The following members of the City Council were present: Mayor Shirley Gibson, Vice Mayor Aaron Campbell Jr., and Council members Andre Williams, Felicia Robinson, David Williams Jr., and Oliver G. Gilbert III. Councilwoman Lisa C. Davis arrived at 7:55 p.m. Also in attendance were: City Manager Dr. Danny O. Crew, City Attorney Sonja K. Dickens and City Clerk Ronetta Taylor. (B) INVOCATION Delivered by Vice Mayor Campbell (C) PLEDGE OF ALLEGIANCE Recited in unison. (D) APPROVAL OF MINUTES Regular City Council Minutes—September 14, 2011 Motion offered by Councilman David Williams Jr., seconded by Councilman Gilbert to approve the minutes, with necessary corrections, if any. There being no discussion, this motion passed and carried by a unanimous vote. (E) ORDER OF BUSINESS (Items to be pulled from Consent Agenda at this time) The following items were added to the official agenda as items H-2 and H-3 respectively. Motion offered by Councilman Gilbert, seconded by Councilman David Williams Jr., to amend the official agenda by adding the above referenced items, as Item H-2 and H-3. This motion passed and carried by unanimous voice vote. Motion offered by Councilman Gilbert, seconded by Councilman David Williams Jr., to approve the official agenda with the necessary additions. (F) SPECIAL PRESENTATIONS (5 minutes each) F-1) Councilwoman Lisa Davis—Proclamation—Bulling Prevention Month Mayor Gibson presented this proclamation to Assistant City Manager Vernita Nelson who accepted it on behalf of Councilwoman Lisa C. Davis. Ms. Nelson provided a brief PowerPoint presentation of the Miami Norland Elementary School Anti-Bullying event held October 18, 2011. F-2) Dr. Danny O. Crew, City Manager—Employee Recognition Captain Alfred Lewers was presented with a five year service pin. Captain Lewers was also presented with the distinguished recognition as Officer of the month for September 2011 for exemplary administrative skills, and saving the city money. Daniel Rosemond was presented with a five year service pin. Officer Booker T. Herring Jr., was presented with the distinguished recognition as Officer of the Month for October 2011 for exemplary police work in apprehending a murder suspect. Councilman Andre Williams commended the police department and its law enforcement officers for doing an excellent job. Deputy Chief Miller indicated the police department would be reaching out to the community newspapers. F-3) Mayor Shirley Gibson—Sofia Lacroix,FIU Medical School Sofia Lacroix and Barbara Howard appeared before the City Council to expound on the FIU Medical School Program and its significance in the City of Miami Gardens. (G) PUBLIC COMMENTS Ruthven Williams, 18425 NW 2"d Avenue, #335, Miami Gardens, Florida, appeared before the City Council as a representative of Miami Broward One Carnival to thank the City of Miami Gardens, its elected officials, staff and residents for their participation and cooperation during this event. Claudia Slater, 1895 NW 7d` Avenue, Miami, Florida, appeared before the City Council to present Mayor Gibson for an award for her outstanding support of Gamma Delta Sigma Chapter Robert McKnight, 5005 North Miami Avenue, Miami, Florida, appeared before the City Council to thank the Council in advance for its support on this passage of the resolution commissioning his artwork. Marie Conyers, 18714 NW 32"d Place, Miami Gardens, Florida, appeared before the City Council in support of the fitness class being held at Miami Carol City Park. She asked that the Council keep this very beneficial program at that park. Kara Petty, Parks and Recreation Director appeared before the City Council and shared the program mentioned by Ms. Conyers is a grant funded program. Staff is working on getting the word out to get more participants. Mayor Gibson shared that it is crowded at the Betty T. Ferguson Recreational Complex therefore, it would be a good idea to encourage others to come out to this site. (H) ORDINANCE(S) FOR FIRST READING: H-1) AN ORDINANCE OF THE CITY OF MIAMI GARDENS, FLORIDA, AMENDING THE CITY'S BUDGET FOR THE 2010- 2011 FISCAL YEAR; AUTHORIZING THE CITY MANAGER TO MAKE CERTAIN ADJUSTMENTS; AUTHORIZING THE CITY MANAGER TO TAKE ALL ACTIONS NECESSARY TO IMPLEMENT THE TERMS AND CONDITIONS OF THIS ORDINANCE; PROVIDING FOR AN EFFECTIVE DATE. It moves the interest payment on the bond issue to the debt service account. Motion offered by Councilman Andre Williams, seconded by Councilwoman Davis to adopt this item on first reading. (SPONSORED BY THE CITY CLERK) Mayor Gibson stated this item, as well as the next item is sponsored by the City Clerk in her official capacity as Supervisor of Elections for the City of Miami Gardens. Attorney Dickens further expounded and stated these are two different proposed Charter amendments. Item H-2 would amend the Charter by taking out the residential boundaries from the Charter and allow the Council to amend those boundaries every decennial census by ordinance. Item H-3 is based upon the actual numbers derived from the Census. There is a disparity between Residential Area Seat 1 and Seat 4. One has 2,500 more, and one has 2,500 less. Staff has proposed a solution to the problem. If Council decides to move forward with Item H-3,it would go to the voters and the voters would decide whether to move the boundaries. Regular City Council Minutes October 26, 2011 Page 4 CITY COUNCIL MINUTES - OCTOBER 26, 2011 Attorney Dickens expounded on reapportionment and the voters right act, which prohibits discrimination of certain racial, ethnic groups as it relates to redistricting. The City's redistricting was already done when Miami Gardens became a city. She said ultimately it is up to the Council if it decides on either proposal. The Clerk has also indicated this election could cost approximately $50,000. We are not certain at this point if there will be a need for a Special Election because Councilman David Williams Jr., has not drawn an opponent as of yet. If Councilman David Williams Jr., does not draw an opponent, there will not be a need for a Special Election. Motion offered by Councilman Gilbert, seconded by Councilman David Williams Jr., to adopt this item on first reading. Councilman Gilbert opined Item H-2 is a good item, which allows the Council to draw the lines as an ordinance rather than by referendum. Generally speaking as it relates to Item H-3, if it is not necessary for the Council to redraw the line right now, he would not redraw them. (I) ORDINANCE(S) FOR SECOND READING/PUBLIC HEARING(S) ORDINANCE NO. 2011-24-266 I-1) AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF MIAMI GARDENS, FLORIDA, AMENDING SECTION 28-125 OF THE CITY'S CODE OF ORDINANCES TO ESTABLISH A PERMIT AMNESTY PROGRAM; PROVIDING FOR THE ADOPTION OF REPRESENTATIONS; REPEALING ALL ORDINANCES IN CONFLICT; PROVIDING A SEVERABILITY CLAUSE; PROVIDING FOR INCLUSION IN CODE; PROVIDING FOR AN EFFECTIVE DATE. (SPONSORED BY THE CITY MANAGER) Mayor Gibson opened the floor for this public hearing. After there were no interested parties to speak on this item, the public hearing closed. Councilman Andre Williams asked the City Manager to expound on this item. Manager Crew explained the City has hundreds of houses in the city that were built without permits. Shellie Ransom the city's Building Official appeared before the City Council to explain this item. She stated this ordinance would allow someone who either built illegally or had a permit and let it expired, gives the Building Official guidelines by which to issue a permit, conduct the inspection and subsequently legalize the structure. The property owner would only have to meet the code requirements that were in place between 1957 and 2004. (L) RESOLUTION(S) None (M) REPORTS OF CITY MANAGERXITY ATTORNEY/CITY CLERK M-1) City Manager's Monthly Report M-2) Miami Gardens Police Department Monthly Report M-3) City Attorney—Scheduling of Executive Session re: CITT Litigation Matter Attorney Dickens announced that an Executive Session was warranted to discuss the litigation case City of Miami Gardens vs. Miami-Dade County, Case No. 11-00822 CA 11. This private-attorney-client meeting hereby in closed chambers in the Mayor and Council Conference Room at City Hall, 1515 NW 167 ' Street, Building 5, Suite 200, Miami Gardens, Florida 33169 to Those in attendance shall be limited to Mayor Shirley Gibson, Vice Mayor Aaron Campbell, Jr., Councilwoman Lisa Davis, Councilman Andre Williams, Councilman David Williams Jr, Councilwoman Felicia Robinson, Councilman Oliver Gilbert III, City Manager Danny O. Crew, City Attorney Sonja K. Dickens, Assistant City Attorney Monica D. Barnes, Outside Counsel Jose Sepulveda and Matt Dates, and a Court Reporter. The subject matter of the meeting shall be confined to settlement negotiations and/or strategy sessions related to litigation expenditures. Attorney Dickens asked that this meeting be scheduled for Wednesday, November 90' at 6:00 p.m. Manager Crew said during the budget time the Council indicated that it may want to secure lobbyist services for special purposes. He said it would be helpful if the Council would give staff some direction on what issues were of concern and whether the Council wanted to go out for bid for lobbying services. Councilman Gilbert said the North Miami Beach water issue is an issue for the City of Miami Gardens. He further opined that gambling is also going to be an issue for the city. Mayor Gibson inquired about the revenues the city receives from Calder. Manager Crew said the direct income last year was a little over one million dollars. Mayor Gibson said the Consumer Tax issue might be something to look at. She said there will probably be thousands of lobbyists lobbying this issue, with varying positions. Regular City Council Minutes October 26, 2011 Page 9 CITY COUNCIL MINUTES - OCTOBER 26,j 2011 Councilman Gilbert shared even Miami-Dade County's position with regard to the stadium is the complete opposite to being advantageous for Miami Gardens. He said the Council members definitely need to be engaged at the County level. Councilman David Williams Jr., suggested a workshop to take a look at the issues. He said there is a lot at stake. Councilman Andre Williams said he did not disagree with this, and could not imagine that Miami Gardens is the only municipality with these concerns. He suggested piggybacking with another municipality for lobbying services. He opined there should be several lobbyist already involved with these issues. Councilman Gilbert said if the city could piggyback on certain issues that would be fine however, there are only a few municipalities with race tracks (Miami, Hialeah and Miami Gardens) therefore, each municipality's issue would not be the same. Miami and Hialeah are much larger cities and what affects them might not necessarily affect us. He said he open to obtaining someone that can uniquely speak for the City of Miami Gardens. By unanimous consent the City Manager was directed to do what is necessary to find and engage a lobbying firm, and bring back a recommendation to the Council. (1) REPORTS OF MAYOR AND COUNCIL MEMBERS Councilman Gilbert opined at some point the City is going to have to resolve the issue with Miami Gardens regarding what their rights are with the DRI. Miami Dade County's position is that the DRI goes on in perpetuity. He said this matter needs to be resolved either through staff or the legal system. Miami Dade County is of the opinion that anything done on that property shall come through them. This would include the zoning as well as building permits. Attorney Dickens opined that Councilman Gilbert has a good legal argument. She suggested when the time is applicable to advise those seeking permits that they must come through the City of Miami Gardens. Councilman David Williams announced the Red Ribbon Campaign would take place this upcoming weekend at the University of Truth Center site.
