APRIL 27, 2011
(A) CALL TO ORDER/ROLL CALL
The City Council for the City of Miami Gardens, Florida, met in regular session on
Wednesday, April 27, 2011, beginning at 7:05 p.m., in the City Council Chambers, 1515 NW
167th Street, Building 5, Suite 200, Miami Gardens, Florida.
The following members of the City Council were present: Council members Lisa C.
Davis, Andre Williams, Felicia Robinson and Oliver G. Gilbert III.
Also in attendance were: City Manager Dr. Danny O. Crew, City Attorney Sonja K.
Dickens and City Clerk Ronetta Taylor.
Attorney Dickens announced that the Mayor as well as the Vice Mayor is not in
attendance tonight therefore, as per the City's Code of Ordinances, the Council has to vote in a
Councilmember to chair tonight's meeting.
Motion offered by Councilwoman Davis, seconded by Councilwoman Robinson to
appoint Councilman Gilbert to chair tonight's City Council meeting. This motion passed and
carried by a 4-0 vote.

Motion offered by Councilman Gilbert, seconded by Councilwoman Robinson to excuse
the absence of. Mayor Shirley, Vice Mayor Aaron Campbell Jr., and Councilman David
Williams Jr. This motion passed and carried by a 4-0 voice vote.

Motion offered by Councilwoman Robinson, seconded by Councilwoman Davis to
approve the minutes,with necessary corrections, if any. This motion passed and carried by a 4-0
voice vote.
(E) ORDER OF BUSINESS (Items to be pulled from Consent Agenda at this time)
Councilwoman Davis asked that Item F-1 be heard as the last item under Special
Presentations.
Item K-8 pulled from the Consent Agenda by Councilwoman Davis, this motion was
seconded by Councilman Williams.
Manager Crew added to the official agenda, under Presentations Item F-4.
Motion offered by Councilman Williams, seconded by Councilwoman Davis to approve
the Official Agenda with the necessary amendments. This motion passed and carried by a 4-0
voice vote.
(F) SPECIAL PRESENTATIONS (5 minutes each)
F-2) Dr. Danny O. Crew, City Manager—Employee Recognition (5 year service
pin)
Manager Crew presented 5 Year Service Pins to the following employees: Yvonne
Desaire Jimeson, Recreation Aide; Lisa Carbonell, Permitting & License Clerk; Keyondra
Johneka Bernard, Permitting & Licensing Clerk; Christina Jean Goetzman, Capital Improvement
Project Coordinator.
F-3) Miami Gardens Progressive Young Adults Advisory Committee Report
Peter A, Chair of the Miami Gardens Progressive Young Adult Committee appeared
before the City Council to provide a status report. This report is attached hereto as Exhibit "A",
and made a part of the record.
F-4) Chief Boyd—Police Department Officer of the Month Recognition
Chief Boyd bestowed the honor of Officer of the Month upon Detective Luis Gonzalez,
for April 2011.
F-1) Councilwoman Davis—Mother's Day
Councilwoman Davis along with members of the City Council presented plaques, floral
arrangements, gift card and gift basket to the following winners: Elizabeth Elaine (May) Davis -
Mother of the Year; Jackie Carter—First Place Winner; Trellana Baxter— Second Place Winner;
Carol Brown—Third Place Winner; and Phyllis W. Sloan-Simpkins—Fourth Place Winner.
(G) PUBLIC COMMENTS
James Rolliser, 1510 NW 175 ' Street, Miami Gardens, Florida, appeared before the City

Council and shared that he purchased his property, October 2010. He received a citation with
regard to an illegal shed. He shared that this shed was on the property when prior to his purchase
and asked why was this violation not addressed at that time.
Councilman Gilbert asked Mr. Lawson to discuss this issue with Sharon Ragoonan,
Building and Code Compliance Director.
Councilman Williams shared there is an ordinance on the books that he sponsored, which
requires that the City inspect houses for code enforcement issues prior to purchase. This provides
the potential buyer with notice prior to purchase. That ordinance was enacted prior to 2010, and
would have applied in this situation. He asked what happened and why was this buyer not
alerted.
Sharon Ragoonan, Director of Building and Code Compliance appeared before the City
Council and shared that eh Director of Code Compliance is checking the records to review what
happened with this particular property.
Councilman Williams shared for the audience's benefit that the City has an ordinance in
place that requires a city inspection of any property before it is sold. The idea is to prevent any
instances like this from occurring.
Cecil Maitland, 2778 NW 1960' Street, Miami Gardens, Florida, the property owner,
appeared before the City Council to express concern with an on-going problem with one of the
neighbors in this residential complex. He shared that the police has been called out to this
residence on several occasions. The Homeowners' Association is ill equip to handle this
situation. Apparently the individual causing the problem has some mental illness issues.
Councilman Gilbert asked that Mr. Maitland speak with Deputy Chief Miller about this
matter.
Almarie Carr, 2778 NW 19601 Street, the tenant of Mr. Maitland appeared before the City
Council to further expound on this situation. She shared that she has several police reports
involving incidents with this particular neighbor. This individual plays loud music all through
the night and constantly slams doors throughout the apartment. When the police are called, this
neighbor will not answer the door. She has cameras surrounding the apartment therefore she is
aware when the officer arrives. This individual lives in an apartment owed by her brother, who
has been fined on numerous occasions by the Homeowners Association. Ms Carr further shared
that her vehicle was also set on fire by this individual's boyfriend.
Councilman Gilbert said the City has no jurisdiction over homeowners' associations;
however, if is a noise issue perhaps the police department can intervene.
Councilwoman Robinson said perhaps this is an issue for the Nuisance Abatement Board.
Ms. Carr further shared that there have been instances when she has gone to the bus stop

to pick up her disabled son, this individual is sitting in her vehicle and has pressed the gas pedal,
as if she is attempting to run her over.
Deputy Chief Miller appeared and shared that the police department is well aware of this
situation there are some medical issues involved, which he is not at liberty to speak about.
Councilman Gilbert asked the Deputy City Manager and City Attorney to communicate
with him on tomorrow in an effort to come up with creative ideas to deal with this situation.
Dr. Lester Brown, 18801 NW 29th Court, Miami Gardens, Florida, appeared before the
City Council to commend the citizens and elected officials for their due diligence. He expressed
pleasure in seeing citizens come before Council with issues, and the Council making an effort to
address those issues. He further commended Councilwoman Davis for honoring mothers on this
special occasion. He further expressed hope that Father's Day will not be forgotten.

Councilman Williams asked how would the City enforce this ordinance.
Manager Crew said this ordinance will be enforced through Public Works. If there is a
complaint about a certain tree planted in the City's rights-of-way, Public Works will remove the
tree. The owner of the property where that tree has been planted will be notified.
Attorney Dickens clarified that the City's practice, especially as it relates to Code
Enforcement issues has been to give warning notices.
Councilman Williams asked whether the City will incur a cost.
Manager Crew said the public works department cleans up the rights-of-way as a normal
part of its maintenance program.
Councilman Williams asked what is considered a nuisance.
Manager Crew said any tree that could be dangerous(e.g. cactus, bougainvilleas)

Manager Crew shared this ordinance provides for the registration alarm systems in the
City of Miami Gardens.
Motion offered by Councilwoman Davis, seconded by Councilwoman Robinson to adopt
this ordinance.
Councilman Williams asked the City Manager to further expound on this item.
Manager Crew said basically everybody has to register their alarm system. This provides
that individuals will still get two free false alarms. After that there will be a fine levied on the
third alarm, by the City.
Councilman Williams asked what would happen if the fine is not paid and more fines are
accumulated.
Manager Crew said in that case this matter would be taken before the Special Master, like
any other Code Enforcement matter. Ultimately, if not paid, a lien would be imposed on the
property.
Councilman Gilbert cautioned when establishing whether an alarm is a false alert. He
said just because the police do a quick look around the property and do not see any sign of forced
entry does not mean someone did not try to break in. He said if we are going to write that
violation there needs to be a significant look around the property to be absolutely sure.
Manager Crew said if the property owner came home and discovered something was
taken the false alarm would be taken off their record.

Councilwoman Davis explained she had pulled this item to get further clarification from
the IT Director.
Ronald McKenzie, IT Director appeared before the City Council to expound on this item.
He explained the bulk of the City's police department computer system is a System Network.
This item renews a contract with a particular company. The CEO of this company is a CPIE,
which is an expert. As of February 1, 2010, there are 20,864 of these people world. They are
extremely sought after. This individual and company put the network currently being used in the
police department. Therefore, they know and understand the network. Other agencies charges
over$200.00 an hour in addition to overtime.
Councilwoman Davis asked whether there were anyone in the City of Miami Gardens
that could provide this service.
Mr. McKenzie in response to Councilwoman Davis question said he cannot say there is
anyone in Miami Gardens that cannot do the work. He shared that this is an extremely sought
after expertise. He reiterated there are only 20,864 experts in the world. If there is someone in
the City of Miami Gardens he would assume that individual works for an agency of a higher

Motion offered by Councilman Williams, seconded by Councilman Gilbert to adopt this

There being no further discussion, the motion to adopt this item passed and carried by a

CITY COUNCIL MINUTES - APRIL 27, 2011
Councilman Williams announced a Public Safety Forum would be held at Mt. Zion
A.M.E. Church, Tuesday, May 3, 2011, beginning at 6:00 p.m.
Councilman Gilbert shared that on this past Saturday he held his first annual Easter Egg
Hunt. He thanked Vice Mayor Campbell for co-sponsoring the event. He also thanked
Councilwoman Davis for coming out and Councilwoman Robinson for coordinating the event.
He further shared that he would be sponsoring a Mother's Day luncheon, Tuesday, May 3, 2011,
at the Betty T. Ferguson Recreational Center.
Councilwoman Davis asked whether the Mother's Day Winners could be invited to this
luncheon as well.
Councilman Gilbert in response to Councilwoman Davis' inquiry said they are welcome
to attend.
