HomeMy WebLinkAbout03.13.2013 CITY COUNCIL MINUTES - MARCH 13, 2013 CITY OF MIAMI GARDENS REGULAR CITY COUNCIL MINUTES MARCH 13, 2013 (A) CALL TO ORDER/ROLL CALL The City Council for the City of Miami Gardens, Florida, met in regular session, Wednesday, March 13, 2013, beginning at 7:05 p.m., at City Hall, in the City Council Chambers, 1515 NW 167' Street, Building 5, Suite 200, Miami Gardens, Florida. The following members of the City Council were present: Mayor Oliver Gilbert, Vice Mayor Lisa C. Davis and Council members Lillie Q. Odom, Rodney Harris, and Dr. Erhabor Ighodaro. Councilman David Williams Jr., arrived at 7:06 p.m. Councilwoman Felicia Robinson arrived at 7:10 p.m. (B) INVOCATION Mayor Gilbert delivered the Invocation. (C) PLEDGE OF ALLEGIANCE Recited in unison. (D) APPROVAL OF MINUTES Regular City Council Minutes—February 27, 2013 Motion offered by Vice Mayor Davis, seconded by Councilman Harris to approve the minutes, with the necessary corrections, if any. This motion passed and carried by a unanimous vote of the members present. (E) ORDER OF BUSINESS (Items to be pulled from Consent Agenda at this time) Councilman Ighodaro pulled Item K-09 from the Consent Agenda. Manager Crew added as Item F-3, a presentation from Community Center, Inc. Motion offered by Vice Mayor Davis, seconded by Councilman Ighodaro to approve the Official Agenda, with the changes. This motion passed and carried by a unanimous vote of the members present. (F) SPECIAL PRESENTATIONS (5 minutes each) F-1) City Manager—FY 2011-12 Audit Report Patricia Varney, Finance Director appeared before the City Council to provide a PowerPoint Presentation on the 2011-2012 Audit, a copy of which is attached hereto and made a part of the record thereof, as Exhibit "A". Mick Russell, an associate with the city's current auditing firm was also present. F-2) Vice Mayor Davis—Instruments N A Bottle Initiative(INAB) Jacqueline Carmon, Founder of Instruments N A Bottle Initiative appeared before the Regular City Council Minutes March 13, 2013 Page 1 CITY COUNCIL MINUTES - MARCH 13, 2013 City Council to expound on this initiative, which would provide instruments to assist with the music program in selected Miami Dade County School; Norland Middle School has been selected to participate in the program, which is generated through the proceeds from recycling. The Initiative also encourages community recycling. F-3) City Manager—Carol City Community Center Foundation. Anthony Bronson, a representative from Carol City Community Center Foundation appeared before the city Council to expound on the Foundation's mission to support the Betty T. Ferguson Community Center. Unfortunately Former County Commissioner Betty T. Ferguson is attending a School Board Meeting and cannot be present. Mayor Gilbert shared over 2,000 residents utilize the Betty T. Ferguson Recreation Center, and the pool on a daily basis. The Foundation donated approximately $24,000.00 to be primarily used for the heating system for the pool at the Betty T. Ferguson Recreation Center. The Foundation also sponsored high school students for their SAT Prep exam. He thanked Mr. Bronson and Attorney Thomas and the Foundation for their support. Attorney Thomas Williams present an additional check in the amount of$15,500 for the installation of the Score Board at the Betty T. Ferguson Recreation Center. (G) PUBLIC COMMENTS Dannie McMillon, 4420 NW 176th Terrace, Miami Gardens, Florida, Chair of the Commission For Women Advisory Committee, appeared before the City Council in support of Item K-9. She shared that in 2003 she was able to travel abroad as part of a Student Exchange Program, which she served as a parent representative. Anthony Okonmah, 20613 NW 15th Avenue, Miami Gardens, Florida, appeared before the City Council to expound on the Student Exchange Program. He encouraged the City to support Item K-9. "The future is our children, and we want to show them the world." Amy Coleman, 2841 NW 212th Street, Miami Gardens, Florida, appeared before the City Council to express concern with the zip codes assigned to the city, which in some instances is still identifying this area as Opa-locks. (H) ORDINANCE(S) FOR FIRST READING: None. (I) ORDINANCE(S) FOR SECOND READING/PUBLIC HEARING(S) ORDINANCE NO. 2013-05-293 I-1) AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF MIAMI GARDENS, FLORIDA, AMENDING CHAPTER 16 OF ARTICLE III OF THE CITY'S CODE OF ORDINANCES TO ADD SECTION 16-65 "MINOR REPAIR OF AUTOMOBILES IN RESIDENTIAL"; PROVIDING FOR ADOPTION OF Regular City Council Minutes March 13, 2013 Page 2 CITY COUNCIL MINUTES - MARCH 13, 2013 REPRESENTATIONS; REPEALING ALL ORDINANCES IN CONFLICT; PROVIDING A SEVERABILITY CLAUSE; PROVIDING FOR INCLUSION IN CODE; PROVIDING AN EFFECTIVE DATE. (L) RESOLUTION(S): RESOLUTION NO. 2013-81-1877 K-9) A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF MIAMI GARDENS, FLORIDA, RECOGNIZING THE AFRICAN RITES OF PASSAGE AND STUDENT EXCHANGE PROGRAM, FOR STUDENTS AT MIAMI CAROL CITY HIGH FEEDER SCHOOLS, SPONSORED BY THE FOUNDATION FOR DEMOCRACY IN AFRICA (FDA) AND MIAMI-DADE COUNTY PUBLIC SCHOOLS (M-DCPS); PROVIDING FOR THE ADOPTION OF REPRESENTATIONS; PROVIDING FOR AN EFFECTIVE DATE. (SPONSORED BY COUNCILMAN ERHABORIGHODARO) Councilman Ighodaro explained he had pulled this item because he wanted to get clarification for the record from the City Attorney as whether there is a conflict with his membership on the Board of Directors of this entity. Attorney Dickens said there is no conflict. Motion offered by Councilman Williams, seconded by Councilman Harris to adopt this item. There being no further discussion, the motion to adopt passed and carried by a unanimous voice vote. (M) QUASI-JUDICIAL ZONING HEARINGS: None (N) REPORTS OF CITY MANAGER/CITY ATTORNEY/CITY CLERK City Clerk Taylor reported that the Office of The City Clerk participated in the National Passport Day in the USA, Saturday, March 9, 2013. Seventy-Five (75)passports were executed, with over$2,200.00 in revenue received during that event. Regular City Council Minutes March 13, 2013 Page 6 CITY COUNCIL MINUTES - MARCH 13, 2013 Clerk Taylor also provided the Council with a draft attendance sheet, which will be used for the various city committees. She said she would be providing a report to the Council on attendance quarterly. Mayor Gilbert informed the City Clerk that there is no need to report any of his appointees' absences; she has permission to remove them from the committee, if they miss three consecutive meeting,with unexcused absences. (0) REPORTS OF MAYOR AND COUNCIL MEMBERS Councilman Williams reported that he and Vice Mayor Davis have agreed to host a fund raising event for Norland Middle School Band. He invited other members of the Council to join this endeavor. He further shared that staff is approximately twenty-five (25%) percent finished with the Archdiocese Property Botanical Fruit Gardens. Some of the fruit trees are already bearing fruit (peach tree). He thanked his colleagues for their monetary support to assist with the purchase of walkie-talkies for Carol City Elementary School. Deputy Chief Miller made the presentation, on close circuit television so that all the students could see the event. He said students went home and told their parents how safe their school was. He further thanked Deputy Chef Miller and the police officers who attended this event, as well. Councilwoman Robinson announced that she has re-started her Meet Me On Monday meeting. The first meeting took place, Monday. March 11`h. The meeting is scheduled for the second Monday of every month. This is an opportunity for residents that have concerns to come out and voice them. The meetings are scheduled at Carol City Park. One component of the meeting deals with health because we do want to have a healthy community. Councilman Ighodaro thanked Councilman Williams for allowing him to be a part of the Walkie-Talkie initiative at Carol City Elementary School. He further shared that he had an opportunity to join with Mayor Gilbert during his 5-K Run event. Councilman Ighodaro asked whether there was anything to preclude a council person from having a webpage on the city's website. He shared that he had made this request approximately four months prior. He shared over the last couple of months he saw a couple of emails from Mr. McKenzie, the city's IT Director, whom he thanks for doing an excellent job. He said he has sent several items to be uploaded, but for some reason that has not been followed through. He emphasized that he wanted to do this and did not want to prolong it. He said he'd rather the Council come together as a group, in support. He asked if there is nothing that precludes him from going solo,he wanted to do that. Attorney Dickens asked for clarification purposes if Councilman Ighodaro meant "going solo"meant he wanted to continue with his webpage. Councilman Ighodaro in response to Attorney Dickens' question said "yes, that is correct. Attorney Dickens opined there is nothing to prohibit the creation and uploading to Regular City Council Minutes March 13, 2013 Page 7 CITY COUNCIL MINUTES - MARCH 13, 2013 Councilman Ighodaro's webpage. Mayor Gilbert shared that he has noticed the emails from Mr. McKenzie, which he has not responded to, but eventually will. He said he was against providing links because we do things as politician that might not always be suitable for linkage. He said he did not have any objections to uploading pictures of elected officials at events. He encouraged Councilman Ighodaro,not to wait for other council members to launch. Mr. McKenzie appeared before the Council and explained,the way the webpage is built it is a link that goes from the Mayor and Council members and leads to a particular page for that Council member. The page is written for all members of the Council. Everybody has an equal page that is why staff has been waiting for launching. If each Council member does not launch there will be a message saying"under construction." Mayor Gilbert said he did not have an issue, with this. Councilwoman Robinson asked whether the each council member can provide info continuously. Mr. McKenzie said this can be done; the webpage would be a work in progress. Everything should be provided digital. Vice Mayor Davis acknowledged Ms. Rita Pierre who was present, and shared that she had joined Ms. Pierre at an event for seniors (over 1,800 seniors attended), which took place in West Palm Beach. She said this was a really great event, and encouraged more Council members to participate next year. Mayor Gilbert thanked the Parks and Recreation Department for the March 9th event (5K Run). He encouraged everyone that has not purchased their Jazz in the Gardens tickets to do so. This year's lineup is outstanding.
