D.B.A. N& J CONSTRUCTION, $13,917,486 WHICH INCLUDES A CITY- BUDGETED CONSTRUCTION CONTIGENCY OF 10% FOR THE CONSTRUCTION OF PHASE 1 CAROL CITY COMMUNITY CENTER; AUTHORIZING THE CITY MANAGER TO NEGOTIATE AND EXECUTE A CONTRACT FOR THIS PURPOSE; PROVIDING FOR THE ADOPTION OF REPRESENTATIONS; PROVIDING AN EFFECTIVE DATE. Backqround: Staff Summarv In June 1999, Miami Dade County (County) commissioned architect Judson Architecture, Inc., then Judson & Partners Architects, to perform architectural and engineering services in order to design a state-of-the-art youth education and sports center for the community. In 2002, after several community meetings and design changes, the master plan (Phases I, II and III) for the Carol City Community Center (CCCC) was approved by the County's Department of Parks and Recreation. However, prior to beginning construction, the project was placed on hold due to funding shortages within the County. In July 2004, via County Resolution No. R-982-04, the County transferred several parks, including the site of the proposed community center, to thP ~:~tv ~f Miami Gardens K-14) CONSENT AGEND~ Awarding Bid for construction of Phase 1 of Carol City Community Cente~ (City). The County Parks and Recreation Department subsequently transferred CCCC plans to the City, along with the remaining balances of various grant funding sources (totaling approximately $11.8M). The City established a capital improvement department to oversee the development and implementation of capital projects throughout the City, including planning, professional selection, monitoring, billing and compliance with all applicable conditions, contract requirements and grants. On November 10, 2004, the City via Resolution No. 2004-116-167 contracted Judson Architecture, Inc. to continue professional consulting services for Phases IV and V, which included bid assistance and construction administration. However, upon review of the plans transferred to the City by Miami Dade County, City staff requested additional design changes to ensure that the building was in compliance with current codes and would meet the needs of the residents as indicated in the City's visioning process. Those design changes included color palette schemes, building elevations to the community center, the addition of fencing, restrooms, concessions, bleachers with press box, increased parking, bollard and security lighting and dumpster enclosures. Bid Evaluation Process: Due to the fact that the City inherited construction documents that were substantially complete, staff determined that the only feasible course of action would be to proceed with the project utilizing the design-bid-build method. Design-bid-build is a process through which the architect or engineer designs the project and is also responsible for providing the construction documents (project specifications, plans, etc.); the city then solicits for a general contractor through an invitation to bid (ITB) process. The City's ITB for the CCCC encouraged minority and small business participation and stipulated the provisions of the City of Miami Gardens Code of Ordinances Sec. 16, regarding local business preference. In addition, with respect to promoting minority participation, the City encouraged Small, Minority, and Women's Businesses to participate in this solicitation and sent direct notices via email to minority-owned contractors including contractors in the City. . In accordance with the City of Miami Gardens purchasing ordinance, when the ITB process is used qualified staff and technical consultants are responsible for determining the lowest responsible responsive bidder. On September 17, 2007, the City issued an ITB for general construction services for the community center, running track, football/soccer field, and nature preserve. A broadcast notice was sent to 1,373 bidders. Twenty-six bidders attended the mandatory pre-bid conference held October 9, 2007 for all prospective bidders. Six bids were received on November 21, 2007 and publicly read. Of the six (6) proposals received, two (2) were deemed non-responsive due to one or more of the following issues: (1) incomplete bid package/missing documentation, and/or (2) did not list subcontractors as required by bid instructions. The bids were evaluated for (1) compliance with the bid specifications, (2) the company's ability to complete the construction within the required time frame, (3) financial stability of the company, (4) lowest bid price, and (5) evidence of prior comparable experience. 2 Based on the evaluation, the apparent low and responsive bidder is Perez-Gurri Corp. d.b.a. N& J Construction, located in Miami, Florida. Reference and background evaluations were conducted and found favorable. In addition, site visits were conducted on several existing and current construction projects by staff. Financial records were analyzed by the City's Finance Director and were deemed satisfactory. The City's architect consultant, Judson Architecture, performed a thorough analysis of the line item bid and the City's project manager reviewed the bid to verify the technical expertise of the bidders. The evaluation team found N& J Construction to be the most responsive responsible low bidder. Copy of the tabulation and supporting documentation is attached as Exhibit A. A copy of the bid document, plans and references were also made available for Council review ( files located at assistant to the mayor and council's office). Construction Timeline & Manaqement: The proposed schedule for the CCCC construction will be 440 working days, upon immediate execution of the contract; mobilization is scheduled for approximately January 2, 2008. If approved by Council, the construction contract is expected to be executed along with payment bond, liability insurance certificate submitted to City no later than December 27, 2007. The City will schedule a pre-construction meeting at which time a notice to proceed will be issued to begin mobilization. At mobilization of services, the City's newly hired Project Manager will be on-site to monitor the progress of construction. Consultant architect Judson Architecture will also make periodic visits to the construction site, in accordance with their existing professional services agreement, to ensure the adherence of plans and architectural integrity of the building(s). Fundinq Phase I construction includes the community center, surrounding restroom/concession facilities, parking lots, running track and field, irrigation, landscaping and the nature preserve (to host the burrowing owls). Based on cost estimates provided by the architect, the City budgeted $14,862,102; N&J bid $12,652,260 (a cost savings of $2,209,842 or 17%). The City has set aside a 10% construction cost contingency of $1,265,220 for a total project cost of $13,917,486. Funding for Phase I improvements is made part by Building Better Communities General Obligation Bond, Quality Neighborhood Improvement Program, Safe Neighborhood Parks, National Football League's Miami Dolphins and City funds. Several of the grants have expiration deadlines quickly approaching and therefore, this project is scheduled for fast track permitting and expedited construction services. Phase II of the project is currently being designed and will include the construction of the outdoor amphitheater, multipurpose field and perimeter fencing for a total estimated cost of $24M (Phases I & II). 3 Recommendation It is recommended that the City Council approve the attached resolution authorizing the City Manager to negotiate and execute a contract with Perez-Gurri Corp. d.b.a N& J Construction, located in Miami, Florida, the amount of $13,917,486 which includes a 10% City budgeted contingency, for the construction of Phase 1 Carol City Community Center. 4 Exhibits: A: Bid Tabulation B. D.B.A. N& J CONSTRUCTION, $13,917,486 WHICH INCLUDES A CITY BUDGETED CONSTRUCTION CONTIGENCY OF 10% FOR THE CONSTRUCTION OF PHASE 1 CAROL CITY COMMUNITY CENTER; AUTHORIZING THE CITY MANAGER TO NEGOTIATE AND EXECUTE A CONTRACT FOR THIS PURPOSE; PROVIDING FOR THE ADOPTION OF REPRESENTATIONS; PROVIDING AN EFFECTIVE DATE. 1 WHEREAS, in June 1999, Miami Dade County commissioned architect Judson 2 Architecture, Inc., to perform architectural and engineering services in order to design a 3 state-of-the-art youth education and sports center for the community ("Carol City 4 Community Center"), and 5 WHEREAS, in 2002, the project was placed on hold due to funding shortages 6 within the County, and 7 WHEREAS, in July 2004, via County Resolution No. R-982-04, the County 8 transferred several parks, including the site of the proposed community center, to the 9 City, and 10 WHEREAS, the Miami-Dade County Parks and Recreation Department 11 subsequently transferred the Carol City Community Center plans to the City, along with 12 the remaining balances of various grant funding sources (totaling approximately 13 $11.8M), and 14 WHEREAS, on November 10, 2004, the City via Resolution No. 2004-116-167 15 contracted Judson Architecture, Inc. to continue professional consulting services for 16 Phases IV and V, which included bid assistance and construction administration; 17 However, upon review of the plans transferred to the City by Miami Dade County, City 18 staff requested additional design changes to ensure that the building was in compliance 19 with current codes and would meet the needs of the residents as indicated in the City's 20 visioning process, and 21 WHEREAS, due to the fact that the City inherited construction documents that 22 were substantially complete, staff determined that the only feasible course of action 23 would be to proceed with the project utilizing the design-bid-build method, and 24 WHEREAS, on September 17, 2007, the City issued an Invitation to Bid for 25 general construction services for the community center, running track, football/soccer 26 field, and nature preserve, and 27 WHEREAS, of the six (6) proposals received, two (2) were deemed non- 28 responsive due to one or more of the following issues: (1) incomplete bid 29 package/missing documentation, and/or (2) did not list subcontractors as required by 30 . bid instructions, and 31 WHEREAS, the bids were evaluated for (1) compliance with the bid 32 specifications, (2) the company's ability to complete the construction within the required 33 time frame, (3) financial stability of the company, (4) lowest bid price, and (5) evidence 34 of prior comparable experience, and 35 WHEREAS, based on the evaluation, the apparent low and responsive bidder is 36 Perez-Gurri Corp. d/b/a N& J Construction, located in Miami, Florida, and 37 WHEREAS, reference and background evaluations were conducted and found 38 favorable; site visits were conducted on several existing and current construction 39 projects by staff, and financial records were analyzed by the City's Finance Director and 40 were deemed satisfactory, and 41 WHEREAS, the City's architect consultant, Judson Architecture, perFormed a 42 thorough analysis of the line item bid and the City's Project Manager reviewed the bid to 43 verify the technical expertise of the bidders, and 44 WHEREAS, the evaluation team found N& J Construction to be the most 45 responsive responsible low bidder, and is recommending that the City contract with N&J 46 to construct the Carol City Community Center, 47 NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY 48 OF MIAMI GARDENS, FLORIDA, AS FOLLOWS: 49 Section 1.
