REGULAR CITY COUNCIL MINUTES
JUNE 239 2010
(A) CALL TO ORDER/ROLL CALL
The City Council for the City of Miami Gardens, Florida, met in regular session on
Wednesday, June 23, 2010, beginning at 7:10 p.m., in the City Council Chambers, 1515 NW
167'hStreet, Building 5, Suite 200, Miami Gardens, Florida.
The following members of the City Council were present: Mayor Shirley Gibson and
Council members Andre Williams, Melvin L. Bratton, Sharon Pritchett, and Oliver G. Gilbert.
Councilwoman Barbara Watson arrived at 7:52 p.m.
Motion offered by Councilman Bratton, seconded by Councilwoman Pritchett to excuse
Vice Mayor Campbell, who was out of town. This motion passed and carried by a 5-0 voice
vote.
Also in attendance were: City Manager Dr. Danny O. Crew, City Attorney Sonja K.
Dickens and City Clerk Ronetta Taylor.

D-1) Regular City Council Minutes—June 9,2010
Motion offered by Councilwoman Pritchett, seconded by Councilman Bratton to approve
the minutes, with necessary corrections, if any. This motion passed and carried by a 5-0 voice
vote.
(E) ORDER OF BUSINESS (Items to be pulled from Consent Agenda at this time)
Motion offered by Councilwoman Pritchett, seconded by Councilman Gilbert to pull Item
J-4 from the Consent Agenda. This motion passed and carried by a 5-0 voice vote.
Motion offered by Councilwoman Pritchett, seconded by Councilman Bratton to pull
item J-8 from the Consent Agenda. This motion passed and carried by a 5-0 voice vote.
Attorney Dickens pulled Item J-5 from the Official Agenda.

(F) SPECIAL PRESENTATIONS (5 minutes each)
F-1) Jay Marder—2010 Census Update
Antranetta Pierre, Economic Development Manager appeared before the City Council
appeared before the City Council to recount the steps taken to kick off the 2010 Census
Campaign.
Anthony Jackson of the Marome Agency appeared before the City Council to further
expound on this Census Campaign, which included a community education component. He
highlights some of the major events held throughout the City, and acknowledged many of the
business owners, and community faith based organizations taking part in this venture. The end
result is that the City had a seventy-two percent (72%)response mail-in rate.
Jay Marder, Development Services Director appeared before the City Council and shared
while there was no history to compare the City's response with the last census, in looking at
other neighborhoods the City had a ten (10%)percent increase in the response rate.
Councilman Williams asked whether the census report would be able to provide a
breakdown of the various Caribbean nationals residing within the City of Miami Gardens.
Mr. Marder said this report would be able to identify the various Caribbean nationals as
well as tell you how many might live on a certain block.
Councilman Williams said it would be interesting to know the different variations on the
makeup of the City. He asked about the time frame to receive the complete census report.
Mr. Marder said the final mail participation rate would be received in September 2010.
Councilman Williams asked whether a return rate in a particular area could be
determined.
Mr. Marder said that information is available on the Census Site.
Councilwoman Pritchett thanked Mr. Marder and Ms. Pierre for their community
outreach during this Census Campaign.
Ms. Pierre provided the Census website as www.census.gov.
Mayor Gibson commended staff as well as Mr. Jackson for doing a phenomenal job on
this campaign.

F-2) Councilman Williams—John Casbarro,KAPOW Presentation
John Casbarro, 5522 114 Avenue, Cooper City, Florida, appeared before the City Council
to thank the City of Miami Gardens, its departments and staff for participating in the KAPOW
Program.
Councilman Williams said this is a wonderful program and makes a different in the lives
of the children participating in the program. He commended City of Miami Gardens staff for
their participation.
F-3) Councilman Gilbert—NAACP ACT-SO
Mr. Art Johnson, 2412 NW 108th Street, Miami, Florida, appeared before the Council to
provide information the NAACP ACT-SO Program. Established 32 years ago, ACT-SO is a
program which emphasizes academic achievement, encourages African Heritage students to
concentrate on their intellectual development and honors those who excel in the Visual and
Performing Arts, Sciences, Humanities and Entrepreneurship. In the spirit of World Olympics,
winners are presented with gold, silver and bronze medals. Gold medal winners ultimately
compete at the National ACT-SO finals,which will be held in Kansas City, July 8-13, 2010.
Mr. Johnson asked for the Council's support by way of sponsorship. He introduced two
of the gold medalists who reside in the City of Miami Gardens.
Councilman Gilbert shared this program was brought to his attention by Assistant City
Manager Vernita Nelson, who is a past champion. He said this is a worthwhile program and
brought the matter before the Council for consideration by way of sponsorship.
Motion offered by Councilman Gilbert, seconded by Mayor Gibson to allocate $2,800.00
from the Council's Contingency Fund, as a sponsorship for this organization.
Councilwoman Pritchett asked whether Mr. Johnson would be willing to come back to
the Council and provide a report on the outcome of the completion.
There being no further discussion this motion passed and carried by a 5-0 voice vote.
F-4) FY 09-10 Distinguished Budget Award
Manager Crew said the City takes its finances very seriously from the beginning. This is
the six year in a row the City has received this Distinguished award.
F-5) Dr.Danny Crew, City Manager—Employee of the Month
Manager Crew presented Ricardo Castillo, as Employee of the Month for the month of
April 2010. Paul Catania, also of the IT Department was recognized as Employee of the Month
for the month of May 2010.
(G) PUBLIC COMMENTS
Charles K. McCoy, 15940 NW 18th Court, Miami Gardens, Florida, appeared before the
City Council to request the Council member representing this residential area to be more visible

in the community. He further thanked the police department for working with the residents after
there was an increase in break-ins in the neighborhood. He asked the Council to address the
issue of noise in the neighborhood.
Sharon Frazier Stephens, 145 NE 193`d Street, Miami, Florida, appeared before the City
Council to expressed concern with young females being initiated into gangs. She encouraged the
continuation of the GEMS Program to combat this type of behavior. She further expressed
concern with the Red Light Camera Hearing process. She asked for consideration as it relates to
residents receiving Red Light Camera tickets. She further shared that the Special Master was
very generous in offering Stipulations to anyone wanting to pay their ticket without going
through with the hearing.
Mayor Gibson in response to Ms. Frazier-Stephens request to give Miami Gardens'
residents special consideration on the Red Light Tickets stated that the City cannot give any
special consideration. She further stated that as of July 1, 2010, the State of Florida will have
jurisdiction over Red Light Tickets. The fine will also increase to $158.00. All appears after
July Is'will be heard by Miami-Dade County Traffic Court.
Attorney Dickens expounded on the Red Light Camera issue by sharing that the court
cost would be an additional $120.00. She further clarified that the City Attorney's Office
through the City Manager's Office offered Stipulations prior to the Special Master Hearing. No
stipulations were offered by the Special Master.
Janice Coakley, 19681 NW 33`d Avenue, Miami Gardens, Florida, appeared before the
City Council and shared that she had difficulty downloading applications from the City's website
to apply for grants through the City's Community Development Department. She said she had
shared this concern with the City Manager and as of a few days ago residents were still have
difficulties downloading that application. She further stated that she had made a public records
request, which was not complete. Not all the documentation she requested was included in that
public records request.
Mayor Gibson advised Ms. Coakley that all public records request must go through the
Office of the City Clerk. That information will then be gathered from the various departments an
provided. If the information received by Ms. Coakley was incomplete all she has to do is to
notify the City Clerk.
Councilman Gilbert placed emphasis on the importance of providing records, not only to
a resident but for anyone requesting documentation, if that record exists.
Manager Crew said he had provided the bulk of what was requested by Ms. Coakley.
Information on the food vendors is still being gathered once that is done,that information will be
provided as well.

I-1) AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF
MIAMI GARDENS, FLORIDA, AMENDING SECTION 16 OF
ORDINANCE NO. 2005-10-48, TO INCREASE THE LOCAL
PREFERENCE FROM FIVE PERCENT (5%) TO TEN PERCENT
(10%); PROVIDING FOR THE ADOPTION OF
REPRESENTATIONS; REPEALING ALL ORDINANCES IN
CONFLICT; PROVIDING A SEVERABILITY CLAUSE; PROVIDING
FOR INCLUSION IN THE CODE; PROVIDING AN EFFECTIVE

Mayor Gibson passed the gavel to Councilman Gilbert to entertain any discussion on this
item.
Councilman Gilbert opened the floor for this public hearing. After there were no
interested parties to speak on this item,the public hearing closed.
Motion offered by Mayor Gibson, seconded by Councilwoman Watson to adopt this item.
Councilwoman Pritchett asked Mayor Gibson to expound on this item for the listening
audience.
Mayor Gibson shared the City currently offers a five percent to contractors wanting to do
business with the City of Miami Gardens, if they hire local vendors. She shared it has been
difficult trying to get contractors to hire local vendors for various city projects. She opined
offering a ten percent preference through the bidding process could be the incentive needed for
those contractors to consider hiring local vendors.
Councilwoman Pritchett asked Mayor Gibson to expound on the waiver procedure.
Mayor Gibson explained if there is a particular purchase or contract in a particular
category, then there may be a request for a waiver, which would be presented to the Council for
approval by written recommendation by the City Manager.
Attorney Dickens pointed out that language is not new, but is existing language in the
adopted ordinance.
At the conclusion of this discussion,the motion to adopt passed and carried by a 6-0 vote.

Mayor Gibson opened the floor for this public hearing.
Patricia Lightfoot, 2750 NW 172nd Terrace, Miami Gardens, Florida, appeared before the
City Council to get clarity on the schedule when the trash receptacles can be placed out for
pickup and when the trash receptacle should be removed once the trash has been picked up.
Councilwoman Watson in response to Ms. Lightfoot explained the trash receptacle can be
placed out no earlier than 7:00 p.m. the night before the scheduled pickup. The trash receptacle
should be returned to an inconspicuous location no later than 11:59 p.m., after the trash has been
picked up.
Ms. Lightfoot explained that no all areas within the City are treated the same when it
comes to the trash being picked up on schedule. She shared that there have been occasions in her
area where the trash has not been picked up on the scheduled date. Telephone calls are then
made to Miami-Dade County alerting them to the fact that the trash was not picked up. It might
be several days before that trash is picked up. She asked that consideration be given in a
situation like this.
Councilwoman Watson stated that in a situation like that it would behoove Ms. Lightfoot
to make contact with the City advising of this missed pickup.
Lemuel Wims appeared before the City Council to share that there are instances when the
regular trash driver is out sick and a substitute is handling the route. That substitute might not be
familiar with that route therefore, in some instances the trash might not be picked up. If
someone trash is not picked up they can call 305-653-2008, the trash will be picked up. He said
Miami Gardens' proposed ordinance is less restricted than what Miami-Dade County has in
place. Miami-Dade County's ordinance provides the trash cannot be put out no earlier than 7:00
a.m. on the day of trash pickup. The City's ordinance is allowing trash to be put out at 7:00 p.m.
the day before.
Attorney Dickens clarified Miami-Dade County's ordinance is a little broader than this
proposed ordinance. She asked Monica Barnes, Assistant City Attorney to provide a more
detailed explanation of the City's proposed ordinance.
Assistant City Attorney Monica Barnes appeared before the City Council to expound on

this ordinance. She said the City's proposed ordinance is allowing residents a little more time to
put their trash out, which is the night before, as opposed to the 7:00 a.m. morning of the
scheduled pickup. This ordinance also allows those residents who work the night shift to put out
and pick up their trash receptacles in a timely manner. This ordinance also provides for residents
to store their trash receptacles in the rear of their homes, and when they are not able to do so, on
the side of the property, and out of plain view.
Councilman Gilbert expressed concern with the enforcement of this ordinance as it
relates those individuals employed as firefighters and in the medical field. Their work hours
might vary. He said the City needs to be understanding with its enforcement.
Councilman Bratton asked who would one address this ordinance as it relates to a
townhouse complex. In a situation like that the trash receptacle cannot be placed in the rear of
the property.
Councilwoman Watson in response to Councilman Bratton's question, and shared in a
case like that the property owners are being asked to place the trash receptacle behind shrubbery
or beside the unit. She said the intent of the ordinance is not to punish the resident but to create a
better environment for the community.
Mayor Gibson expressed understanding of Councilman Bratton's concerns with the
townhouse units. In this particular case the trash receptacles cannot be located in the rear of the
property unless it is transported through the front door. Furthermore,this is no way to place this
trash receptacle on the side because of the side units of the townhouse.
Councilman Gilbert said from looking at the ordinance it only addresses prohibiting the
property owner from leaving the trash receptacle in the right-of-way.
Attorney Dickens suggested adding the language "where possible" to the end of the
sentence" Solid waste receptacles shall be stored in the rear or along the side of residential property
in an inconspicuous manner,except during scheduled solid waste collection."
Councilman Bratton said he wanted to make sure an exception was in placed for attached
units.
Attorney Dickens said an exception clause can be added as follows: "Solid waste
receptacles shall be stored in the rear or along the side of residential property, except for attached
units,in an inconspicuous manner,except during scheduled solid waste collection.
Motion offered by Councilman Bratton, seconded by Councilwoman Pritchett to amend
the ordinance providing for an exception for attached units.
There being no further discussion on the amendment, the motion passed and carried by a
6-0 voice vote.

Councilwoman Pritchett inquired about the funding this expenditure because in the
documentation provided several funds are listed including the Safe Neighborhood Park Fund as
well as the City of Miami Gardens Parks and Recreation Departmental Operating Budget.
Manager Crew in response to Councilwoman Pritchett's question said the bulk of the
funding will come from the Parks and Recreation Departmental Operating Budget.
Motion offered by Councilwoman Pritchett, seconded by Councilman Gilbert to adopt
this item. This motion passed and carried by a 6-0 voice vote.

J-8) A RESOLUTION OF THE CITY OF MIAMI GARDENS, FLORIDA
DECLARING THE CITY'S OFFICIAL INTENT TO REIMBURSE
ITSELF FROM THE PROCEEDS OF TAX-EXEMPT
OBLIGATIONS AND/OR TAXABLE OBLIGATIONS FOR
CERTAIN CAPITAL EXPENDITURES MADE AND TO BE MADE
BY THE CITY WITH RESPECT TO THE ACQUISITION AND
IMPROVEMENT OF LAND AND THE ACQUISITION,
CONSTRUCTION, IMPROVEMENT AND EQUIPPING OF A
NEW TOWN CENTER FACILITY THEREON CONTAINING A
CITY HALL, POLICE STATION AND PARKING GARAGE;
AUTHORIZING CERTAIN INCIDENTAL ACTIONS; AND
PROVIDING FOR AN EFFECTIVE DATE.(SPONSORED BY THE
CITY MANAGER)
Councilwoman Pritchett asked the City Manager to expound on this item.
Manager Crew explained the City had to hire a real estate expert to draw up a contract for
the new City Hall. That expert was paid out of the Capital Projects fund. This resolution allows
the City to once the bond has been issued and the moneys received, all those expenses/costs
incurred can be paid back. He said there will be approximately a quarter million dollars of
expenditures before the bond is issued. Those expenditures will come out of the fund balance.
Once the bond is issued, the fund balance can be repaid.

Motion offered by Councilwoman Pritchett, seconded by Councilman Gilbert to adopt
this item.
At the conclusion of this discussion, the motion to adopt passed and carried by a 5-1
voice vote. Councilwoman Pritchett cast the dissenting vote.
(M) REPORTS OF CITY MANAGERXITY ATTORNEY/CITY CLERK
M-1) City Manager's Monthly Report
Major Anthony Chapman of the Miami Gardens Police Department appeared before the
City Council to announce the City of Miami Gardens Police Department has released for public
review and comments its application for the Edward Byrne Memorial Assistance Grant(JAG)
Formula Program ($182,557.00); in accordance with the public comments requirements of the
Grant Program the city of Miami Gardens Police Department has made the Grant available for
public to review and comment from Friday, June 18, 2010 to Monday, July 19,2010. The Grant
can be reviewed at the Miami Gardens Police Department,the North Dade Regional Library,
Miami Gardens City Hall and the Miami Gardens Police Department website at
www.miami arg denspolice.org.
Mayor Gibson announced that the post office has changed its policy and now only
accepts passport applications by appointment. She asked the City Clerk if her office has been
directly affected by this new policy, and whether any additional advertisement is being done to
attract applicants.
Clerk Taylor said the volume of passport applications being process by the Office of the
City Clerk has increased. Information identifying the City of Miami Gardens is on the National
Passport Agency's website. The City of Miami Gardens accepts passport applications five days
a week from 8:30 am. To 3:30 p.m. Walk-ins are welcomed. No one gets turned away.
Councilwoman Watson asked whether the City Clerk had considered purchasing the
equipment to do passport pictures, in-house
Clerk Taylor said initially at the start of the passport program she had looked at
purchasing the digital camera equipment. The cost at that time was approximately $1,000. She
opined the volume at that time was not enough to justify the purchase.
(N) REPORTS OF MAYOR AND COUNCIL MEMBERS
Councilman Gilbert shared he attended a community meeting in Councilwoman
Watson's area. The residents had several questions about the inlet just south of Coconut Cay.
He said there were questions raised about who actually owned the inlet and who was responsible
for maintaining it. He shared that he told this group he would bring their questions to Council.
Manager Crew said staff has research the ownership aspect of this situation and has not
come up with a clear answer. However, the inlet is attached to Coconut Cay's aqua-system.
Coconut Cay is responsible for cleaning the inlet(Community Development District).

Councilman Gilbert said some of the homeowners said there are easements, but the
easements do not say who owns the land.
Attorney Dickens said this is the first time she is hearing about this issue. She said the
plats can be looked at or a title search done to determine who owns the inlet.
Councilwoman Watson said there are some other factors that have not been raised at the
dais. She said she did not know if the City would get a resolution because this is an extremely
complex situation. She opined the appropriate way to do this would be to workshop the matter
for discussion.
Councilman Bratton volunteered to be the voting delegate for the Florida League of
Cities Conference, August 19-21, 2010, Hollywood, Florida.
Mayor Gibson announced the City of Miami Gardens has earned a national recognition
(Tree City USA) from the National Arbor Day Society.
Mayor Gibson shared a thank you letter with the Council from the National Kidney
Foundation. This foundation was able to screen 112 individuals
