Crew, City Manager Date: September 13 , 2007 RE: FY 07 Budget Amendment As we approach the end of our fiscal year, it is necessary to make several adjustments in our current adopted budget. The two big items involve items that are currently in the adopted budget, but were budgeted in the wrong Fund. The first involves a$145,000 grant we received from Miami-Dade County for fa~ade renovation. This was budgeted in the Development Services Fund since at the time, that was the closest thing we had to a community development department. Since last October however, we have hired a new CDBG Director and have allocated additional funds for fa~ade work in the CDBG budget. It makes more sense that the grant be administered from this department rather than planning. The second transfer involves moving the original $7.5 million Capital Facilities bond proceeds from the General Fund to the Capital Projects Fund. These funds have now been spent on the police station, public works, NW 27t" Avenue beautification and Rolling Oaks Park addition; however, since payments fro these projects were made from the Capital Projects Fund, it is necessary to transfer the monies from the General Fund to the Capital Projects Fund. Finally, since our budget was approved last September, the City has received $615,000 in State Housing Initiative Partnership (SHIP) funds for our housing program. The State requires that these be kept in a separate fund and physically, the money has to be kept in a separate bank account. These were done in order to receive the grant. This confirms that set up. RECOMMENDATION: That City Council approve the ordinance on first reading. H-1) ORDINANCE 1 ST READING CITY'S BUDGET F/Y 2006-2007 Ordinance No. ORDINANCE NO. 2007 AN ORDINANCE OF THE CITY OF MIAMI GARDENS, FLORIDA, AMENDING THE CITY'S BUDGET FOR 2006-2007 FISCAL YEAR; CREATING CERTAIN FUNDS; AUTHORIZING THE CITY MANAGER TO MAKE CERTAIN ADJUSTMENTS; AUTHORIZING THE CITY MANAGER TO TAKE ALL ACTIONS NECESSARY TO IMPLEMENT THE TERMS AND CONDITIONS OF THIS ORDiNANCE; PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, in accordance with Section 4.5 of the City of Miami Gardens Charter, the City Council adopted a Budget for Fiscal Year 2006-2007, and WHEREAS, the City Manager recommends that the City establish certain accounting funds for the FY 06-07 budget, and WHEREAS, it is appropriate to provide for certain transfers, appropriations and authorizations based upon previous and anticipated expenditures and revenues, WHEREAS, the City Council has determined that it is necessary to amend the budget to reflect these changes, NOW THEREFORE BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF MIAMI GARDENS, FLORIDA, AS FOLLOWS: SECTION 1. ADOPTION OF REPRESENTATIONS: The foregoing Whereas Clauses are hereby ratified and confirmed as being true, and the same are hereby made a specific part of this Ordinance. SECTION 2. AMENDMENT TO BUDGET: A. The following amounts are hereby transferred for the operation and maintenance of the various Funds below, said monies currently appropriated as part of the adopted annual operating budget for the fiscal year beginning October 1, 2006, and ending September 30, 2007: From Page 1 of 3 Revised FY 07 Budget Ordinance Ordinance No. Development Services Fund 15-00-00-337-705-00 ($145,000) To Community Development Block Grant Fund 14-00-00-331-716-00 $145, 000 From General Fund 01-00-00-389-900-00 ($7, 500, 000) To Capital Projects Fund 30-00-00-337-705-00 $ 7,500,000 B. The following amounts are hereby appropriated as part of the adopted annual operating budget for the fiscal year beginning October 1, 2006, and ending September 30, 2007: Revenues Community Development Block Grant Fund 14-00-00-331-716-00 $145, 000 Expenditures Community Development Block Grant Fund 14-13-01-513-647-00 $145, 000 Revenues Capital Projects Fund 30-00-00-337-705-00 $7, 500, 000 Expenditures Capital Projects Fund 30-12-01-512-611-00 $7, 500, 000 C. The City Manager is authorized to establish the State Housing Incentive Partnership (SHIP) Grant Fund in the amount of the grant received, $613,000 and to establish a separate bank account per grant requirement to hold such funds. SECTION 3. INSTRUCTIONS TO THE CITY MANAGER: The City Manager shall take all actions necessary to implement the terms and conditions of this ordinance. SECTION 4. CONFLICT: All ordinances or Code provisions in conflict herewith are hereby repealed. Page 2 of 3 Revised FY 07 Budget Ordinance Ordinance No. SECTION 5. SEVERABILITY: If any section, subsection, sentence, clause, phrase or portion of this Ordinance is for any reason held invalid or unconstitutional by any court of competent jurisdiction, such portion shall be deemed a separate, distinct and independent provision and such holding shall not affect the validity of the remaining portions of this Ordinance. SECTION 6. EFFECTIVE DATE: This ordinance shall take effect immediately upon its passage. PASSED on first reading this day of , 2007. PASSED AND ADOPTED on second reading this day of , 2007.
