The following members of the City Council were present: Vice Mayor Erhabor Ighodaro and Council members: Lillie Q. Odom, Lisa C. Davis, Rodney Harris, Felicia Robinson and David Williams Jr. Mayor Oliver Gilbert III arrived at 7:01 P.M. Also in attendance were: City Manager Cameron D. Benson, City Attorney Sonja K. Dickens and City Clerk Ronetta Taylor. (B) INVOCATION Delivered by Mayor Gilbert (C) PLEDGE OF ALLEGIANCE Recited in unison (D) APPROVAL OF MINUTES D-1) Regular City Council Minutes—July 12, 2017 Motion offered by Councilman Williams, seconded by Councilwoman Davis to adopt the minutes, with the necessary corrections if any. There being no discussion the motion to adopt the minutes passed and carried by a unanimous vote of the Council members present. (E) ORDER OF BUSINESS (Items to be pulled from Consent Agenda at this time) Councilman Harris requested to have the following added on the official agenda as Item K-9 " A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF MIAMI GARDENS, FLORIDA, ALLOCATING THE SUM OF ONE THOUSAND, FIVE HUNDRED DOLLARS ($1,500.00) FROM COUNCILMAN HARRIS' SPECIAL EVENT ACCOUNT, FOR THE PURPOSE OF SUPPLYING BOOKBAGS AND SCHOOL SUPPLIES FOR THE MOUNT HERMON BACK TO SCHOOL COMMUNITY HEALTH EXPO; PROVIDING FOR THE ADOPTION OF REPRESENTATIONS; PROVIDING FOR AN EFFECTIVE DATE." Councilman Williams requested to defer F-1 under Special Presentations. City Attorney Dickens requested to defer P-1 under City Manager/City Attorney/City Clerk Report, more particularly that item relating to the Special Magistrate's Recommendations July 26, 2017, City Council Minutes Page 1 in the Sunbeam Case. Motion offered by Vice Mayor Ighodaro, seconded by Councilwoman Odom and Councilman Harris to adopt the Official Agenda with the necessary changes. There being no discussion the motion to adopt the official agenda passed and carried by a unanimous vote of the members present. (F) SPECIAL PRESENTATIONS (5 minutes each) F-1) Councilwoman Lillie Q. Odom—Special Presentation Councilwoman Odom recognized and commended residents Mr. and Mrs. Alton Jackson for their seventieth(70) wedding anniversary. Mayor Gilbert acknowledged Mr. and Mrs. Alton Jackson and commended the couple for their commitment. (G) PUBLIC COMMENTS (2 minutes each) David Cruz, of 9170 NW 20th Place, Sunrise, Florida, appeared before City Council to express concern with the City's Red-light Cameras. He explained he's received a couple of violations in the past and attended a hearing. Mr. Cruz expressed concern on behalf of the residents of Miami Gardens, and stated that the type of residents living in Miami Gardens, who live from paycheck to paycheck, and have no job at all would have a hard time with Red-light camera violations payments. Mayor Gilbert responded by explaining the residents of Miami Gardens are working class citizens and he will not tolerate any desperate comments about residents. Linda Hodges Holloway, 748 NW 200 Street, Miami Gardens, Florida, appeared before City Council to acknowledge the impact Councilwomen Lisa C. Davis has made in the community through the many events she has sponsored. Mrs. Holloway commemorated the positive impact the Food and Wine Festival has on the community. There being no other interested parties to speak during public comments. Public comments were closed. (I) ORDINANCE(S) FOR FIRST READING/PUBLIC HEARING(S): None (I) ORDINANCE(S) FOR SECOND READING/PUBLIC HEARING(S) ORDINANCE NO.2017-09-373 I-1) AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF MIAMI GARDENS, FLORIDA, EXTENDING THE EXISTING MORATORIUM ON THE SUBMISSION, PROCESSING AND ISSUANCE OF DEVELOPMENT PERMITS, CERTIFICATES OF USE, BUSINESS TAX RECEIPTS AND ALL OTHER July 26, 2017, City Council Minutes Page 2 APPLICATIONS AND PERMITS FOR THE OPERATION OF MEDICAL MARIJUANA DISPENSING FACILITIES AND MEDICAL MARIJUANA DISPENSING ORGANIZATIONS FOR AN ADDITIONAL 180-DAY PERIOD; PROVIDING FOR EXCEPTIONS; PROVIDING FOR A STUDY AND DIRECTIONS TO THE CITY MANAGER; PROVIDING FOR PENALTIES; PROVIDING FOR ADOPTION OF REPRESENTATIONS; REPEALING ALL ORDINANCES IN CONFLICT; PROVIDING A SEVERABILITY CLAUSE; PROVIDING FOR INCLUSION IN CODE; PROVIDING AN EFFECTIVE DATE. After there were no interested parties to speak on this item,the public hearing closed. Motion offered by Councilmen Harris, seconded by Councilwomen Odom and Davis,to adopt this item. Attorney Dickens explained there will be a workshop in October to discuss this matter. Councilwoman Odom questioned what would happen if we don't have what we need in place during that time period. Mayor Gilbert in response to Councilwoman Odom's inquiry stated the timeframe can be extended if needed. Attorney Dickens explained the deadline can be extended, however, there should be no need for an extension. She said after the workshop in October, she will have a clear understanding and draft the final ordinance prior to the January deadline. Councilman Williams referenced the spelling of his surname and asked that it be corrected to include the"s"at the end. At the conclusion of this discussion,the motion to adopt passed and carried by a 7-0 vote. (L) RESOLUTION(S) RESOLUTION 2017-130-3235 L-1) A RESOLUTION OF THE CITY OF MIAMI GARDENS, FLORIDA, ADOPTING A PROPOSED MILLAGE RATE TO BE LEVIED FOR FISCAL YEAR 2017-18 FOR OPERATING PURPOSES; ESTABLISHING THE DEBT SERVICE MILLAGE RATE APPROVED BY THE ELECTORATE IN APRIL 2014; SETTING THE DATE, TIME AND PLACE OF PUBLIC HEARINGS TO CONSIDER THE PROPOSED MILLAGE RATE, July 26, 2017, City Council Minutes Page 6 DEBT SERVICE MILLAGE RATE AND TENTATIVE BUDGET; PROVIDING FOR DIRECTIONS TO THE CITY MANAGER; AND PROVIDING FOR AN EFFECTIVE DATE. (SPONSORED BY THE CITY MANAGER) Manager Benson explained the recommended mileage rate is 6.9363, which has been the same for the last three(3)years. Motion offered by Councilman Williams, seconded by Councilman Harris to adopt the item. RESOLUTION 2017-131-3236 L-2) A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF MIAMI GARDENS, FLORIDA, CREATING THE EXCELLENCE IN EDUCATION TEMPORARY AD HOC ADVISORY COMMITTEE; PROVIDING FOR A SUNSET DATE; PROVIDING FOR THE ADOPTION OF REPRESENTATIONS; PROVIDING FOR AN EFFECTIVE DATE. (SPONSORED BY COUNCILMAN DAVID WILLIAMS JR.) Councilman Williams shared that he had an extensive discussion with the School Board representative regarding the Education in Excellence Compact. As an outgrowth of that discussion, he is recommending the creation of an Ad Hoc Advisory Committee. This Committee's responsibility would include reviewing and making recommendations to the Council as it relates to the Excellence in Education Compact. The composition of this Ad Hoc Advisory Committee provides for each Council member to appoint a representative. In addition to evaluating and providing recommendations, the Committee would also establish goals and objectives for the Educational Compact. Motion offered by Vice Mayor Ighodaro, seconded by Councilwoman Odom to adopt the item. Councilwoman Davis asked if there is a timeframe set for the committee to provide recommendations. Attorney Dickens in response to Councilwoman Davis' inquiry stated the item provides for the Committee to respond as soon as possible or within a year, whichever comes first. Councilwoman Robinson requested clarification for the membership criteria of the Committee as she believes the City has a lot of inactive committees. She shared the Educational Compact has not been successful, and did not understand how adding additional members would change the current outcome. July 26, 2017, City Council Minutes Page 7 Attorney Dickens in response to Councilwoman Robinson's comment stated the item is requesting a separate committee not adding members to the existing Educational Compact. This Ad Hoc Advisory Committee will provide recommendations on how to enhance the Compact. Councilwoman Odom for clarification purposed stated the Committee is a temporary item that would assist in making the determination about the Educational Compact. Mayor Gilbert stated he supports the item and is looking forward to the recommendations from the Committee. He said the current inactive standing of the Educational Compact speaks for itself. He conveyed hope that the members of the Ad Hoc committee will provide insight on how to get the Compact more involved with the Schools in Miami Gardens. In addition, he explained that it is difficult for school principals to get involved as they already have a full schedule. Councilwoman Davis asked if the School Board would be involved. Councilman Williams in response to Councilwoman Davis' inquiry said the Compact an agreement with the Miami Dade Public School Board. Councilwoman Robinson stated that as a long-time educator she wishes to see the Educational Compact be a success, however, she sees the lack of consistency with the members and hopes that consistency improves. There being no discussion, the motion to adopt the item passed and carried by a unanimous vote of the City Council members present. QUASI-JUDICIAL ZONING HEARINGS/JENNINGS DISCLOSURE: Nakeischea Smith, Planning Director appeared before the City Council to outline the Quasi-Judicial Process. Ronetta Taylor, City Clerk administered the Oath to those participating in this Quasi- Judicial Process. (M) ORDINANCES ON FOR FIRST READING/PUBLIC HEARING(S): None (1) ORDINANCES ON FOR SECOND READING/PUBLIC HEARING(S) None (0) RESOLUTION(S)/PUBLIC HEARING(S) July 26, 2017, City Council Minutes _ Page 8 RESOLUTION NO.2017-132-3237 0-1) A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF MIAMI GARDENS, FLORIDA AMENDING RESOLUTION NO. 4- ZAB-149-91 CONSENTING TO THE MODIFICATION OF THE HOURS OF OPERATION FOR A CHILD LEARNING CENTER AND AFTER SCHOOL CARE CENTER LOCATED AT 18215 NORTHWEST 18TH AVENUE, MIAMI GARDENS, FLORIDA; PROVIDING FOR THE ADOPTION OF REPRESENTATIONS; PROVIDING FOR AN EFFECTIVE DATE. (SPONSORED BY THE CITY MANAGER) Mayor Gilbert opened the floor for this public hearing. After there were no interested parties to speak on this item,the public hearing closed. Nakeischea Smith, City of Miami Gardens Planning Director appeared before the City Council and explained the facility is requesting to reduce the hours during the week and add Saturday hours. The current hours of operations are 6:OOAM-6:OOPM Monday-Friday and the change would be 9:OOAM-6:30PM Monday—Friday and 12:OOPM—6:30PM on Saturdays. Motion offered by Councilwoman Robinson, seconded by Councilwoman Davis to adopt this item. There being no further discussion,the motion to adopt passed and carried by a unanimous voice vote of the City Council. (P) REPORTS OF CITY MANAGER/CITY ATTORNEY/CITY CLERK City Manager Benson thanked the Procurement Director Lindell Miller for her two (2) year tenure and congratulated her on the move to Georgia to pursuit her Law degree. P-1) City Attorney's Report—Special Magistrate's Recommendation in the Sunbeam Case The above referenced item was deferred to the September 27, 2017, City Council Meeting. P-2) MGPD Monthly Report—June 2017 (Q) REPORTS OF MAYOR AND COUNCIL MEMBERS Vice Mayor Ighodaro announced the International Music Festival is scheduled for Saturday, August 5, 2017. He thanked staff and Noelle Barnes for all the hard work towards the festival. He also thanked Barbara Jordan for her generous donations towards the festival. He gave away two (2) VIP festival tickets to the first attendee in the audience to arrive at tonight's meeting. July 26, 2017, City Council Minutes Page 9 Councilwoman Robinson announced the community events related to Live Healthy Miami Gardens with kick off on August 5h at Rolling Oaks Park from 11:OOAM—3:00 PM. Councilman Harris announced the Community Safe Summit Walk and Celebration on Saturday July 29, 2017, at Saint Phillip Catholic Church. Councilwoman Odom did not have anything to report. Councilwoman Davis thanked Darlene and Jackie for attending the Council Meeting and learning about the City of Miami Gardens. In addition, Councilwoman Davis thanked and conveyed appreciation to staff including City Manager Benson, Assistant City Manager Clay, Finance Director Patricia Varney, City Attorney Sonja Dickens, and City Clerk Taylor among others for doing an excellent job. She also reminded the audience about the upcoming Food and Wine Festival. Councilwoman Davis congratulated Mayor Gilbert on the announcement of his engagement. Councilman Williams thanked City Manager Benson for allowing Lindell Miller to participate with Science in the Gardens and her expertise will be missed. He explained that parents are elated about the partnership with Florida International University Doctorial Students and the City's Parks and Recreation Department for the summer program. He also announced the 4h Annual Laws of Health scheduled for August 13, 2017, will take place at the Botanical Garden from 1:OOPM-6:OOPM, in which two (2) pink benches will be dedicated for Cancer Awareness. Mayor Gilbert thanked Councilwoman Odom and congratulated the couple for their commitment to seventy (70) year marriage. In addition, Mayor Gilbert encouraged the residents to tell their best stories about the City of Miami Gardens. He challenged the residents to pick a positive story about the great City of Miami Gardens. He explained it is a great honor to serve as the Mayor and reminded everyone the residents are responsible for the public view of the City. He opined when the Media speaks about the City of Miami Gardens, they are speaking about its residents. He shared residents of Miami Gardens include kids in Norwood who won the National Chest Championship, the Fastest Track and Field Runner in his age group in the world, a successful Robotics, Science, and Reading programs; the Food and Wine Festival,the dedication to Seniors and Cultural Diversity.
