Staff Summary In order for the the Miami Gardens Police Department (MGPD) to begin operations in December it will be necessary for the Department to successfully implement, test and train on the Department's computer network, a connection with the Florida Department of Law Enforcement's (FDLE) Criminal Justice Network (CJNET) is imperative. A new version of CJNET (FCIC II) is coming online during the later stages of 2007 and the Miami Gardens Police Department is expected to be one of the first agencies to receive this new system. Until this new system is implemented it will be necessary for a connection via the old system between FDLE and the police department to be established. J-2) CONSENT AGENDA RESOLUTION DIVER5IFIED COMPUTIN~G, INC. Through our networking consultant, BearingPoint Enterprises, a contract has been negotiated with Diversified Computing to provide a connection from FDLE to the MGPD on a month to month basis for the purposes of training and nefinrork implementation. This contract will be in effect until the FCIC II system is implemented and tested by FDLE and subsequently installed at the MGPD which is expected by December 2007. Recommendation: That the City Council authorize the City Manager to execute the attached contract with Diversified Computing, Incorporated for the purposes of providing a connection to the Police Department from FDLE. RESOLUTION No. 2007- A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF MIAMI GARDENS, FLORIDA, AUTHORIZING THE CITY MANAGER AND CITY CLERK TO EXECUTE AND AITEST, RESPECTIVELY, THAT CERTAIN CONTRACT FOR SERVICES BETWEEN THE CITY OF MIAMI GARDENS AND DIVERSIFIED COMPUTING, INC., TO PERMIT THE CITY OF MIAMI GARDENS TO CONNECT INTO THE FLORIDA CRIMINAL JUSTICE NETWORK AT A FEE OF $200.00 PER MONTH, A COPY OF WHICH IS ATTACHED HERETO AS EXHIBIT A; PROVIDING FOR INSTRUCTIONS TO THE CITY CLERK; PROVIDING FOR THE ADOPTION OF REPRESENTATIONS; PROVIDING AN EFFECTIVE DATE. 1 WHEREAS, the MGPD has the responsibility to provide police service to the 2 residents of the City of Miami Gardens and must have access to an FCIC/NCIC 3 connection for the purposes of conducting training, background and criminal checks, as 4 well as entering stolen vehicles and items into the data network, and 5 WHEREAS, Diversified Computing has agreed to allow the City of Miami 6 Gardens to use their license to permit the City to access the Florida Criminal Justice 7 Network, 8 NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY 9 OF MIAMI GARDENS, FLORIDA, as follows: 10 Section 1. ADOPTION OF REPRESENTATIONS: The foregoing Whereas 11 paragraphs are hereby ratified and confirmed as being true, and the same are hereby 12 made a specific part of this Resolution. 13 Section 2. AUTHORITY: The City Manager and City Clerk are hereby 14 authorized and directed to execute and attest, respectively, that certain contract for 15 services befinreen the City of Miami Gardens and Diversified Computing, Inc., to permit 1 16 the City of Miami Gardens to connect into the Florida Criminal Justice Network at a fee 17 of $200.00 per month, a copy of which is attached hereto as Exhibit A. 18 Section 3. INSTRUCTIONS TO THE CITY CLERK: The City Clerk is hereby 19 20 21 22 23 24 25 26 27 28 29 30 31 32 33 34 35 36 37 38 39 40 41 42 43 44 45 46 47 48 49 50 51 authorized to obtain three (3) fully executed copies of the subject Agreement, with one to be maintained by the City; with one to be delivered to Diversified Computing, Inc., and with one to be directed to the Office of City Attorney. Section 4. EFFECTIVE DATE: This Resolution shall take effect immediately upon its final passage. AND THE CITY of MIAMI GARDENS CONTRACT FOR SERVICES This agreement made this 9th day of October, 2007, between Diverse Computing, Inc (DCI), herein after referred to as the "Provider" whose address is 2957 Capital Park Drive, Suite 10, Tallahassee, FL 32301 and the City of Miami Gardens herein after referred to as "CMG" whose offices are located at 1515 NW 167th Street, Suite 200 Miami Gardens, Florida 33169. WITNESSETH WHEREAS, the CMG recognizes the need for the Florida Criminal Justice (CJNET) connectivity product of the Provider, and desires to subscribe to the product in connection with the discharge of the responsibilities of the Miami Gardens Police Department (MGPD), and WHEREAS the MGPD has the responsibility to provide police service to the residents of CMG and must have access to an FCIC/NCIC connection for the purposes of conducting training, background and criminal checks; as well as entering stolen vehicles and items into the data network, and WHEREAS, Provider desires to provide their CJNET connectivity product to the CMG; and NOW THEREFORE, in consideration of the mutual covenants and understandings set forth herein, the parties agree to as follows: 1. TERM: The term of this Agreement shall be for a period of one month, commencing upon Contract sign date, "Effective Date". Thereafter, this Agreement shall automatically renew for successive one (1) month periods unless either party provides written notice of termination at least twenty (20) days prior to the end of the initial or any renewal term. 2. FEE: Provider shall be reimbursed the amount of $200.00 per month, "Monthly Fee". MODIFICATION: It is agreed that all particulars contained in this document are binding on both parties. Any variation, alteration, modification, or waiver of provisions of the contract shall only be valid when they have been reduced to writing, duly signed, approved by both parties, and attached to the original of this contract. 4. DUTIES OF PROVIDER: 1. Provide CMG one (1) Cisco VPN client license. 2. Provide CMG one (1) user login for Cisco VPN client to connect to Provider VPN Concentrator at The Tallahassee Community Police Department (TCCPD), located in Tallahassee, FL. 3. Provide CMG secure CJNET connectivity via Cisco VPN client connection to Provider VPN Concentrator at TCCPD. 4. Provide technical and operational support (8-5 Mon-Fri) related to CJNET connectivity. 5. DUTIES OF CMG: A. The CMG agrees to: 1. Utilize only one instance of the provided Cisco VPN client and user login. 2. Notify FDLE network and information security personnel of FCIC II Development access by the MGPD. 3. Utilize CJNET connectivity ONLY for FCIC II TEST Message Switch Access. Production system access will be granted upon written approval of FDLE. 4. Provide Internet connectivity to facilitate network access to Provider VPN Concentrator. 5. Comply with all FDLE rules and regulation relating to CJNET access. 6. Pay Provider the Monthly Fee for the first Agreement Term within 30 days of the Effective Date and subsequent Monthly Fees and within 30 days of each renewal date as applicabie. 6. BOTH PARTIES AGREE: A. Not to use or disclose any information concerning products/services provided to the MGPD for any purposes not in conformity with state regulations and Federal law or regulations except upon written consent. 7. TERMINATION: Either party may terminate this contract upon no less than twenty (20) days written notice being sent by Certified Mail, Return Receipt Requested, to the usual business address of the other party. . 8. FEDERAL AND STATE REGULATIONS: Both parties agree to comply with all applicable provisions of the Federal and State administrative Rules and Regulations, in regards to products/services delivered under this contract. 9. GOVERNING LAW: This Agreement is governed by the laws of the State of Florida, as if pertormed wholly within the state and without giving effect to the principles of conflict of law.
