CITY OF MIAMI GARDENS
REGULAR CITY COUNCIL MINUTES
NOVEMBER 13, 2013
(A) CALL TO ORDER/ROLL CALL
The City Council for the City of Miami Gardens, Florida, met in regular session,
Wednesday, November 13, 2013, beginning at 7:03 p.m., in the City Council Chambers, 1515
NW 167th Street,Building 5, Suite 200, Miami Gardens, Florida.
The following members of the City Council were present: Mayor Oliver Gilbert, Vice
Mayor Lisa C. Davis, and Council members: Lillie Q. Odom, Rodney Harris, David Williams
Jr., and Erhabor Ighodaro. Councilwoman Felicia Robinson was out of town attending a
National League of Cities Conference. By a unanimous vote of the members present,
Councilwoman Robinson's absence was excused.
Also in attendance were: City Manager Cameron Benson, City Attorney Sonja K.
Dickens and Deputy City Clerk Mario Bataille, sitting in for City Clerk Ronetta Taylor, who was
not present due to illness.

Regular City Council Minutes—October 23,2013
Motion offered by Councilman Ighodaro, seconded by Vice Mayor Davis to approve the
minutes, with necessary corrections, if any. This motion passed and carried by a unanimous
voice vote of the members present.

L-01) A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF MIAMI GARDENS,
FLORIDA, AMENDING RESOLUTION NO. 2103-144-1940 WHICH AUTHORIZED THE
CITY MANAGER AND THE CITY ATTORNEY TO TAKE ANY AND ALL STEPS
NECESSARY TO INITIATE THE PROCESS FOR THE CITY'S ISSUANCE OF A FIFTY
MILLION DOLLAR ($50,000,000.00) IN GENERAL OBLIGATION BONDS TO AMEND
THE COST OF THE BOND IN AN AMOUNT NOT TO EXCEED SIXTY MILLION
DOLLAR ($60,000,000.00) IN ORDER TO PROVIDE FOR CONSTRUCTION/PROJECT
MANAGEMENT COSTS ASSOCIATED WITH THE PARK IMPROVEMENTS, AND TO
PROVIDE FOR COSTS ASSOCIATED WITH CRIME PREVENTION EQUIPMENT FOR
LAW ENFORCEMENT ASSISTANCE VIA ELECTRONIC MEANS; PROVIDING FOR THE
ADOPTION OF REPRESENTATIONS; PROVIDING FOR AN EFFECTIVE DATE.

A substitute Item for Item O-1,was provided to the Council.
Motion offered by Councilman Ighodaro, seconded by Councilman Williams to approve
the Official Agenda with the necessary additions/deletions/amendments. This motion passed and
carried by a unanimous voice vote of the members present.
(F) SPECIAL PRESENTATIONS (5 minutes each)
F-1) Vice Mayor Davis—CAC Advisory Committee
Lonnie Lawrence, Chair of the CAC Advisory Committee appeared before the City
Council to express the Committee's due diligence and commitment that exist about the City and
the crime within the city. He further invited residents and business owners to attend the
Committee's scheduled meeting every third Tuesday of the month at 7:00 p.m., at the Miami
Gardens Police Department.
F 2) Viee Mayor-Davis Diabetes Event
F-3) Councilwoman Lillie Q. Odom—World AIDS Day Proclamation
Councilwoman Odom read a proclamation proclaiming December 3, 2012, as World
AIDS Day Proclamation in the City of Miami Gardens. She further announced that an open
forum entitled "Open the Curtain", will be held Friday, December 6, 2013, starting at 9:00 a.m.,
at St. Thomas University.
F-4) Circular Pilot Program Report
A representative from the Corradino Group appeared before the City Council to report
that options are being presented to the Council on how to proceed with the project.
Mayor Gilbert asked the Manager Benson whether this was a time sensitive item and
whether it had to be heard this evening. He explained he was just handed the report and would
really like an opportunity to go through the document and familiarize himself with it. He
suggested moving this item to the next meeting.
Mr. Corradino explained this is for information purposes only. An item will be presented

at the next meeting for Council to provide direction on how to proceed.
(G) PUBLIC COMMENTS
Reverend Nettie B. Davis, 16400 NW 15th Avenue, Miami Gardens, Florida, appeared
before the City Council to expound on the AIDS Epidemic, which has been in existence for more
than 30 years worldwide. She said in the past thirty (30) years more than 236,000 African
American have died from this disease. Those numbers do not reflect the latest infected. She
stressed the importance of providing this community with the most up-to-date and valuable
information possible. She further called upon the faith based organization in this community for
their support.
Mayor Gilbert asked that an eblast be generated announcing this event.
Sporty Young, 19025 NW 23`d Avenue, Miami Gardens, Florida, appeared before the
City Council representing the Crestview Rolling Oaks Ambassadors and the Crestview Crime
Prevention Group. He said the residents in Crestview are very concerned about the crime in this
area. He stated that citizens are afraid to report crime because the police department asks for the
name of the caller. The police then come straight to the caller's house. The residents feel that by
reporting the crime, they will be put in danger. He asked that the police department establish a
procedure where the caller reporting the crime is not required to provide personal information.
Basil Lloyd Cole, 2350 NW 187' Street, Miami Gardens, Florida, appeared before the
City Council to express concern with the escalating crime in the city. He opined the police are
not patrolling the neighborhoods, and only appear after a crime has been committed. He further
shared that the police department needs to socialize more with the neighbors, in order to build a
relationship.
Dr. Sallie Frazier Holmes, 18515 NW 22nd Place, Miami Gardens, Florida, appeared
before the City Council to express concern with a property next door to her home, which is being
neglected. She opined if the City of Miami Gardens would take a little more effort in making
sure a vacant property is well taken care of the neighboring property owners would be most
appreciative.
Mayor Gilbert informed Dr. Holmes that Ms. Ransom-Jackson would be speaking with
her to get the correct address of the property in question.
Victor W. Moncrieffa, President of Crestview Homeowners Association 1820 NW 186th
Street, Miami Gardens, Florida appeared before the City Council and shared that crime concerns
are always the first items on their agenda. The problem is when a call is made the police
department there is never a call back or a follow up. He suggested that the police department be
more proactive and engage the community by keeping residents abreast of what is going on in
the community.
Mayor Gilbert asked the Chief and Deputy Chief as well as the Chair of the CAC to meet
with this gentleman.

Jennifer Nijhavo, 1731 NW 206 Street, Miami Gardens, Florida, appeared before the City
Council to invite everyone to the Lake Lucerne Neighborhood Watch Christmas event scheduled
for Thursday, December 12, 2013, starting at 7:00 p.m., at the Betty T. Ferguson Recreational
Complex. She acknowledged Vice Mayor Davis for her continued support. This free event is
open to the public. She suggested hosting an event at Sun Life Stadium to bring the community
together to address the crime issues in Miami Gardens.
Fiordalieu Hidalgo, 4955 NW 199th Street, Miami, Florida, speak lady—appeared before
the City Council to express concern with the negative publicity the city has been getting about
the crime in the city. She shared that she has property within the corporate boundaries of the
city and opined more police officers are needed.
Gloria Copeland, 17700 NW 14th Avenue, Miami Gardens, Florida, appeared before the
City Council and shared that her son and grandson were murdered over a year ago. She said she
has never gotten a follow-up or status report on the case. The police said flyers were passed out
but everyone she has spoken with has ever seen a flyer.
John Zeigler, 18501 NW 22"d Court, Miami Gardens, Florida, appeared before the City
Council to express appreciation to Chief Boyd and Deputy Chief Miller for their assistance to the
Citizens Advisory Committee. He said it is up to the residents to assist the police department
when they see crimes occurring.
Mayor Gilbert shared the City is going to do an email blast, as well as provide
information on the website so that residents will know what is being done to address their
concerns. Residents are always welcome to come to City Council meetings to express their
concerns. However, if residents want an immediate response they do not have to wait until the
second and fourth Wednesday of the month. Residents can contact any City Council member
with their concern. He encouraged residents to contact his office.

Attorney Dickens explained this is a house keeping item, as a result of the 2013
Legislative Session.
Mayor Gilbert opened the floor for this public hearing. After there were no interested
parties to speak on this item, the public hearing closed.
Motion offered by Councilman Williams, seconded by Councilwoman Odom to adopt
this item.

OLIVER GILBERT'S APPOINTMENT OF COUNCILMAN
RODNEY HARRIS TO THE CHARTER REVISION
COMMISSION IN ACCORDANCE WITH SECTION 6.2 OF THE
CITY OF MIAMI GARDEN'S CHARTER; PROVIDING FOR THE
ADOPTION OF REPRESENTATIONS; PROVIDING FOR AN

Consent Agenda.

2103-144-1940 WHICH AUTHORIZED THE CITY MANAGER
AND THE CITY ATTORNEY TO TAKE ANY AND ALL STEPS
NECESSARY TO INITIATE THE PROCESS FOR THE CITY'S
ISSUANCE OF A FIFTY MILLION DOLLAR ($50,000,000.00) IN
GENERAL OBLIGATION BONDS TO AMEND THE COST OF
THE BOND IN AN AMOUNT NOT TO EXCEED SIXTY MILLION
DOLLAR ($60,000,000.00) IN ORDER TO PROVIDE FOR
CONSTRUCTION/PROJECT MANAGEMENT COSTS

THE ADOPTION OF REPRESENTATIONS; PROVIDING FOR AN

Mayor Gilbert passed the gavel to Vice Mayor Davis before sharing his rationale for
sponsoring this item, which occurred after discussion with the newly appointed City Manager.
He said he previously sponsored this item for 50 Million, but one of the lessons learned is if the
City plans to build a fifty million dollar project, construction managers have to be hired to
oversee the project; to keep it on time and on budget. The city does the very best it can with
what it has. Secondly, additional money is included for law enforcement to provide for
electronic augmentation of our police presence. Staff has looked at initiatives that work in other
cities such as shot spotters and cameras (not red-light), which would allow the city to be watch.
He said he did not bring this item to Council lightly, and shared while discussing this item with
legal advisors some felt that the city should not be watching; that is it an invasion of privacy and
a violation of their civil rights. He opined that he did not that it was a violation of civil rights or
invasion of privacy because the cameras would be placed on an open street. He stressed the
importance of people wanting to feel safe.

Cyril Saiphoo, Zoning Administrator appeared before the City Council to explain the
process used for this Quasi-Judicial Proceeding.
Deputy City Clerk Bataille administered the Oath to those participating in this Quasi-
Judicial Proceeding.

Mr. Saiphoo said that staff is recommending approval of this item subject to several
conditions. A revised memorandum was provided to the Council, which listed the eleven (11)

conditions staff is recommending approval on: Landscaping. In lieu of providing the required
street trees (royal palms) along NW 2"d Avenue the applicant shall make a contribution of funds
in accordance to Section 34-333(d) of the City's Land Development Regulations. Applicant
shall submit, obtain approval, and make said contribution prior to the issuance of Certificate of
Use and Business Tax Receipt; Vehicles. Pre-owned vehicles more than six (6) years old shall
only be permitted to be stored on site for a period of thirty (3) consecutive days and shall be
stored at the rear of the property. All junk vehicles shall be immediately removed from the site.
Accessory Uses. Only accessory uses customary and incidental to pre-owned vehicles sales shall
be allowed; which shall include, but not be limited to, minor vehicle repairs as defined in the
City's Land Development Regulations.
Mayor Gilbert asked who is responsible for removing the large palm leaves that fall from
the Royal Palm trees.
Mr. Saiphoo in response to Mayor Gilbert's inquiry responded that the City is responsible
for taking care of the maintenance of the trees.
Mayor Gilbert suggested selecting another species of tree for landscaping.
Councilman Harris asked what procedure the city has in place to ensure that the provision
relating to vehicles is complied with.
Mr. Saiphoo in response to Councilman Harris' inquiry said code compliance would
monitor.
Attorney Wayne Pathman with the law firm of Pathman Lewis, LLP, appeared before the
Council on behalf of the applicant to indicate that his client is willing to work with staff to ensure
all conditions are met. He further assured the Council the building will look different than what
is currently at this location.
Attorney Pathman said the applicant will make every attempt to move the vehicles
through the lot as quickly as possible, every thirty (30-45) days. A job fair will also be held in
the City of Miami Gardens.

(P) REPORTS OF MAYOR AND COUNCIL MEMBERS
Councilman Ighodaro thanked everyone for attending the Crime Prevention Meeting held
November 7, 2013. The meeting was in preparation for the S.A.V.I.O.R. March. He further
thanked Councilman Harris for his contribution. City Manager Cameron Benson was also
thanked. He announced that on Thursday, November 14'`, he is hosting a video segment on his
visit to Africa. The public is invited to attend. He also announced that he would be sponsoring a
Foreclosure workshop, Saturday,November 16'' from 11:00 a.m. — 1:30 p.m., here at City Hall.
Councilman Williams announced the grand opening of the science lab at Miami Carol
City Senior High School, Thursday, December 5t' starting at 8:30 a.m. The third annual science
and engineering elementary school fair will be held Monday, December 9`h at St. Thomas
University. The awards ceremony will take place, Tuesday, December 10`x' at the Betty T.
Ferguson Recreation Complex. He stated that he has never been involved with a finer police
department than the City of Miami Gardens.
Councilwoman Odom reiterated the AIDS Awareness Event to take place at St. Thomas
University, Friday, December 6, 2013 at 9:00 a.m. She further wished everyone a Happy
Thanksgiving holiday.
Vice Mayor Davis shared that she had attended the Lake Lucerne Crime Watch meeting,
Tuesday, November 10th. She further acknowledged Ms. Mary McCoy for the outstanding job
she is doing in getting the word out about crime. She further thanked Officer Jessup for
attending the meeting. She also thanked Chief Boyd for ensuring police presence at this
meeting.
Vice Mayor Davis encourage everyone to attend the Diabetes event, which is a free
informative event scheduled for Sunday, November 17th from 4:00 — 7:00 p.m., at the Betty T.
Ferguson Recreation Complex.
Vice Mayor Davis further welcomed Elsa Thompson, Assistant to the Council to the City
of Miami Gardens.
Mayor Gilbert asked the police officers present to stand up. He further explained to the
audience the meaning of the Zero Tolerance Policy and stated, "If they can arrest you, they are
going to." He said he wanted the audience to understand that and to tell their nephews,
grandsons,nieces, granddaughters.
