependents until the retired councilmember becomes Medicare-eligible.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF MIAMI GARDENS, FLORIDA AS FOLLOWS:
Section 1: ADOPTION OF REPRESENTATIONS: The foregoing Whereas
paragraphs are hereby ratified and confirmed as being true, and the same are
hereby made a specific part of this Resolution.
Section 2: AUTHORIZATION TO PAY FOR THE COST OF
CONTINUATION HEALTH INSURANCE FOR CITY COUNCIL MEMBERS: The
City shall pay for the full cost of continuation health insurance benefits for retired
City council members and their eligible dependents until the councilmember
becomes Medicare eligible. Each eligible councilmember, in his/her sole
discretion, will determine whether to continue to participate in the City's group
health insurance plan upon leaving office.
Section 3: ELIGIBILITY CRITERIA: To the extent coverage is
available, City council members who have served at least two (2) consecutive
terms in office with the City shall be offered continuation health coverage for
themselves and their eligible dependents at the City's expense. This criteria shall
apply to all council members in office at the time of the passage of this resolution
and thereafter.
Section 4: AUTHORIZATION OF CITY OFFICIALS; IMPLEMENTATION:
The City Mayor and Manager are authorized to take all action necessary to
implement this Resolution and provide continuation health insurance coverage to
former council members under these terms and conditions, and to forward all
necessary documents as may be required to implement continuation coverage
and execute any required agreements or documents.
Section 5: AUTHORIZATION FOR FUND EXPENDITURE: The City
Mayor and Manager are authorized to expend budgeted funds to implement the
terms and conditions of this Resolution.
Section 6: EFFECTIVE DATE: This Resolution shall take effect
immediately upon its final passage.

MIAMI GARDENS AT ITS REGULAR MEETING HELD ON OCTOBER 29, 2018.
