REGULAR CITY COUNCIL MINUTES
FEBRUARY 27, 2013
(A) CALL TO ORDER/ROLL CALL
The City Council for the City of Miami Gardens, Florida, met in regular session,
Wednesday, February 27, 2013, beginning at 7:03 p.m., at City Hall, in the City Council
Chambers, 1515uilding 5, Suite 200, Miami Gardens, Florida.
The following members of the City Council were present: Mayor Oliver Gilbert, Vice
Mayor Lisa C. Davis, and Council Members: Lillie Q. Odom, Rodney Harris, Felicia Robinson,
David Williams Jr., and Dr. Erhabor Ighodaro.
Also in attendance were: City Manager Dr. Danny O. Crew, City Attorney Sonja K.
Dickens and City Clerk Ronetta Taylor.
(B) INVOCATION
Councilwoman Odom delivered the Invocation.
(C) PLEDGE OF ALLEGIANCE
Recited in unison.
(D) APPROVAL OF MINUTES
Regular City Council Minutes—February 13, 2013
Motion offered by Councilman Williams, seconded by Vice Mayor Davis to approve
minutes, with necessary corrections, if any.
There being no discussion,this motion passed and carried by a unanimous voice vote.
(E) ORDER OF BUSINESS (Items to be pulled from Consent Agenda at this time)
Item K-14 was pulled from the Consent Agenda by Councilman Ighodaro.
Item K-2 was pulled from the Consent Agenda by Councilwoman Robinson
Motion offered by Vice Mayor Davis, seconded by Councilman Ighodaro to approve the
official agenda with the necessary changes.
There being no further discussion,the motion to adopt passed and carried by a unanimous
vote.

(F) SPECIAL PRESENTATIONS (5 minutes each)
F-1) Mayor Gilbert—Senator Oscar Braynon II,Legislative Session
State Senator Oscar Braynon II, appeared before the City Council to announce that
Tuesday, March 5, 2013, is the start of the State of Florida Legislative Session for 2013. He
informed the Council that he is in receipt of the City of Miami Gardens' Legislative Package,
and has already starting with applicable legislators with regard to the items. He further shared
that his local office located at 606 NW 18P Street, Miami Gardens, Florida is open and staff
will be available to assist, if needed.
F-2) Councilman Ighodaro—Black History Essay Contest Winners
Councilman Ighodaro presented Certificates and cash prizes to the three winners: Calista
Pagan— 1 Sc Place Winner with a $200.00 cash award; Petrus Nicoleau—2"d Place Winner with a
$150.00 cash award; and Tanae' Price — 3`d Place Winner, with a $100.00 cash award.
Councilman Ighodaro acknowledged the Miami Gardens Kiwanis Club for its sponsorship of this
event.
F-3) City Manager Employee Recognition
Manager Crew recognized the following employees with their five (5) year service pin:
Mike Gambino, Flood Plain Coordinator/Administrator with the Public Works Department;
Dane-Ryan Foo, Management District Supervisor with the Parks and Recreation Department.
Deputy Chief Paul Miller appeared before the City Council to present Officer Pedro
Valdez, with the distinguished recognition as Officer of the Month for the month of January
2013, for his heroic efforts in saving the life of an elderly citizen.
Ramona Abrahams appeared before the City Council to present a plaque to Officer
Valdez for his outstanding due diligence is saving the life of one of the Center's participants.
F4) Councilman Ighodaro—Kymberlee C. Smith, Esq. re: Water Safety Month
Councilman Ighodaro stated this event is about saving lives and thanked Attorney Smith
for her involvement.
Attorney Smith appeared before the Council to expound on the water safety initiative
sponsored by Councilman Ighodaro. She emphasized the importance of teaching our youth and
adults about water safety. This will be a joint effort with several entities involved. The event is
going to be educational as well as entertaining and fun for all. Several sponsors have already
committed to being a part of this life saving event.
Attorney Smith thanked City Clerk Ronetta Taylor, and Christopher Williams of the
Parks and Recreation Department for their involvement and support as well.
F-5) City Hall Project Update—Skanska
Skanska's representative appeared before the City Council to provide a report on the
status of the City Hall Project. She indicated that a number of building activities with the City
Hall, Police Department and Council Chambers have been completed. Project highlights of the

month included: Lectured Carol City High School Students about (LEED and Safety);
Contributed to the Scott Lake Elementary School Botanical Garden Revitalization; Partnered
with Carol City High School Executive Pass Partnership Agreement.
F-6) Mayor Gilbert—AKA Emerging Young Leaders(EYL)
Mayor Gilbert acknowledged the presence of the AKA Emerging Young Leaders at
tonight's meeting. This organization is committed to developing the skills and talents of middle
school age girls in the Miami Gardens area to potentially becoming leaders in their communities.
The training consists of Leadership, Education Enrichment, Civic Engagement, and Character
Building.
F-7) Manager Crew—Special Presentation—Bill Lehman/Warren Zinn/Mark
Napolitano
Mr. Lehman recounted in 1995, a group of businessmen formed an organization called
the "Town" Coalition. The organization's Mission Statement "The Coalition is an organization
of businessmen, businesses and civic minded residents united to promote the improvement of the
quality of life and the rejuvenation of the business climate in the Northwest Dade area; to
advance education for the betterment of the economy and to enhance security for all. Former
Mayor Shirley is a part of this organization. The Coalition decided to focus its interest on one
particular project,which is the Optimist Club located by Norland High School.
Mark Napolitano appeared before the Council to further expound on the Coalition and its
community efforts. A check in the amount of $20,674.57 was presented to the City as a
contribution to the North-Dade Optimist Project.
Manager Crew shared the bid for the North-Dade Optimist project will be brought to
Council for approval, at the next meeting. He conveyed appreciation of the extra funds.
(G) PUBLIC COMMENTS
Dannie McMillon, 4420 NW 176th Street, Miami Gardens, Florida, Chair of the City of
Miami Gardens Commission For Women item, on tonight's agenda.
Adam Wolfson, 20837 NW 2nd Avenue, Miami Gardens, Florida, appeared before the
City Council to share information about the Okey-Dokey Grocery. A job fair will be held at the
New Fountain of Life Church, Thursday, March 7, 2013.
Mayor Gilbert asked that a eblast be sent out to inform the residents of this job fair.
Floyd C. Parker, 1851 NW 187th Street, Miami Gardens, Florida, appeared before the
City Council to express concern with the artwork (tattoo-sleeves) being displayed by several
police officers. He suggested while on duty, those officers wear a long sleeve uniform shirt to
cover up the artwork.

Bennie M. Grant, 17740 NW 10 Avenue, Miami Gardens, Florida appeared before the
Council to express concern with the number of vendors along 27th Avenue, on Valentine's Day.
She said when Miami Gardens first incorporated this type of activity was a problem. The city
looked like a swap market. The City of Miami Gardens is trying to project a certain image
especially with the City Hall project, as well as the beautification efforts that have been put in
place. However, where balloons with teddy bears, etc., are popping up all over the place, it
projects a certain image. She said this type of activity is not encouraged or allowed in
surrounding municipalities. She suggested that the City aggressively attack this problem next
year.
Malik A. Mateen, 17031 NW 12th Avenue, Miami Gardens, Florida, appeared before the
City Council to express concern with the FDOT project and the possible closure of the Palmetto
NW 12th Avenue exit. He further asked whether the City can impress upon the Social Security
Administration to erect signage that is visible for those visiting this facility. He shared that
motorist are always knocking on his door because he lives near this facility, asking for
directions.
Mayor Gilbert asked staff to provide Mr. Mateen with the pertinent information regarding
the FDOT project.
(I) ORDINANCE(S) FOR FIRST READING:
H-1) AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF
MIAMI GARDENS, FLORIDA, AMENDING CHAPTER 16 OF
ARTICLE III OF THE CITY'S CODE OF ORDINANCES TO ADD
SECTION 16-65 "MINOR REPAIR OF AUTOMOBILES IN
RESIDENTIAL"; PROVIDING FOR ADOPTION OF
REPRESENTATIONS; REPEALING ALL ORDINANCES IN
CONFLICT; PROVIDING A SEVERABILITY CLAUSE;
PROVIDING FOR INCLUSION IN CODE; PROVIDING AN
EFFECTIVE DATE. (SPONSORED BY THE CITY MANAGER)
Motion offered by Vice Mayor Davis, seconded by Councilman Harris to adopt this item
on first reading.
Shellie Ransom-Jackson, Building Official/Code Compliance Department appeared
before the Council to expound on the ordinance. She said when the city first incorporated this
was one of the ordinances in place by Miami-Dade County. This ordinance provides specific
guidelines for what property owners can do to their personal vehicles on their property
Motion offered by Vice Mayor Davis, seconded by Councilman Harris to adopt this item
on first reading.
Councilwoman Odom asked about the length of time allotted for repairs.

Mrs. Ransom-Jackson in response to Councilwoman Odom's inquiry said the homeowner
would have 24 hours for minor repairs such as tire or oil change or battery change.
Councilwoman Odom asked whether the city would keep track of how many times a
property requested to do minor repairs on their personal vehicle.
Mrs. Ransom-Jackson in response to Councilwoman Odom stated that a permit is not
pulled for this type of activity.
Councilwoman Odom referenced the ordinance, more particular the word "permit" and
questioned whether that word should be"permitting".
Ms. Ransom-Jackson agreed the word should be "permitting".
There being no further the motion to adopt this item on first reading passed and carried
by a 7-0 vote.

DIVISION 1, SECTION 2-85 ENTITLED "BOARDS
COMMITTEES COMMISSIONS," OF THE CITY'S CODE OF
ORDINANCES TO PROVIDE FOR A TERM LIMITATION FOR
MEMBERS OF NONSTATUTORY BOARDS AND COMMITTEES;
PROVIDING FOR ADOPTION OF REPRESENTATIONS;
REPEALING ALL ORDINANCES IN CONFLICT; PROVIDING A
SEVERABILITY CLAUSE; PROVIDING FOR INCLUSION IN
CODE; PROVIDING AN EFFECTIVE DATE. (COUNCILMAN
DAVID WILLIAMS)
Councilman Williams stated that this ordinance is self-explanatory by its definition; as it
relates to the membership of non-statutory boards and committees. This is an opportunity to get
new blood, new ideas.
Motion offered by Councilman Ighodaro, seconded by Vice Mayor Davis to adopt this
item on first reading.

Vice Mayor Davis asked if this process was already in place.
Clerk Taylor in response to Vice Mayor Davis' inquiry replied, "Yes."
Mayor Gilbert clarified that any Council member can remove anyone they appoint, at any
time.
Councilwoman Robinson pointed out the ordinance provides for term limits, just as the
Council has. She shared that it is her understanding that some people have been on committees
since the establishment of that committee.
Vice Mayor Davis asked is it not the new Council member's choice of whether they want
to remove an existing committee member of allow that person to continue serving.
Mayor Gilbert opined the meaning behind this ordinance is well intended, but did not
think it is going to solve the problem. This ordinance would interfere with a council person's
prevue to appoint who they want. If a council person wants somebody new, they can do that
now. He said there are not a lot of people willing to serve on these committees. There also
quorum problems with the existing committees.
Councilwoman Odom said it is her understanding that the committee members already
have term limits.
Attorney Dickens said the committees either have specified term limits or provides that
the term limit coincides with the council person that appoints them.
Councilman Williams said you can conceivably have one person serve on a committee
forever because of the different council person appointing that same individual.
Vice Mayor Davis stated it would be up to that new council person to indicate whether
they wanted to appoint someone new.
Mayor Gilbert commented if there is someone serving on a committee that has been
appointed by another council member and has served; why should he be prohibited from
appointing that individual, especially when he likes that committee member's ideas. This
ordinance would limit a council member's ability to appoint an existing committee member to
the same committee. If a council member wanted to appoint someone new to a committee right
now, there is nothing to prohibit that.
Councilman Harris asked whether the council members are interviewing the existing
committee members to determine whether they want these individual to continue on the
committees. He shared that he started that process once he was elected.
Vice Mayor Davis shared that she has met with existing committee members. She opined
that we need to give other people a chance as well.

matters on the second Wednesday of the month to whenever needed.

Motion offered by Councilman Williams, seconded by Vice Mayor Davis to adopt the
Consent Agenda.

REPRESENTATIONS; PROVIDING FOR AN EFFECTIVE DATE.

Councilwoman Robinson shared she had pulled this item because she wanted to ensure
there would be no cost associated with this event that would be allocated from the General Fund.
Councilman Ighodaro said the only cost associated with this event would be from his
Discretionary Account.
After the discussion, a motion was offered by Vice Mayor Davis, seconded by
Councilwoman Odom to adopt this item.
This motion passed and carried by a unanimous voice vote.
RESOLUTION NO. 2013-69-1865
K-14) A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
MIAMI GARDENS, FLORIDA, APPROVING THE 2013
CALENDAR OF EVENTS FOR THE COMMISSION FOR
WOMEN; APPROVING THE EXPENDITURE OF FUNDS FOR
THIS PURPOSE; PROVIDING FOR THE ADOPTION OF
REPRESENTATIONS; PROVIDING FOR AN EFFECTIVE DATE.

Councilman Ighodaro explained he had pulled this item because he wanted to amend the
activities to include the Sponsorship Breakfast scheduled for March 30, 2013.
Mayor Gilbert stated that he wanted to ensure that this Advisory Committee did not go
over its budgeted amount of$2,500.00, for the activities listed.
Clerk Taylor shared that the "Commission" is also initiating a fundraising campaign to
offset the cost of the activities listed.
Motion offered by Vice Mayor Davis, seconded by Councilwoman Odom to adopt this
item.

(NI) REPORTS OF CITY MANAGER/CITY ATTORNEY/CITY CLERK
M-1) City Manager Monthly Report
M-2) Miami Gardens Police Department Monthly Report
Manager Crew announced that the Citizens Academy will start March 25, 2013. He
invited anyone interested in learning about the city to sign up. Two former graduates are now
sitting council members.
Manager Crew said the recession that is going on in Washington, D.C., will cost the city
of Miami Gardens, a minimum of 1.7 million dollars over the next several years. This year

alone, it will cost the city over $60,000.
Manager Crew announced that March 13, 14 and 15 have been identified as potential
dates for the Strategic Planning Session.
The Council indicated the suggested dates were too close to the Jazz in the Gardens
event,and asked that staff bring back new dates.
Clerk Taylor announced the Office of the City Clerk would be participating in the
National Passport Day event, scheduled for Saturday, March 9, 2013.
(N) REPORTS OF MAYOR AND COUNCIL MEMBERS
Councilman Ighodaro shared that he is partnering with State Senator Oscar Braynon II to
sponsor a Youth Basketball Tournament, Saturday, March 23, 2013. He thanked John Rebar,
Parks and Recreation Director for his assistance. He acknowledged the Miami Gardens Kiwanis
for being a major sponsor of this event.
Councilman Williams shared the city received a grant for a Botanical Fruit Garden at the
Archdiocese Property.
Councilwoman Robinson shared that the Black History Event featuring very talented
local artists.
Councilman Harris thanked his colleagues, staff and residents for making his first Town
Hall meeting a great success.
Vice Mayor Davis shared that she visited the Clover Leaf Senior program earlier during
the day, and only about five people knew this was the city's tenth year anniversary. She
expressed anticipation of getting the message out to the community of the activities planned for
the tenth year anniversary celebration. She asked whether the committees would be incorporating
the 10`x'year anniversary in with their planned activities.
Mayor Gilbert shared that he too attended the Black History Art Expo event, which was
exceptional. He further thanked Councilman Harris for sponsoring the Town Hall meeting. He
shared that he also attended the CAC meeting, which prompted him to consider something that
should probably be discussed at the Strategic Planning Session. He opined the Council should
sunset all of the committees subject to the authorization. He said he is not so worried about the
people who serve on the committees; he is worried about the committees that do not do anything.
He asked the City Clerk to work with every staff liaison because he wanted to know who was
attending the meetings. He said if he has appointed someone who is not attending meetings, he
will remove them. If a committee is not functioning as they should be, that committee needs to
be sunset. He said his expectation is that every committee, in every activity planned that a
component of that incorporates the 10th Anniversary for the City of Miami Gardens.
