GARDENS, FLORIDA, AUTHORIZING THE CITY MANAGER TO ISSUE
A PURCHASE ORDER TO SHAW CONTRACT FLOORING SERVICES,
INC. D/B/A SPECTRA CONTRACT FLOORING IN AN AMOUNT NOT TO
EXCEED ONE NINETY NINE THOUSAND THREE HUNDRED EIGHTY-
EIGHT DOLLARS AND SEVENTY-ONE ($99,388.71) CENTS FOR THE
PURCHASE AND INSTALLATION OF FLOORING IN THE NEW POLICE
DEPARTMENT FACILITY; PROVIDING FOR THE ADOPTION OF
REPRESENTATIONS; PROVIDING AN EFFECTIVE DATE.
Staff Summarv
On April 11, 2007, the City Council authorized the purchase of property to house the Police
Department and all services related to the operation of that department. As part of the general
renovations, an assessment of certain aspects of the building have been made as to what
equipment and furnishings can be used in its current state and what must be repaired and/or
replaced. Staff has determined that the flooring throughout the building is in a state of disrepair
and is beyond routine cleaning to render it functional. The carpet is stained in many locations,
has been torn in places, and displays the wear of being in a building occupied by 200 plus
individuals for a lengthy period.
Analvsis:
The State of Florida has currently awarded contracts to several flooring manufacturers. Staff
has received several samples of various types of flooring and consulted with industry
professionals as to the type of flooring which should be installed. The conclusion of staff was to
purchase a variety of flooring to meet the individual space needs in the building. The flooring
options will include carpet tiles, laminate floors, and rubber flooring for the training room.

FLOORING
A quote of $99,388.71 has been received from Shaw Contract Flooring Services, Inc. d/b/a
Spectra Contract Flooring (Attachment A) for the purchase of floor products which will be
provided by different manufactures. The flooring demolition and the new installation will be
conducted by Spectra. This purchase will satisfy the flooring needs of approximately 90% of~the
building. The remaining flooring will be provided in the renovations being conducted by the City
contracted architect. These flooring areas will need special conditions such as impenetrable
floors for the prisoner area and flooring specific to the lobby area renovation. Funding for this
purchase is available in the building bond.
Recommendation:
We recommend that the City Council approve the attached resolution authorizing the City
Manager to issue a purchase order in accordance with the State of Florida flooring contract in
an amount not to exceed $99,388.71 to Shaw Contract Flooring Services, Inc. d/b/a Spectra
Contract Flooring for the purchase and installation of flooring.

1 WHEREAS, the City has acquired improved property to house its newly
2 organized police department, and
3 WHEREAS, as anticipated, an inspection of the property reveals a need to
4 remove existing floor covering, which is no longer serviceable, and to replace the same
5 with floor covering suitable to the anticipated use, and
6 WHEREAS, it is important to the overall welfare of the community that it present
7 a pleasing face to the public and a clean, safe, adequate and aesthetically-pleasing
8 environment to its workforce, and
9 WHEREAS, the State of Florida has awarded various contracts to several
10 flooring manufacturers, and the City has an opportunity to "piggy-back" off the State bid,
11 and
12 WHEREAS, the staff has reviewed various contracts and materials and has
13 found that Shaw Contract Flooring Services, Inc. d/b/a Spectra Contract Flooring
14 reflects the most appropriate materials and services for the purposes intended,
15 NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
16 OF MIAMI GARDENS, FLORIDA, AS FOLLOWS:

17 Section 1. ADOPTION OF REPRESENTATIONS: The foregoing Whereas
18 paragraphs are hereby ratified and confirmed as being true, and the same are hereby
19 made a specific part of this Resolution.
20 Section 2. AUTHORIZATION; The City Manager is hereby authorized and
21 directed to issue a purchase order in accordance with the State of Florida contract in
22 favor of Shaw Contract Flooring Services, Inc. d/b/a Spectra Contract Flooring in an
23 amount not to exceed Ninety Nine Thousand Three Hundred Eight-Eight Dollars and
24 Seventy-One ($99,388.71) Cents for the purchase and installation of flooring, including
25 the demolition and the disposal of existing floor coverings, in the new police department
26 facility.
27 Section 3. EFFECTIVE DATE: This Resolution shall take effect immediately
28 upon its final passage.

We PROPOSE to perform the work complete in accordance with the specifications and as described above for the SUM of:

Conditions of Proposal:
1. This proposal may be withdrawn it not accepted within 30 days of its issuance. Spectra will consider reasonable requests to engage in negotiations for revisions to this Proposal,
including signing a subcontract that incorporates the terms of this Proposal. A proposal not accepted within 30 days will be subject to price escalation for materials.
2. This proposal is subject to credit review and approval. Payment terms are net 30 days. Past due invoices are subject to service charges of ti.5% per month (18% per annum). In
the case of any default, Customer shall pay Spectra's reasonable attorney fees and costs, including those on any appeal, even if no suit or action is fiied.
3. All work shall be pertormed in a workman~ike manner according to industry standards. Areas to receive flooring shall be free and clear of debris. Any changes to the work shall b~
pertormed only after execution of a written change order.
4. Prior to commencement of Spectra's work: (a) Customer shall test all concrete sub floors receiving flooring for vapor emission levels and alkalinity per ASTM F-1869 and provide
written results to Spectra, including a list of any sealers applied to the concrete sub floor; (b) If Customer does not provide such reports at least 10 days prior to commencement c
Spectra's work, then Customer shall provide Spectra with access to all concrete sub floors for appropriate testing and Customer shall be responsible for the costs of such testing;
and (c) Any concrete sub floors not meeting manufacturers' requirements for installation will require correction or the execution of a separate waiver agreement.
5. All work is contingent upon strikes, accidents or delays beyond Spectra's control. Customer shall carry insurance for all hazards, including fire. Spectra's workers are fully covere~
by Worker's Compensation and Liability Insurance.
6. Customer represents and warrants that: (a) the project site contains no hazardous or other dangerous substances, either exposed or concealed; or (b) Customer has given written
notice to Spectra of all such substances and their location(s). To the fuflest extent permiried by law, Customer shall indemnify, defend and hold Spectra harmless from any
damage, claim, loss, expense a~d attorney fees related to Spectra's liability, if any, including any federal or state statute related to hazardous or other dangerous substances.
7. Spectra is fully licensed, bonded, and insured. This proposal does not include participation in any OCIP/CCIP or related programs. Requests for Spectra to participate in such
programs may result in additional costs.
ACCEPTANCE OF PROPOSAL: The above prices, specifications, and conditions are satisfactory and are hereby ACCEPTED.
