A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
MIAMI GARDENS, FLORIDA, AUTHORIZING THE CITY
MANAGER TO PURSUE ANNEXATION OF THE
UNINCORPORATED PORTION OF MIAMI-DADE COUNTY
LOCATED EAST OF THE CITY LIMITS ALONG NW 1ST
AVENUE, NW 176 STREET, NW MIAMI COURT, NE 181ST
STREET AND NE 5TH AVENUE, TOTALING APPROXIMATELY
134.41 ACRES, PROVIDING FOR INSTRUCTIONS TO THE CITY
MANAGER TO PROCEED WITH ANNEXATION; PROVIDING
FOR INCORPORATION OF RECITALS; PROVIDING FOR THE
ADOPTION OF REPRESENTATIONS; PROVIDING FOR AN
EFFECTIVE DATE.
WHEREAS, on December 11th, 2013, the City Council adopted Resolution
#2013-279-1975 authorizing the City Manager and City Attorney to initiate the required
steps to annex certain property from NW 211 Avenue south of NW 171St Street to 1-95
("Proposed Annexation Area") into the City of Miami Gardens' ("City") jurisdiction, and
WHEREAS, the City of Miami Gardens' annexation relates to a
commercial/industrial area known as the "Miami Industrial District - Section Four (4) per
Plat 27-15 and North Dade Industrial Tract per Plat 65-64 (Exhibit #1 and #2)", and
WHEREAS, the Proposed Annexation Area is bounded north by NW 183rd
Street between NW Miami Court & NE 2nd Ct; bounded on the west by NW Miami Court
between NW 183rd Street and NW 176th Street and NW 1st Avenue between 176th
Street and approximately NW 172nd Street; bounded on the east by NE 5th Avenue
from NE 181 st Street to NW 176th Street and East Drive between NW 177th Street to
NW 172nd Street and to the south by East Drive approximately between NW 1St Avenue
to NE 1St Avenue (See Attached Boundary Survey), and
WHEREAS, the proposed annexation area is estimated to add approximately
$98.4 million in tax revenues based on a 95% collection rate, offset by debt to taxable
assessed value ratio of 3.79%, and
WHEREAS, the City will develop a general land use plan and zoning for the
proposed annexation area, a timeline for providing Public Works services such as street
and sidewalk installation and repairs, drainage maintenance, swale maintenance, a
proposal addressing safety and security issues and an estimate of the costs to provide
such services, and
WHEREAS, on January 10, 2018, the City Council adopted Resolution #2018-
002-3315 authorizing the City Manager to submit an annexation application to the
Miami-Dade County Commission, and
WHEREAS, Section 20-3 of the Miami-Dade County code, "Initiation of the
Boundary Changes by a Municipality", states "any proposed boundary change desired
by the governing body of a municipality shall be initiated by resolution of such governing
body adopted after a public hearing held pursuant to written notice mailed to all owners
of property within the area and within six hundred (600) feet thereof in such proposed
boundary changes, according to the current tax assessment roll and pursuant to
published notice...", and
WHEREAS, on October 23, 2019, the City Council had a public hearing,
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF MIAMI GARDENS, FLORIDA AS FOLLOWS:
Section 1 : ADOPTION OF REPRESENTATIONS: The foregoing Whereas
paragraphs are hereby ratified and confirmed as being true, and the same are hereby
made a specific part of this Resolution.
Section 2: AUTHORIZATION: The City Council of the City of Miami Gardens
hereby authorizes the City Manager to pursue an Annexation of the unincorporated
portion of Miami-Dade County located east of the City limits along NW 1st Avenue, NW

176th Street, NW Miami Court, NE 181st Street and NE 5th Avenue, totaling
approximately 134.41 acres.
Section 3: EFFECTIVE DATE: This Resolution shall take effect immediately
upon its final passage.

GARDENS AT ITS REGULAR MEETING HELD ON NOVEMBER 13, 2019.
