A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
MIAMI GARDENS, FLORIDA, AWARDING REQUEST FOR
PROPOSAL NUMBER 16-17-042, STEP TWO FOR
CLOVERLEAF PARK IMPROVEMENTS TO GULF BUILDING
LLC; AND AUTHORIZING THE CITY MANAGER TO PROCEED
WITH NEGOTIATIONS; PROVIDING FOR THE ADOPTION OF
REPRESENTATIONS: PROVIDING FOR AN EFFECTIVE DATE.
WHEREAS, in April 2014, the City of Miami Gardens' residents approved a
General Obligation Bond in the amount of Sixty Million Dollars ($60,000,000), for the
construction of and improvements to the City's parks and related facilities, and
WHEREAS. on March 21, 2016. Staff issued Request For Qualifications (RFQ)
Number 15-16-030 for Cloverleaf Park Improvements, Step One, inviting Design-Build
firms or teams to provide qualifications for the City's consideration for the negotiation
and award of a future Design-Build contract for overall improvements to Cloverleaf Park,
and
WHEREAS, the RFQ was prepared in accordance with Florida Statue 287.055
Consultants Competitive Negotiation Act (CCNA), and
WHEREAS, a broadcast notice was sent to one thousand one hundred thirty five
(1,135) vendors, and
WHEREAS, on April 27, 2016, six (6) proposals were received and publicly read,
and
WHEREAS, on May 9, 2016, the Selection Committee short-listed four (4) firms:
Gulf Building, LLC; Recreational Design & Construction, Inc.; Stonehenge Construction,
LLC.. and West Construction, Inc., and
WHEREAS. on April 6, 2017, Request For Proposal (RFP) Number 16-17-042,
Step Two for Cloverleaf Park Improvements was issued to the four (4) short-listed firms,
and
WHEREAS, the RFP opened on June 12, 2017, and two (2) proposals were
received from Gulf Building. LLC., and West Construction, Inc.. and were publicly read,
and
WHEREAS. the Office of Procurement Management (OPM) applied the City of
Miami Gardens Business and Resident Economic Growth Plan (CMG-BREP)
preference to this project, and
WHEREAS. Gulf Building, LLC., and West Construction, Inc., were compliant to
the City's CMG-BREP, and
WHEREAS, on June 28, 2017, an Evaluation Committee meeting was held, and
WHEREAS, both Gulf Building, LLC., and West Construction, Inc.. were deemed
responsive and responsible to the requirements of the RFP, and
WHEREAS, on October 25, 2017, the City Council heard oral presentations, and
WHEREAS, in accordance with Florida Statutes 218.391(4)(b) "If compensation
is one of the factors established pursuant to paragraph (3)(a) and used in the evaluation
of proposals pursuant to paragraph (3)(d), the governing body shall select the highest-
ranked qualified firm or must document in its public records the reason for not selecting
the highest-ranked qualified firm,"
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF MIAMI GARDENS, FLORIDA AS FOLLOWS:
Section 1: ADOPTION OF REPRESENTATIONS: The foregoing Whereas
paragraphs are hereby ratified and confirmed as being true. and the same are hereby
made a specific part of this Resolution.
Section 2: AUTHORIZATION: The City Council of the City of Miami Gardens
hereby awards Request for Proposal Number 16-17-042, Step Two for Cloverleaf Park
RESOLUTION NO. 2017-162-3267
Gulf Building LLC
Improvements to Kiffl+ep+lefft, and further authorizes the City Manager to proceed with
negotiations.
Section 3: EFFECTIVE DATE: This Resolution shall take effect immediately
upon its final passage.

Staff Summary:
BACKGROUND
In April 2014, the City of Miami Gardens' residents approved a General Obligation Bond in the
amount of sixty million dollars ($60,000,000) for the construction of and improvements to the
City's parks and related facilities. The City Council subsequently approved a Bond
Implementation Plan that lists and details the proposed improvements at each park facility or
municipal property.

On March 21, 2016, staff issued Request For Qualifications (RFQ) Number 15-16-030 for
Cloverleaf Park Improvements, Step One, inviting Design-Build firms or teams to provide
qualifications for City consideration for the negotiation and award of a future Design-Build
contract for overall improvements to Cloverleaf Park, including but not limited to
renovating/remodeling the existing building, expanding, resurfacing and refurbishing the existing
basketball court and other facility improvements.
A broadcast notice was sent to one thousand one hundred thirty five (1 ,135) vendors. Sixty-two
(62) proposals were requested. The RFQ opened on April 27, 2016 and six (6) proposals were
received and publicly read. The RFQ was prepared in accordance with Florida Statute 287.055
Consultants Competitive Negotiation Act (CCNA).
On May 9, 2016, the Selection Committee short-listed four (4) firms: Gulf Building, LLC;
Recreational Design & Construction, Inc.; Stonehenge Construction, LLC and West
Construction, Inc.
CURRENT SITUATION
On April 6, 2017, Request For Proposal (RFP) Number 16-17-042, Step Two for Cloverleaf Park
Improvements was issued to the four (4) short-listed firms. The RFP opened on June 12, 2017.
Proposals were received from two (2) proposers, Gulf Building, LLC and West Construction, Inc.
Each proposal was publicly read.
The Office of Procurement Management (OPM) applied the City of Miami Gardens Business
and Resident Economic Growth Plan (CMG-BREP) preference to this project. Gulf Building, LLC
and West Construction, Inc., were compliant to the City of Miami Gardens Business Resident
Economic Growth Plan (CMG-BREP) (Exhibit 1).
An Evaluation Committee meeting was held on June 28, 2017. Gulf Building, LLC and West
Construction, Inc., were deemed responsive and responsible to the requirements of the RFP.
After evaluation and scoring, the Evaluation Committee ranked the two firms; West
Construction, Inc. (274.5), Ranking 1 and Gulf Building (247.58), Ranking 2. There are eight (8)
criteria considered during the evaluation; Experience/Ability, Project Understanding,
Approach/Method, Design, Schedule, CMG-BREP Compliance and Price. The Evaluation
Committee is tasked with providing a thorough review of the submitted proposal for four (4) key
areas; Experience/Ability, Project Understanding, Approach/Method and Design. Points are
added and a final score is tabulated. Guidelines are provided in the Request for Proposal (RFP)
document for schedule adherence and CMG-BREP compliance. Schedule and CMG-BREP
compliance are assessed by the Office of Procurement Management and points are provided.
Distribution of price points are calculated as a percentage of cost increase as compared to the
lowest responsive cost proposal received. The proposer with the lowest total cost will receive
100% of the available points (20). Each subsequent proposal will receive a percentage of the
total available points.

For example, if Proposer A submits a total cost of$15.000 and Proposer B submits a price of$16,000,
Proposer A will receive full points (20) and Proposer B would receive 18.75 points calculated as follows
[$15,0001$16,000 x 20].
The RFP document also provides for a maximum bid price. Proposals are accepted in excess of the
maximum bid price because all awards are negotiated to provide the City with the highest quality product
at the best price. The maximum bid price set for the work at Cloverleaf Park was $1.3 million. West
Construction submitted a price of $1.299M, while Gulf submitted a proposal with a price of $1.875M.
Based on the formula detailed above, West Construction received 20 points for price and Gulf Building
received 13.86. If price is eliminated from the computation, the scoring would be West Construction
(214.5) and Gulf Building (206). Further, staff is primarily concerned with three (3) key evaluation areas,
experience/ability; approach/method and design. Scoring in those areas resulted in a virtual tie; West
Construction (126.5) and Gulf Building (126). Finally, West Construction, Inc. has been awarded a
total of four (4) other bond projects totaling close to $20 million. Although work is proceeding,
staff has concerns regarding the firm's capacity to effectively manage and deliver a quality
product in a timely manner if awarded another project at this time.

Council's Office for review.
FISCAL IMPACT
The funding is derived from the General Obligation Bond and the amount listed in the RFP as
the maximum bid amount is available for this project.
Proposed action:
It is recommended that the City Council approves the attached resolution authorizing the City
Manager to negotiate and execute an agreement with for the
improvements at the Cloverleaf Park, Step Two as listed in Request for Proposal Number 16-
17-042.

At Gulf Building, a project involves more than just the successful and efficient completion of construction

Job description
Project Laborer: Perform tasks involving physical labor at construction sites. May operate hand and power
tools of all types: air hammers, earth tampers, cement mixers, small mechanical hoists, surveying and
measuring equipment, and a variety of other equipment and instruments. May clean and prepare sites, dig
trenches, set braces to support the sides of excavations, erect scaffolding, and clean up rubble, debris and
other waste materials. May assist other craft workers.
Gulf will work in collaboration with all subcontractors to obtain their buy-in for committing to work within
the guidelines of the City of Miami Gardens' CMG-BREP Plan for all phases of construction.
